J&A Number 116004 of the order. The contract action will be funded with Navy Working Capital Funds.
4. Statutory Authority Permitting Other Than Full and Open Competition
Pursuant to 10 U.S.C. 2304(c) (1) - Only a limited number of responsible sources and no other supplies or services will satisfy agency requirements, FAR 6.302-1(b)(1)(ii).
5. Rationale Justifying Use of Cited Statutory Authority
The Naval Surface Warfare Center Panama City Division (NSWC PCD) is the supply depot for the SEAL Delivery Vehicle (SDV). NSWC PCD has been tasked with providing support to both new SDVs and SDVs already in the Fleet. The SDV Cable Assemblies, which are manufactured by Teledyne ODI, Ametek SCP, Brantner & Assoc. Inc.
and Teledyne D.G. O’Brien, Inc., are already in use on the SDVs.
The current requirement is to procure various cable assemblies.
This procurement is not suitable for full and open competition for the following reason:
• Teledyne ODI, Ametek SCP, Brantner & Assoc. Inc. and
Teledyne D.G. O’Brien, Inc. are the only NAVSEA approved sources of supply for the SDV Cable Assemblies, under Source Control Drawings 7648256, 7648211, 7110412, 7648255, 7648254, 7648210, and 7110331. The items contained in these source control drawings are the only items approved for use by the SDV Configuration Manager.
Only Teledyne ODI, Ametek SCP, Brantner & Assoc. Inc. and Teledyne D.G. O’Brien, Inc. have the approval required to supply the SDV Cable Assemblies produced by their company and certify them for service. To certify additional sources would require the contractor initiation of the process. The certification will take approximately 12 months and the contractor is responsible for all certification cost. This cost is not reimbursed by the Government. Prospective contractors will be certified in accordance with NAVSEA
S9320-AM-PRO-020.
The current delivery time for this requirement is 180 days to satisfy schedule requirements and the time constraints associated with certifying additional contractors would cause significant delays to the Governments current requirement. If the scheduled requirements are not met then cables will not be available to the fleet in order to complete mission requirements. As such Teledyne ODI, Ametek SCP, Brantner & Assoc. Inc. and Teledyne D.G. O’Brien, Inc. are the only sources capable of meeting this requirement at this time.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The proposed contract action was synopsized via posting on the Federal Business Opportunities (FEDBIZOPPS) website on 15 January 2016 in accordance with FAR 5.2. The synopsis expressed the Government’s intent to contract on a limited source basis.
There have been no inquiries to this synopsis to date. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, no other sources can meet the requirements.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined the anticipated prices to the Government for the supplies and services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For reasons set forth in Paragraph 5, Teledyne ODI, Ametek SCP, Brantner & Assoc. Inc. and Teledyne D.G. O’Brien, Inc. are the only manufacturers that can meet the requirement. At this time there are currently no new contractors seeking approval to provide the cable assemblies. All costs pertaining to the certification are solely the contractor’s responsibility and will not be reimbursed by the Government; therefore, the certification process must be contractor initiated. NSWC PCD will continue to promote competition and assist any new contractors seeking NAVSEA approval.
