J&A Number: 117003 Code: 104 PR Number: TBD
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 Contracts Department, Code 02.
2. Description of the Action Being Approved
This is a justification and approval to award a Firm Fixed Price (FFP) contract, on a brand name basis, to upgrade existing Solidworks software versions in use by engineering and scientific personnel at NSWC PCD. The requirement will be a competitive small business set aside to Solidworks retailers authorized to service the Panama City, Florida region.
3. Description of Supplies/Services
The Contractor shall provide upgrade to various Solidworks software versions currently in use by NSWC PCD technical personnel, an estimated 137 owned licenses. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The estimated value of this effort is not to exceed $276,000.00. All software will be delivered no later than thirty (30) days after award of the order. The contract action will be funded with various sources of FY17 funds Research, Development, Test & Evaluation (RDT&E) funds.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) – Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1(c), Application for brand name descriptions.
5. Rationale Justifying Use of Cited Statutory Authority
The NSWC PCD technical community requires a means of creating Computer Aided Design (CAD) models and drawing files to design and document systems in support of multiple Littoral, Expeditionary Warfare, and Science and Technology (S&T) programs. The Solidworks products include tools for 3D modeling, assembly, drawing, sheet metal, weldments, and freeform surfacing. It can import numerous file types from other 2D and 3D CAD programs and has been in use by NSWC PCD for over five years. This purchase is brand name specific for the following reasons. The commercially available Solidworks software is required by NSWC PCD technical personnel to produce deliverables in Solidworks format. The software upgrade requested in this acquisition provides continued Solidworks software capability for supporting existing tasks. The acquisition of another brand will cause NSWC PCD to replace the existing CAD platform and migrating ongoing projects into a different system, procure specific sessions to train personnel, and delay projects until the personnel and the systems reach maximum capabilities to utilize a different software platform. As a result, the Government would expect recurring costs associated with the labor hours that each single user would require to achieve an acceptable level of proficiency with other platforms. As such, it is advantageous to the Government to procure Solidworks upgrades on a brand name basis.
6. Description of Efforts Made to Solicit Offers From as Many Offerors as Practicable.
This proposed acquisition will be synopsized on the Federal Business Opportunities government point of entry, on a small business set aside basis, no preference. Based on extensive procurement history, the Government expects adequate competition from authorized Solidworks retailers. If this solicitation does not yield adequate competition, the Government will extend the response time and/or open the solicitation to allow the participation of large businesses to achieve the maximum extent of competition.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable pursuant to FAR Part 13.501.
8. Actions to Remove Barriers to Competition.
For the reasons set forth in Paragraph 5, NSWC PCD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges NSWC PCD will assess whether competition for future requirements is feasible.
