J&A Number: 116005 Office: Code P.R. Number:

JUSTIFICATION AND APPROVAL (J&A)

TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001, Contracts Department, Code .

2. Description of the Action Being Approved

Authorization to procure commercially available parts for the Landing Craft Air Cushion (LCAC), Command, Control, Communications, Computers, and Navigation (C4N) Systems project from Alta Data Technologies LLC, 4901 Rockaway Blvd N E Suite A, Rio Rancho NM 87124-4503 on the basis of other than full and open competition.

3. Description of Supplies/Services

This acquisition is for eighty-five (85) Ethernet appliances with one channel of dual redundant MIL-STD-1553, P/N: ENET2- 1553-1D-E used for the LCAC C4N System Baseline Configuration 4 (SBC4) ENET 1553 assembly with options for an additional twenty

(20) Ethernet appliances.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The total estimated amount of this acquisition including options is

A firm-fixed-price commercial item contract is anticipated using fiscal year (FY) funds as follows:

Appropriation FY16 FY17 FY18 Total

Delivery will be to NSWC PCD eight (8) weeks after award of the contract or exercise of any option.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority

NSWC PCD is the design authority for the LCAC C4N systems. These systems are part of the Service Life Extension Program (SLEP).

The Amphibious Warfare Program Office SLEP program of record will upgrade legacy craft from FY01 until FY18. Thirty (30) of these craft configured with System Baseline Configuration Two (SBC2) will be technology refreshed with System Baseline Configuration Four (SBC4) from FY 2016 through FY 2018. The parts requested in this J&A are part of a build to print data package whose assembly will be provided as Government Furnished Equipment (GFE) to an Alteration/Installation Team (AIT) for integration with SBC4 installation kits. The Ethernet appliances being purchased are commercial items manufactured by Alta Data Technologies as part of the end item assembly. This procurement is not suitable for full and open competition and it is in the best interest of the Government to acquire these items using a non-competitive procurement for the following reasons:

a. Alta Data Technologies LLC is the only company that makes this commercial item that is compliant with the SBC4 Technical Data Package (TDP).

b. NSWC PCD conducted a Sources Sought Notice/Request for Information (RFI) N6133113SNQ07 in September 2013. A total of six vendors responded to this RFI. After analysis of the RFI results, three vendors were identified as meeting the Government’s specifications for integration and establishment as part of the TDP. Since multiple commercial products were identified through the RFI, a competitive Request for Quote (RFQ) was issued to industry using the same technical specifications referenced in the RFI through FedBid. From this RFQ, Alta Data Technologies LLC was selected as the lowest price technically acceptable source and was awarded N61331-14-P-8502.

The Ethernet appliance purchased under this purchase order was integrated into an assembly, called the “ENET-1553 UNIT”, which is used to provide 1553 data communication capabilities to the LCAC C4N SBC4 system. Additional quantities were purchased from Alta Data Technologies LLC under order N61331-15-P-4539 in April 2015 to support testing. The ENET-1553 unit was tested in conjunction with the rest of the components of the SBC4 system from May 2014 until November 2015. Alta Data Technologies LLC’s ENET2-1553-1D-E passed all minimum specification performance tests. Testing involved the following: functional qualification testing in a lab environment, operational testing on LCAC 91 and environmental qualification testing at a certified environmental test facility. Alta Data Technologies LLC’s ENET2-1553-1D-E was certified as part of the ENET-1553 UNIT and total SBC4 system qualification. The ENET2-1553-1D-E is one of several integration cornerstones for the SBC4 system and formulation of the TDP.

c. The cost to develop, test, evaluate, and requalify a new Ethernet appliance is estimated at $1.1 Million. This includes the $300K estimated for software integration, $300K estimated for development of a specification, and $500K estimated for associated test procedures, procurement, and manufacturing costs for first article units, as well as cost for changes in the LCAC TDP to incorporate the new product into the Navy’s baseline.

This analysis is based on the SBC4 development task recently completed by the LCAC C4N project.

d. The lead time associated with the development, test and evaluation of this requirement is estimated at 39 months. This includes the time necessary to complete all the engineering efforts listed under 5c above plus task/funding negotiation with the sponsor to fund competitive requirements, contract lead time, and product lead time once Government acceptance is completed. A design change resulting from further competition would further delay installations by up to three additional years and incur significant additional cost for integrating a different Ethernet appliance converter into the ENET-1553 unit.

In summary Alta Data Technologies LLC is the only known source that can meet the LCAC C4N requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed contract was synopsized via posting on the Federal Business Opportunities (FEDBIZOPPS) website on 08 February 2016 in accordance with FAR 5.2. The synopsis expressed the Government’s intent to contract on a sole source basis and closed on 12 February 2016. Prior to the synopsis being posted a sources sought notice was posted in FEDBIZOPPS on 12 January 2016 and closed 21 January 2016.

No responses were received prior to the synopsis closing date. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any other company other than Alta Data Technologies LLC to provide the required supplies.

Other vendors wishing to qualify their products have been advised of the process in the FEDBIZOPPS announcement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated prices to the Government for the supplies and services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC PCD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWC PCD will assess whether competition for future requirements is feasible.
