Department of Navy, Southwest Regional Maintenance Center (SWRMC) requires direct replacement parts and components for repair of the Ship's Rudders. These replacement parts are critical to repair the ship's port and starboard rudders, responsible for the steering of the ship.
Wartsila Defense, Inc. is the Original Equipment Manufacturer (OEM) and recognized manufacturer for the required replacement parts. Wartsila Defense, Inc. is the only source that can satisfy the Navy's requirement because the parts are highly specialized for a major system.
Thus, only the OEM parts and components can meet the ship's replacement parts and there is no other known source for the repair parts. The parts/components to be procured must be compatible to ensure form, fit, and function.
(Revised April 2018) installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect or interface with the existing system.
A patent, copyright or proprietary data limits competition:
The items are “direct replacement” parts/components for existing equipment. Provide the information about the Next
Higher Assembly (NHA)/equipment which the replacement parts are going into (e.g. description, model, part number, Original Equipment Manufacturer (OEM), etc.).
Other information to support sole source/brand name sole source procurement. The rationale must then justify
"either" substantial duplication of cost to the Government that is not recovered through competition or unacceptable delays in fulfilling the mission of the agency.
The material must be replaced with the same exact material and must have the same function capability. In addition, the required parts must be compatible in all aspects (Form, Fit, and Function) with the existing port and starboard rudders presently installed. The required parts represent the Government's minimum requirements. The government's minimum needs have been verified by the certifying technical and requirements personnel.
All Tech Manuals are for parts manufactured by Wartsila Defense, Inc.
Wartsila Defense, Inc. has proprietary rights to all equipment, parts, and drawings that are associated with the ship's rudder parts and components.
The required items listed below are the direct replacement parts for the ship's port and starboard rudders. They are proprietary to the Wartsila Defense, Inc.
Manufacturer # Item Description Quantity TBF100262083 Thordon SXL Molded Tube Rubber Bearing 1 NS-H-328 Sleeve 1 NS-H-329-02 Bearing Bushing 1 TBF100262083 Thordon SXL Molded Tube Rubber Bearing 1 NS-H-328 Sleeve 1 NS-H-329-02 Bearing Bushing 1
The next higher assembly is the ship's entire rudder system. The replacement/conversion of the entire system would be cost prohibitive and exceed the cost to conduct repairs through the use of this authority. Cost savings would not result from full and open competition to avoid the proprietary nature of the current configuration(s).
Lastly, the Contracting officer has determined that the anticipated cost to the Government will be fair and reasonable and a notice will be publicized as required per the FAR 5.2.
Contracting Officer recommends soliciting this requirement using other than full and open competition. The Government needs brand name products from the original equipment manufacturer in accordance with FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirement. Items must be compatible in all aspects, form, fit, and function to the existing system.
Lastly, in accordance with FAR 13.106-1(b)(1), soliciting from a single source, Contracting officer may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available to provide the required repair parts. To attempt to procure these products from any other source would result in substantial duplication of costs to the Government that could not be recovered through competition because the Government would be required to purchase an entirely new system.
