52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) technical, (2) past performance, and (3) price. The Offeror must be determined to have acceptable technical and past performance before further consideration will be given; that is, selection of the contractor is to be based on the establishment of minimum requirements to be evaluated on an “acceptable” or “unacceptable” basis. Quotes are evaluated for acceptability, but not ranked using the non-price factors. Award will be made on the basis of the lowest priced quote that meets the acceptability standards for all non-price factors. If the Government determines an offeror’s price to be inexplicably low or otherwise not fair and reasonable, that offeror may be eliminated.

Submission Requirement

Factor 1-Technical: The prospective offeror must demonstrate specific experience in providing inspection and maintenance of FENWALNET 6000 Systems of complexity similar to or exceeding the scope identified in the performance work statement (PWS) through a narrative of one (1) contract within the last three (3) years.

Offerors that submit one qualifying Corporate Experience Data Sheet shall be deemed technically acceptable.

Offerors are required to provide ONE (1) Corporate Experience Data Sheet (Attachment 5) on ONE (1) of the firm’s recently completed contracts or task orders (not to exceed three years older than date of solicitation) that demonstrate relevant work.

Altered or substituted Corporate Experience Data Sheets may not be evaluated.

If referencing non-government corporate experience contracts, offeror’s shall include a point of contact with the customer company which includes: name, company title, phone number, and email to allow for government verification.

Factor 2-Past Performance: Past performance information shall be obtained from established systems such as the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases. Past performance information may also be obtained from other sources available to the Government.

An offeror will be found acceptable if, based on the past performance information obtained, the government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is not available or so sparse that no meaningful past performance rating can be reasonably assigned.

Offeror’s are not required to submit any additional documentation in support of this evaluation criterion.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor prior to the end of the current base or option period; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract period expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

252.216-7006 ORDERING (MAY 2011)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the contract schedule. Such orders may be issued from 23 November 2018 through 22 November 2023.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c)(1) If issued electronically, the order is considered ``issued'' when a copy has been posted to the Electronic Document Access system, and notice has been sent to the Contractor.

(2) If mailed or transmitted by facsimile, a delivery order or task order is considered ``issued'' when the Government deposits the order in the mail or transmits by facsimile. Mailing includes transmittal by U.S. mail or private delivery services.

(3) Orders may be issued orally only if authorized in the schedule.
