About this file

This document contains a justification and approval for other than full and open competition along with details of a related federal contract award. The justification approves increasing the value of an existing contract with Fairbanks Morse, LLC from $2,520,352 to $3,367,138 for an emergency diesel generator overhaul on an Ohio Class submarine, including replacement of upper and lower crankshafts. The work is required to support an underway limiting casualty report, and any delay could degrade the vessel's operational capability and maneuvers as it supports real world events. Additional requirements for welding repairs and quarantining contractor personnel due to COVID-19 increased the contract value above the original approval amount. Competition was limited to Fairbanks Morse as the original equipment manufacturer and only known source capable of performing the urgent work by the required deadline to avoid operational impacts. The related contract was awarded on March 2, 2020 to Fairbanks Morse for $2,470,918.88 with a period of performance from March 4 to May 4, 2020.

J&A No.: 02088-3 contract value resulting from this change remained under the original J&A approval value of $2,520,352.

e. RCC 2G, for additional weld repairs and mandated COVID-19 14 day quarantine of contractor personnel travelling to the island of Oahu, has an estimated value of $464,158. RCC 3G, for additional subcontractor machinists and for mandated COVID-19 quarantine of contractor personnel travelling to the island of Oahu, has an estimated value of $362,628. 4. Statutory authority permitting other than full and open competition

10 U.S.C. 2304(c)(2). Unusual and Compelling Urgency.

5. Rationale justifying use of cited statutory authority

The Repair and Overhaul identified in Paragraph 3 above is supporting an underway limiting CASREP. The is a forward deployer supporting real world events. If urgency is not applied there will be an impact to the operator’s mission causing a degradation in our Navy’s defense capabilities. The Emergency Diesel Engine is an integral submarine component. Loss of Emergency Diesel Engine capability would degrade and limit operational capability and maneuvers required of a forward deployer.

The customer identified the additional welding requirement for RCC 2G on Wednesday, 25 March 2020. The additional requirement for additional machining subcontractors and quarantine of the prime contractor was identified on Monday, 30 March 2020.

6. Description of efforts made to solicit offers from as many sources as practicable

Per PHNS & IMF Engineering and Planning Department (EPD), Fairbanks-Morse owns the necessary equipment and is experienced in performing the appropriate procedures and services identified in Paragraph 3a. They are currently the only known vendor that has performed this particular repair, are the Original Equipment Manufacturer of Emergency Diesel Engine on the class submarines, and are the only known source capable of meeting this urgent requirement.
