JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) -Norfolk.
2. Description of the Action Being Approved: This is a sole or limited source and/or brand name justification for work to be provided under Work Items (WI) 0201, 0301, 0403, 0601, 0605, 0904, 0907, and 0913 of the Statement of Work (SOW) for the Regular Overhaul/Dry-Docking (ROH/DD) of the USNS APACHE (T-ATF-172) under RFP N32205-18-R-4550. This Justification is covering only the portion of the acquisition which is brand-name and the approval level requirements will then only apply to that portion.
3. Description of Supplies/Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field service representatives and OEM parts to accomplish the requirements of
WIs listed below. The estimated combined dollar value is $684,376.00, which will be funded utilizing
FY 18 Operation & Maintenance funds.
Work Items requiring OEM parts and OEM/OEM-authorized Service Representative(s):
0201: Main Propulsion Engines (Electro-motive Diesel Incorporated (Inc.))
0301: Engine Operating Station (EOS) Automation System Calibration and Repair (Fairlead
Integrated Power and Controls)
0403: Bridge Electronics (Raytheon-Anschutz)
0601: Davit Extension (Allied Systems Company)
0605: Crane System Annual Certification (Allied Systems Company)
0904: Shafting, CPP, Shaft Seals (Propulsion Systems Inc.)
0907: Bow Thruster Overhaul (Brunvoll USA)
0913: Cathodic Protection (Wilson Walton)
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1):
Only one responsible source and no other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a) and/or (b).
5. Rationale Justifying Use of Cited Authority:
a. WI 0201: Main Propulsion Engines
This work requires the supply of Marine Systems Inc. as the sole-source Electro-Motive Diesel (EMD)
Inc. OEM-authorized technical representative and part for the repairs of USNS APACHE’s main propulsion engines. EMD Inc. is the OEM. The engines are listed as critical equipment per Safety
Management System (SMS) #10.6-002-01-ATF. Per COMSC INSTRUCTION 4490.1, an OEM or
OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. A loss of propulsion while at sea affects mission accomplishment and safety. Additionally, incorrectly installed or deficient parts could cause excess friction, threatening smoke and fire in the engine room. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
b. WI 0301: EOS Automation System Calibration and Repair
This work requires the supply of Fairlead Integrated Power and Controls (FIPC) OEM parts and technical representatives for the calibration and repair of USNS APACHE’s EOS Automation System.
The EOS Automation System is an integral system. FIPC owns all rights to the Beach Panel. Beach was the designer and OEM for the EOS on the T-ATF platforms. Regulatory agencies require annual
Periodic Safety Test Procedure (PSTP). The procedure needs software maintained by FIPC to operate correctly. FIPC owns and maintains all of the logic ladders that are needed for proof of system.
Moreover, only FIPC has access to proprietary drawings/technical data and has the expertise and knowledge to identify and provide OEM parts, components, and qualified services for required repairs/maintenance. If the EOS Automation becomes inoperable, a loss of propulsion while at sea can occur. Additionally, incorrectly installed or deficient parts could cause system failure and loss of control at sea. FIPC Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
d. WI 0403: Bridge Electronics
This work requires the supply of a Raytheon-Anschutz OEM-authorized technical representative and parts for USNS APACHE’s bridge electronics, including the Furuno Marine Radar model FAR-
2107/2807 series, Raytheon STD 22 Dual Gyro System, GMDSS Furuno (2) VHF- FURUNO Model
FM8800S, MF/HF Model FS2571C, SASS: Furuno Felcom 19, EPRIB ACR RLB-37 ID#
2DCC7B1E7CFFBFF VHF Radios: Furuno FM-8800. The above bridge equipment is listed as critical equipment per SMS #10.6-002-01-ATF. Per COMSC INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of control at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all
OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
e. WI 0601: Davit Extension Work
The work item requires the supply of Allied Service OEM parts and technical representatives for the services and repair of Model DC 700 davits and the CT 17 constant tension winch to meet regulatory requirements onboard USNS APACHE. Allied Services is the OEM for the davit. Rigid-Hull
Inflatable Boats and davit assemblies are listed as critical equipment per SMS #10.6-002-01-ATF. Per
COMSC INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical”. The davit is used to deploy and retrieve the ship’s Rescue Boat. Incorrect maintenance could cause personnel or equipment mishaps. Allied Service Representative are trained and certified to inspect, maintain, and service the davit greatly mitigates risk associated with davit failure. Allied Service Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM
f. WI 0605: Crane System Annual Certification
The work item requires the supply of Allied Service OEM parts and technical representatives for the service and repair of Model TB 60-A crane onboard USNS APACHE. Allied Services is the OEM for the crane. The crane is mission essential equipment for USNS APACHE. Cranes are listed as critical equipment per SMS #10.6-002-01-ATF. Per COMSC INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical”. Incorrect maintenance could cause a personnel or equipment mishap.
Allied Service Representative are trained and certified to inspect, maintain, and service the crane greatly mitigates risk associated with crane failure. Allied Service Representatives will only install genuine
OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
g. WI 0904: Shafting, Controllable Pitch Propellers (CPP), Shaft Seals
This work requires the supply of Propulsion Systems Incorporated (PSI) OEM parts and technical representatives for the repairs of USNS APACHE’s shafting, CPP, and shaft seals. PSI is the OEM for this equipment. The shaft, CPP, and shaft seals are listed as critical equipment per SMS #10.6-002-01-
ATF. Per COMSC INSTRUCTION 4490.1, OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical”. Only
PSI has access to proprietary drawings/technical data and has the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Because this work item requires removal critical components, access to proprietary drawings/technical data is of particular importance. A loss of the shaft or shaft seals would severely inhibit the ship’s ability to remain afloat and would be cause for a mission-ending “no sail”. An improperly aligned CPP system would prevent safe and reliable navigation of the vessel, possibly leading to collisions, groundings, and a loss of mission readiness. PSI technical representatives will know how to properly affect repairs and perform aligning procedures.
They will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. h. WI 0907: Bow Thruster Overhaul
This work requires the supply of Ships Machinery International as the sole-source Brunvoll, USA
OEM-authorized technical representative and parts supplier for the repairs to USNS APACHE’s Bow
Thruster. The Bow Thruster is a critical component for ship operation and maneuvering. The loss of the
Bow Thruster could affect the ship’s ability to perform operations for mission requirements and cause limited maneuvering during critical times. Only OEM-authorized service and parts providers have access to proprietary drawings and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. SMI representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
i. WI 0913: Cathodic Protection
This work requires the supply of Wilson Walton OEM parts and technical representatives for the partial upgrade of the USNS APACHE’s Cathodic Protection Impressed Current (CAPAC) System. The
CAPAC System is an integral system as applied to the protection of the ship’s hull steel and coating system. Historic data from USNS APACHE’s past ROH/DDs demonstrated the importance of the system due to the severe deterioration of the hull coating system, which is contributed to the over current operation of the existing outdated system. Wilson Walton equipment was utilized in the development of the Alteration Equivalent to Repair approved by MSC Engineering. Wilson Walton equipment is the standardized system used on MSC’s T-ARS and T-ATF class ships. The commonality of parts, technical manuals and repair contracts is a force multiplier. Replacing existing equipment with
Wilson Walton equipment will ensure compatibility with existing equipment and ship’s configuration.
Wilson Walton Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The requirement has been synopsized at the Government Point of Entry (GPE), FedBizOps website, and the
Government intends to post a Request for Proposal (RFP) along with this justification at the GPE with the intent of awarding a firm-fixed price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM Authorized vendor as a subcontractor to perform the work in the related WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Removed Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
