N39040-15-T-0178 Attachment 5 Questions & Answers – 8/18/15

1. Please confirm whether or not this is a single award procurement. Will the contract be Type “C” or “D”? Please explain the ordering process for the issue of a task order. After award, how will the individual line item prices in Exhibit A-D be used?

This requirement will result in a single-award, Firm Fixed-Price type “P” contract. As a result, there will not be any task orders issued but rather invoicing under the proper period of performance CLIN referencing the proper ELIN.

2. Clause 52.244-41, Service Contract Labor Standards is not incorporated in the solicitation, but there is a Wage Determination Register included as an attachment to the solicitation. Does the Service Contract Labor Standards Clause apply? And if so, why wouldn’t it be exempt in accordance with 10 U.S.C. 7299? In addition, Attachment 1 is not the current Wage Determination.

This service requirement is not exempt from the Service Contract Labor Standards Clause and as such, Revision No. 17 dated 07/08/2015 is updated and attached and Clause 52.244-41 is included.

3. Section L, Page 83 states: Initial Quotes and any modifications thereto are to be submitted to the Contracting Officer on or before the closing date and time cited elsewhere in this Request for Quote. Faxes or responses through FBO or any other method other than Hard Copy format of Emailed Copy are not acceptable.

All submissions are to be made by email directly to the Contract Specialist, Aimee Maciejewski at Aimee.Maciejewski@navy.mil.

4. The cover sheet indicates that this is a Small Business Set-Aside but does not include the NAICS Code. Please advise.

The NAICS Code being used is 336611 as posted on FBO and is a Small Business Set-Aside.

5. Attachment 2 contains all of the past performance information that we are required to provide. It’s a 4 page documents with the first page being the past performance table and on the second page starts the questionnaire. Are we allowed to split them up or should we submit all 4 pages to our customer to forward to the Government? Typical past performance submissions consist of the past performance information (page 1) being submitted as part of the proposal, while the past performance questionnaire (pages 2 – 4) are sent to the referenced customer to be completed and then submitted to the Government.

The 4 pages can be split and pages 2-4 consisting of the Past Performance Questionnaire can be submitted directly to the Government as is typical.

6. On page 10, paragraph C.1.3 the following statement, "Work shall be accomplished by personnel meeting at least the minimum qualification set forth elsewhere herein and shall be provided onboard the living barges as required." Please provide the minimum qualifications as they are not set forth elsewhere.

Paragraph's c.1.3.b (3), (4) address that the contractor shall provide journeyman level mechanics, and technicians, and where specialized skills are not within the contractors internal workforce, those items will be subcontracted to personnel meeting these requirements.

7. "ELIN 101 PLANNED MAINTENANCE TASKS: Based on our experience managing living barge maintenance projects, we have found it important to have a full time (40 hour work week) dedicated person assigned to each barge while a ship's crew is occupying it. This full time maintenance technician responds to routine as well as urgent/emergent maintenance issues that come up on a daily basis. The current structure of the contract requirements and ELIN's makes it difficult to project future manpower requirements and eliminates the flexibility to adequately respond and effectively manage multiple barge projects when ship's crews are involved. Recommend an ELIN be added in the 101 section as follows: 101AJ Maintenance Support to ship's crew occupying the craft (as required, 40 HR's per week). This would be invoked as required and the number of Maintenance Hours would be determined by the length of time the crew occupies the Barge".

It is not the intent to have a single worker sitting on each barge 40 hours/week waiting for a problem to arise. The intent is to have a maintenance person report to each barge each day to make a single daily assessment of repairs or maintenance, with most routine items being corrected the following workday, or where necessary, more urgent work to be addressed more quickly. Paragraph c.8.1 addresses developing daily work priorities with the COR.

8. ELIN 103AA requires: "Accomplish a preliminary and final visual and operational inspection of all systems and equipment utilizing barge systems and equipment check off list. Submit a detailed report of all discrepancies." Request a copy of this check off list to assist us in accurately estimating the LOE to accomplish.

See Operation Check Off List added as Exhibit E

9. ELINs 106BU - 106CF for Remove/Replace Pipe do not specify the type of pipe. The cost differential can be very significant based on the type of pipe, and unless specified, an accurate estimate cannot be provided. Request the type of pipe be specified for each of these ELINs.

Consider soft soldered piping to be copper, welded piping to be steel, threaded and brazed piping to be copper. Changes to A-D Attachments highlighted and attached.

10. Page 20, Radiological Controls, references prerequisites for a contractor to receive a red-badge, but the solicitation does not explicitly state that the contractor will be required to procure a red badge. Since the barges will be housing submarine crews, who will be working with sensitive information generally classified at the No Foreign National level, will the contract personnel assigned to this contract be required to obtain a red badge?

No red badge required. Submarine crew will provide escort as required for green badged personnel.

11. Page 16, Section C.7.2, items discusses the need to treat all potentially hazardous solid waste as hazardous until it has been tested and proved otherwise. In the event that the solid waste is determined to be hazardous, who is responsible for disposing of it? This is not specified in the SOW. There are no ELINS on Exhibits A-D Attachment for providing this service. Recommend ELINS be created to enable pricing these requirements.

Where hazardous waste is discovered, or created, as a result of an approved repair or maintenance, the Government will dispose of the waste.

12. ELINs 106BU through 106CF are for the replacement of piping. Based on the description of work provided in C.8.5, it appears this also includes fittings, valves and insulation. In order to provide accurate pricing, recommend separate ELINS for common fittings, valves, and insulation for each pipe size.

Due to the infrequency of these repairs, these will be addressed in the unplanned parts/repairs ELIN.

13. The solicitation states that NAVSEA Standard Item (NSI) 009-04 will be invoked on all Task Orders. In order to ensure that the successful bidder is able to comply with this requirement, recommend that bidders be required to submit evidence or at least an affirmation that the bidder has an accepted Quality Management System as defined in NSI 009-04.

The nature of the following NSI's are either not applicable, or unneccesarily restrictive. Delete the following NSI's from C.4:

009-04 009-05 009-09 009-34 009-60 009-69 009-80 009-99 009-101

14. The solicitation states that NAVSEA Standard Item 009-69 will be invoked on all Task Orders. In order to ensure that the successful bidder is able to comply with this requirement, are bidders required to submit a Heavy Weather Plan for approval as defined in NSI 009-69 with its proposal?

See answer to #13 – NSI 009-69 is removed from the statement of work.

15. Based on extensive experience with managing living barges, an organizational structure is required that facilitates communication and decision making between the crew, the shipyard and the contractor. Recommend that the Government consider adding a requirement for submission of an Offeror's Management Plan and organizational structure to demonstrate that the Offeror can effectively manage day to day operations and emergent needs.

In accordance with para C.7.1.C, work requirements and schedules will be coordinated on a daily basis between Contractor Personnel, the COR, and Ships Force. The submission of a management plan or organizational structure to predict day-to-day management capabilities is deemed unnecessary.
