Section B - Supplies or Services and Prices

SECTION B

1.0 GENERAL. The rates for services provided under this contract shall be payable at the applicable, fully loaded, rates stipulated in Section B. Said payments shall be considered payment in full for all services, equipment, supplies and all Contractor personnel under this contract, including all penalty time, bonuses, payments and emoluments payable to Contractor personnel for services under this contract, irrespective of the geographic scope of said services.

1.1 PER DIEM RATE. Per Diem rates shall cover the cost of daily operation, equipment, personnel, and service for the SBX-1 Security Force, unless an expense is specifically listed in the contract as being reimbursable.

Payment of the awardee’s per diem rate shall commence upon the performance period commencement date.

Note: Any number of days identified herein for FOS and ROS are for pricing and evaluation purposes only.

Any representations to operating tempo per year are estimates only.

1.2 REIMBURSABLE ITEMS. Reimbursable supplies and services are those items specified in the contract as reimbursable, or otherwise pre-approved by the Contracting Officer. The reimbursement cost shall not include overhead, general and administrative costs, material handling costs, profit, or fees above the actual costs. See Section G for the documentation requirements for reimbursable items. Reimbursables shall not exceed funding expressly obligated to this contract by the Contracting Officer. Travel, training, and reimbursable overtime are the only anticipated reimbursable items.

1.3 ESTIMATES. All quantities are estimates unless specifically guaranteed.

1.4 CLIN STRUCTURE. The CLIN structure may be unilaterally changed by the Government at award to accommodate the funding format.

1.5 RESERVED.

1.6 REDUCED OPERATING STATUS (ROS). Fixed Reduced Operating Status (ROS) prices shall include costs for wages, fringes, training, insurance, other personnel expenses, indirect costs, G&A, and profit. The Government will also reimburse the contractor for provisions at a fixed rate of $30 per ration (three meals for one person) or a single meal rate of $8.00 for breakfast and lunch, and $14.00 for dinner for all required crew members. In the event the vessel is unavailable to accommodate the crew for messing and berthing, the Government will reimburse the contractor travel and per diem costs in accordance with the DoD Joint Travel Regulations (JTR) in effect at the time of travel.

1.7 RESERVED.

1.8 CONTRACTOR’S ACCOUNT. All overtime, penalty time, bonuses, and other additional emoluments, payable for whatever reasons, shall be for the Contractor’s account except as specifically otherwise provided in the contract.

Section C - Descriptions and Specifications

SECTION C

C1.0 Scope of Work/Mission On September 15, 2008, the United States Navy (Navy) and the Missile Defense Agency (MDA) signed a Memorandum of Agreement (MOA) transitioning the Sea Based X-Band Radar (SBX-1) platform Operations and Support (O&S) from MDA to Navy cognizance. The Navy designated Military Sealift Command (MSC) as the agent responsible for the SBX-1 Program Office. MSC's duties include acquiring the proper levels of security and protection for the SBX-1 vessel (duties are limited to providing security to SBX-1 by a security force of contractor Security Officers who will remain onboard within the lifelines of the vessel), in accordance with U.S. Strategic Command Instruction (SI) 538-2 and other applicable directives listed in the reference section of this document.

C1.1 General The contractor shall provide personnel and material for securing SBX-1 in accordance with (IAW) Sponsor Security Requirements (as delineated in MDA Memorandum of 26 July2012 entitled “SBX-l Security Requirements”),SI 538-2 (e.g., Chapter 10 Sea-Based Missile Defense Systems (SBX/AEGIS/OSV)) and other terms of this PWS. Security requires continuous armed force protection of the SBX-1 at all times; when the SBX-1 is at sea and when the vessel is in port. The contractor shall be responsible for maintaining onboard physical security 24 hours 7 days a week 365 days a year and be able to sustain 60-day rotations in two scenarios, 1) when the vessel is at sea in International Waters, and 2) while the vessel is in U.S. Territorial Seas and internal waters (including U.S. Navy and commercial facilities). Contractor Security Officers shall perform their duties onboard SBX-1 and not outside the lifelines of this vessel, notwithstanding any other requirements of SI 538-2 (and successor directives). It is understood, however, that contractor Security Officers onboard SBX-1 may have to use force against attackers who are located outside the lifelines of the ship. The PWS does not include the requirement to provide SI 538-2 protection to the vessel when moored, anchored or docked at a foreign port or shore-side security duties IAW SI 538-2. Should this become necessary it will be handled as a separate work item which will be required to be submitted for approval by the Contracting Officer. The contractor shall maintain communications with escort, security patrol craft (when applicable), and port security personnel and demonstrate capabilities and preparedness to Navy and other authorized and appropriate review agencies (such as but not limited to; Naval Criminal Investigative Services (NCIS), Combatant Commander (COCOM) staff, Coast Guard, etc.) (See for example: DoDI 2000.16 (series) and OPNAVINST 5530.14 (series)). To facilitate this the contractor shall have 3 years of experience in security in support of port security or Security System Level A (SSL-A) requirements as well as 3 years of company experience with weapons maintenance of the types that will be used on SBX-1 (handguns, shotguns, military assault rifles, and crew served weapons). These experience requirements can met through Prime, Subcontractor, and Teaming/Partnership.

C1.1.1 Contractor Security Officers shall:

a) Contractor Security Officers (this includes all contractor personnel who will board SBX-1) shall be armed while on duty (CDRL A015). All Security Officers shall be capable of, and are authorized to, respond to Force Protection Conditions (FPCON) in accordance with applicable referenced documents, rules and regulations, including the authorizations, restrictions, and use of force rules in DOD Directive

5210.56 of April 1, 2011 (and any changes).

b) The contractor shall provide training on the Use of Force rules contained in DOD Directive 5210.56. All contractor Security Officers must be required to show certification of the training received and certify understanding of the Use of Force rules contained in DOD Directive 5210.56 of April 1, 2011 (CDRL A012). Contractor Security Officers are required to fulfill DoD and Navy periodic training requirements for the use of firearms, warning shots, and use of force, to include meeting the requirements of DoD 5210.56.

c) Contractor Security Officers shall be vetted through the Military Sealift Command (MSC) El Paso Intelligence Center (EPIC) screening process and receive approval from MSC N3 Operations Directorate before access to the vessel shall be granted (see paragraph C1.16.1). If personnel are not cleared through the EPIC screening they are not eligible for employment onboard SBX-1. Contracting Officer has the right to direct the removal of any contractor Security Officer from SBX-1 when the Contracting Officer deems this appropriate.

d) Written acknowledgment by the contractor and individual contractor Security Officers that (CDRL A015):

1. Inappropriate use of force by contractor Security Officers may subject such personnel to prosecution by U.S. authorities, State and local authorities, and civil liability. Such written acknowledgement should not be construed to limit potential civil and criminal liability to conduct arising from "the use of weapons." For example, contractor Security Officers could be held criminally liable for any conduct that would constitute a federal offense (see the Military Extraterritorial Jurisdiction Act, (Section 3261 of title 18, United States Code)).

2. Written proof of authorization to be armed must be carried by all contractor Security Officers who will be armed. Proof of authorization to fire warning shots must also be carried by all contractor personnel who will be armed. Such written authorizations may be granted by (and once granted, may be rescinded by) the Master, the Commodore of the cognizant MSC Area Command that the vessel is operating in, or an individual designated in writing by them. The written authorization(s) will be signed by the Master, Commodore, etc., (e.g., signed in ink or digitally).

3. Contractor Security Officers may possess only U.S. Government issued or Contracting Officer approved-in-writing weapons and ammunition for which they have been qualified in accordance with section C1.7 (e) of this PWS.

4. Contractor Security Officers were instructed on and understand the rules and limitations on the use of force.

5. Authorization to be armed or fire warning shots may be revoked for non-compliance with established rules for the use of force, firing of warning shots, or safe handling of weapons and ammunition.

6. Contractor Security Officers are prohibited from consuming alcoholic beverages or being under the influence of alcohol or any drug, prescription or otherwise, that would impair your ability to safely operate any firearm while armed.

7. Contractor Security Officers DO NOT have a psychiatric diagnosis for which medication is necessary (a waiver of this limitation may be available, in some circumstances, in accordance with the requirements of paragraph 6b of OPNAVINST 3591.1(series)).

8. After investigation by the Contractor of the background and qualifications of contractor Security Officers and organizations, the Contractor certifies that contractor Security Officers are not prohibited under U.S. law to possess firearms. Individual contractor Security Officers shall certify that they are not prohibited under U.S. law to possess firearms (CDRL A012).

C1.2 Operational Control (OPCON) SBX-1 will normally operate inport as a test asset or underway in Limited Test Support Status (LTSS). The vessel could also be activated as a contingency asset in case of emergency with Secretary of Defense approval. Operational Control (OPCON) will vary in either case.

C1.2.1 – LTSS OPCON and Tactical Control (TACON) of SBX-1 will reside with Commander, Missile Defense Agency, Sensors Directorate.

C1.2.2 – Contingency (OPCON) of SBX-1 and assigned personnel will reside with Commander, U.S. PACIFIC COMMAND (USPACOM) and contingency TACON will reside with U.S. Pacific Fleet (COMPACFLT) unless specified otherwise.

C1.3 Area of Operations Operations are anticipated to be conducted in the Pacific Ocean. SBX-1 is expected to be operating in the United States (to include U.S. territories and U.S. territorial waters) and on international waters.

C1.3.1 Operating Scenario Vessel operations consist of Ballistic Missile Defense operations in support of Home Land Defense test events, transits, and maintenance. The Government may vary Operational Tempo (OPTEMPO) to meet mission requirements. Typical annual OPTEMPO (subject to change) for SBX-1 operations (see Section C1.10 for mobilization information):

C1.4 Rotation Schedule for Contract Security Force in an Underway (SSL A) Scenario: Full operational status is planned for 120 days per year (two 60 day periods). A SSL A security posture will be in effect during this time. The entire vessel crew will serve without relief during this period. In the event the vessel is underway for longer than 60 days in an SSL-A status, contractor personnel may be relieved on a rotation schedule determined by the frequency of helicopter flights, Offshore Support Vessel (OSV) runs or other means to transport personnel (OSV runs are expected every 30-60 days). Due to these unusual mission requirements, security personnel may have to serve onboard SBX-1 for extended periods (> 60 days) or experience delays in transit while enroute to the vessel.

OSV transfer times vary due to the location of the vessel and weather/sea state. For planning purposes, most OSV transfers take between seven to ten (07-10) days transit (each way). The Contractor shall provide continuous protection of the vessel during such delay periods.

C1.4.1 Unscheduled Extensions of Duty The on-board staff is subject to mobilization and other modifications of established shifts and work schedules to respond to potential or real threats as determined by the SBX-1 Master (hereafter referred to as Master) or as preplanned by Force Protection Condition (FPCON) as defined in the Vessel Security Plan (VSP) (sample VSP provided as Attachment B); current copy will be furnished by the government at contract award).

C1.4.2 Reimbursable Overtime The Contractor shall comply with the manning requirements specified in Section C1.15. All overtime that is incurred beyond the 40 hour workweek for each Security Officer shall be reimbursable in accordance with the contractor’s approved Staffing Plan (C1.23b) and Section G-7. The following are the only expected sources of reimbursable overtime: 1. VSP Response (Actual Security Incident, Increased FPCON requiring additional manpower, etc.). 2. Shipboard SOLAS training/drills (Training/Drills associated with Shipboard requirements outside of the normal 40 hour workweek.). 3. Overtime associated with Section C.1.15.4.

4. Other reimbursable OT as discussed and pre-approved by the Contracting Officer (OT associated with Security training outside of the normal 40 hour workweek).

C1.5 Embarkation/Debarkation The Contracting Officer’s representative (COR) will provide the contractor the port location of the SBX-1 and/or the disembarkation point for the OSV not less than four (4) working days prior to when they are expected to report. Contractor personnel may embark the SBX-1 while in-port or underway (via the OSV, helicopter, or other means). The location of the SBX-1 and OSV shall only be communicated as necessary.

C1.6 Personnel Equipment Requirements Contractor will provide all necessary personal use equipment for duties onboard the SBX-1 including but not limited to uniforms suitable to allow other personnel onboard SBX-1 to recognize contractor Security Officers, cold weather gear, ballistic personal protective equipment. Cold weather gear includes clothing suitable for outdoor wear in Arctic at sea environments. Ballistic personal protective equipment includes equipment suitable to stop a 7.62x39mm round (CDRL A017).

C1.7 Personnel Qualifications A SECRET Facility Clearance is required at the start of performance. SECRET Personnel Security Clearances are required prior to assignment to the vessel (see Section C 1.16). The contractor shall provide a Security Force with qualifications as described below:

a) Contractor Security Officers shall complete training in accordance with the requirements of COMSCINST 5530.3(series), this PWS, DOD Directive 5210.56 of April 1, 2011, and as directed by the Master. All contractor Security Officers must maintain proficiency on all tasks identified in the SBX-1

VSP.

b) Contractor Security Officers shall be capable of detecting, assessing, responding, and delaying security threats and meeting performance goals of SI 538-2 (duties are limited to providing security to SBX-1 by contractor Security Officers who will remain onboard within the lifelines of the vessel) and all applicable instructions (including COMSCINST 5530.3(series)) to suppress covert and overt activities against SBX-1.

Contractor Security Officers must be U.S. Citizens and have a secret security clearance before boarding the vessel.

e) All contractor Security Officers shall be qualified in the use and maintenance of 9mm handguns, 12 gauge shotguns, AR 15 assault rifles, M-79 Grenade Launchers, deck-mounted / hand held M-240 machine guns and deck-mounted M-2 machine guns IAW OPNAV INSTRUCTION 3591.1(series) SMALL ARMS TRAINING AND QUALIFICATION (CDRL A010). Contractor Security Officers will be trained in the firing of warning shots from rifles and crew-served weapons in accordance with DOD Directive 5210.56.

Contractor Security Officers are required to fulfill DoD and Navy continuing firearms qualification requirements.

f) All contractor Security Officers shall possess a valid Transportation Worker’s Identification Card (TWIC) or DoD Common Access Card, and United States passport no later than the start of Period of Performance (PoP). Verification of Physical Certification for Physical Fitness (Merchant Mariner’s Physical Examination Equivalent) is required for each crew rotation on the SBX-1) (CDRL A012).

h) All contractor Security Officers shall possess an approved DD Form 2760, “Qualification to Possess Firearms and Ammunitions”, certifying the individual is not prohibited under U.S. law from possessing a weapon or ammunition due to conviction in any court of a crime of domestic violence whether a felony or misdemeanor, and shall submit the MSC supplement to DD Form 2760 (found in COMSCINST 5530.3(series)) and not be disqualified thereunder from possessing, receiving, shipping, or transporting arms or ammunition (CDRL A012).

C1.8 Physical Security The Contractor shall coordinate with the Master to establish and maintain minimum Geographic Combatant Commander (GEOCOCOM) and Navy Numbered Fleet Commander Force Protection (FP) requirements for SBX-1 which comply with Sponsor Security Requirements and applicable portions of SSL-A and SSL-C requirements set forth in STRATCOM SI 538-2, Navy Priority B requirements OPNAVINST 5530.14(Series), and Tactical Control for FP (TACON for FP) requirements that can be performed on board the vessel by contractor Security Officers (i.e., within the lifelines of SBX-1).

C1.8.1 SSL-A requirements for FOS SI 538-2 (and successor directives) provides security standards and criteria for the protection of SBX-1in Contingency Operation status. These standards and criteria (particularly those in Chapter 10 of SI 538-2) are applicable to this contract. The contractor and contractor Security Officers will perform their security duties onboard SBX-1 (within the lifelines of the vessel) and will not perform security duties off the vessel (including security on piers, land approaches, vehicle barriers, or on patrol craft). The contractor shall ensure the following six SSL-A requirements are met while the vessel is in FOS:

a) Access Control - Control entry and circulation within the restricted area.

b) Electronic Security - Use integrated electronic security systems (IESS) to provide continuous intrusion detection, automated entry control when so implemented, and surveillance at the restricted area boundary and individual resources. Post sentries when IESS is not installed or not operational. The security system employed on-board the SBX-1 is not a true integrated security system - - it is three separate systems which must be monitored by the Security Console Operator. However, for purposes of common verbiage, and to associate it to written standards, this document will use IESS for the SBX-1’s electronic security system. To facilitate this, contractors shall have two years of past company experience working with IESS similar to the ones described in this Performance Work Statement.

c) Barriers - Install (government provided) barriers to impede access to protected resources. Note that Contractor will not be responsible for installing barriers off the vessel, such as vehicle barriers.

d) Delay and Denial - Apply system security engineering during design and construction to provide delay and denial to protected resources. Delay must be long enough to allow security forces to respond and neutralize the threat before opposing forces gain access to the protected resource.

e) Active Patrol - Expand defense of the security area of interest through the use of a successive series of security screens and active patrolling to reduce the standoff threat.

f) Response Force - Post dedicated security forces inside the restricted area and designate an immediate response force (per SI 538-2) outside the restricted area. Note that Contractor will not provide security forces off the vessel.

It is understood that contractor Security Officers on SBX-1 may have to use force against attackers who are located outside the lifelines of the ship.

C1.8.2 Sponsor Security Requirements for ROS – The contractor shall:

a) Access Control – Post an entry controller (when applicable) and alarm monitor (when applicable) and a designated Response Force (RF) as outlined in Ch 6 of SI 538-2. The RF may have other security responsibilities but they must be able to respond within five (5) minutes.

b) Electronic Security - Use integrated electronic security systems (IESS) to provide line of intrusion detection (usually at the individual resource). Post sentries when an IESS is not installed or operational. Monitor the Electronic Security System and provide response to alarms.

c) Service Components prescribe supporting force responsibilities and entry control procedures for restricted areas.

At locations inside/outside of United States territory, entry to the SBX-1 must be controlled by posted US personnel (i.e. the contractor) or Automated Entry Control System (AECS). Conduct checks of areas containing controlled area resources (iaw VSP and all other applicable references).

d. Ensure proper training of assigned security personnel (iaw Section C 1.24)

C1.9 Small Arms Locker and Weapons The SBX-1 has a central Armory and a magazine with 4 Ready Service Lockers. The contractor will store and secure ammunition and 40mm flashbang rounds in the ship’s magazine (located port starboard side amidship in the vicinity of the armory) for issue to each Ready Service Locker. In addition one set of binoculars and one insulating gun barrel change mitt will be stored inside the RSL. Other equipment that may be necessary to the mission may also be stored in the RSL as relevant to the mission at the discretion of the Assistant Anti-Terrorism Officer (Assistant ATO). The leading contractor Security Officer on board SBX-1 will be designated as the Assistant Anti-Terrorism Officer (Assistant ATO), and will have authority over other contractor Security Officers on SBX-1; it being understood that the vessel’s Master still has final responsibility for and authority on the vessel. ALL firearms and ammunition will be furnished by the Government.

See Attachment A (Government Property List). The contractor (as Assistant ATO with authority delegated to him by the Master) shall be responsible for the weapons; weapons repairs will be conducted according to NSWC Crane weapons return guidelines (CDRL A003).

C1.10 MOBILIZATION

C1.10.1 Mobilization Period for Contingency Operations in SBX-1. The mobilization period for SBX-1 to shift from Limited Test Support Status (LTSS) to an operational status (i.e. falling under SSL-A requirements) will be dependent upon real world requirements. Accordingly the contractor shall mobilize the additional staff for SBX-1 (FOS) requirements at SSL-A status or shall utilize existing personnel to meet these requirements (in this case additional hours outside of the 40 hour workweek will be paid as reimbursable overtime). Sponsor Security Requirements will apply during this mobilization period but at the end of the mobilization period the contractor shall provide the staffing and manning levels described for the 15 person force described in Underway Manning (Operational SSL-A) (Section C1.15.3). Crew wages and benefits are reimbursable upon arrival to the SBX-1 during the mobilization period in accordance with the Contractor’s Staffing Plan.

C1.10.2 Notification of Limited Test Support Underway Operations SBX-1. Unless real world requirements dictate otherwise a 15 day in-port notification period will be provided for the contractor to prepare for SBX-1 (FOS) operation in accordance with Sponsor Security Requirements. Sponsor Security Requirements will apply during this mobilization period and throughout the LTSS Underway period. No additional personnel will be required during an LTSS Underway Period.

C1.11Personnel

C1.11.1 Key Shore Based Personnel The Contractor shall submit to the Contracting Officer resume of the Project Manager as well as a listing of contact information; including name, office telephone number and cellular telephone number and a list of references with their proposal. Substitution with equal or better qualified personnel requires Government Contracting Officer concurrence (CDRL A014). The Contracting Officer will review all resumes submitted by the Contractor and approve/disapprove the employment of each individual. The Contractor shall provide particulars dealing with the Project Manager’s qualifications showing why they are qualified for these functions. The Project Manager shall have at a minimum 10 years of Security or Law Enforcement experience and 5 years of Project Management experience.

C1.11.2 Key Shipboard Personnel The Contractor shall submit to the Contracting Officer resumes of the Assistant Anti-Terrorism Officer (ATO) assigned to the vessel under this contract as well as a listing of contact information of these personnel; including name, office telephone number and cellular telephone number and a list of references with their proposal. ATO's assigned to this vessel shall have a minimum of 10 years’ experience in security or law enforcement and 3 years of supervisory experience in security or law enforcement either in the civilian or military sector. Substitution with equal or better qualified personnel requires Government Contracting Officer concurrence (CDRL A014). The Contracting Officer will review the resumes submitted by the Contractor and approve/disapprove the employment of each individual. All documentation required under this contract for these key shipboard personnel shall be included with their resumes. The leading contractor Security Officer on board SBX-1 will be designated as the Assistant Anti-Terrorism Officer (Assistant ATO), and will have authority over other contractor Security Officers on SBX-1; it being understood that the vessel’s Master has final responsibility and authority on the vessel for all persons on board (other than military Embarked Security Teams).

C1.11.3 Contractor Security Officers If for any reason the Government is dissatisfied with the qualifications, conduct or performance of any contractor Security Officer (including the Assistant ATO) employed for service on SBX-1, the Contracting Officer will provide particulars to the Contractor, in writing, who shall promptly, independently investigate and take immediate corrective action, when appropriate, up to and including dismissal of the employee. The Contracting Officer may nonetheless direct that a contractor employee be removed from service on SBX-1. The Contractor will have no recourse, financial or otherwise, to the Navy for any corrective action taken by the Contractor.

C1.11.4 Contractor Security Officers Requirements All contractor Security Officers must be U.S. citizens and meet all state and federal regulations pertaining to security duties including background checks as well as obtain and maintain secret clearance as required by this performance work statement. Inclusive of this (but not limited to) is:

Speak, read, write and understand English clearly and correctly; follow instructions, both written and spoken;

prepare written reports as required; physically be able to stand the entire watch on his or her feet and fulfill roving watch duties as required; and attend Government Furnished training as required. The cost for any additional training is reimbursable in accordance with Section H.

C1.11.5 Crew Retention Plan Contractor shall establish and implement a security team retention plan, which shall remain current throughout the contract. It shall address continuity of services and actions taken to increase the instances of Security team members returning to the SBX-1 no later than the start of PoP. (CDRL A016)

C1.12 Operational Responsibilities

a) The Master will act as the ATO onboard SBX-1; the Master has the authority to delegate his responsibilities as ATO to an Assistant ATO. The Contractor shall provide an Assistant Antiterrorism Officer (Assistant ATO) (who serves as lead Security Officer) who will report to the Master and to act as liaison between security forces, other contractors and government personnel onboard. The Assistant ATO will communicate directly with appropriate Area of Responsibility (AOR) COCOM AT/FP POCs, to include MSC area commands. The Navy O&S AT/FP Lead will provide contact information for these POCs upon request. A team lead or second in command must be appointed to act for the Contractor’s Team Leader when the Assistant ATO is off-duty (CDRL A014).

b) Contractor personnel shall be capable of detecting, assessing, responding, delaying and disabling security threats and meeting performance goals of SI 538-2 and all applicable instructions. Periodic Navy and other agency inspections will evaluate performance and readiness of the Contractor Security Forces.

c) The Contractor shall update and maintain the VSP, with master (ATO), for approval by MSC N3, Director of Operations. The VSP shall meet all the requirements of a Security Plan as outlined in Reference C3.5. The Contractor shall comply with the VSP. The Contractor shall appoint a qualified individual who shall serve as the vessel's Assistant ATO. The VSP will be provided to MSC N34 within 90 days of contract award or before un-accompanied on-board performance begins. A Plan of Action and Milestones (Gantt chart) for maintaining the VSP shall be submitted as part of the contractors’ Transition Plan (see C-1.23a. below). The VSP shall include regularly scheduled readiness drills and exercises to assure readiness and capability to respond to anticipated threats. Such drills and exercises shall be scheduled in coordination with the Master, onboard Government representative and other operational contractors aboard the SBX-1. The VSP will further define and detail each of the security positions required IAW SI 538-2 and applicable references. The Contractor shall further collect and maintain verification records for the COR and other Government personnel as defined by the COR to demonstrate that the requirements of the VSP are met.

d) The Contractor shall designate certain Security Officers for service as Security Console Operators (SCO) (requirements for these positions are stated in the VSP). The SCO position operates the CCURE Alarm System, Close Circuit Television (CCTV) System, and communication equipment. The Government through the incumbent contractor will provide On-The-Job (OJT) training for CCURE Alarm System operations during the Transition period. The SCO coordinates actions of the Security Officers with Assistant ATO/Shift Lead oversight and control as required and IAW Emergency Action Checklists contained in the Vessel Security Plan. Duty schedule and rotation for the SCO position is to be defined by the Assistant ATO.

e) The Vessel and its associated contractor Security Officers will be subject to COMSC 5530.3 (series) requirements for MSC performed spot checks as well as NCIS performed Individual Ship Assessments (ISA’s).

f) A minimum of one roving security watch must be active at all times. Roving watch duties include alarm investigation, patrolling, and armed response. Additional roving watches may be required by the Assistant ATO, FPCON or situations justifying increased security and vigilance (such as chokepoints, in-port, etc.), and times the vessel is either moored or dockside IAW SI 538-2, and the Vessel Security Plan.

g) IAW SI 538-2 and the Vessel Security Plan, the in-port response force will consist of two members of the Vessel O&M Crew as provided by the Ship’s Master (ATO). The Assistant ATO shall ensure that assigned Vessel O&M Crew designated as in-port response force members are integrated into the Vessel Security Plan, associated drills, and shipboard training (conducted by the ATO). These individuals are “on-call” to respond in accordance with plans within the developed Vessel Security Plan and situations arising from actual incidents or increases in FPCON. Use of force by Vessel O&M contractor personnel will be in accordance with MSC ALMSC message 018/2012, which references DODD 5210.56 of 1 Apr 2011 (Carrying of Firearms and the Use of Force by DoD Personnel Engaged in Security, Law and Order, or Counterintelligence Activities).

h) Intel Warnings and Indicators: The Government Mission Site Representative (GOMSR) will provide the Assistant ATO with access to classified message traffic in order to access, read, and ensure his team is briefed on appropriate Intel Warnings and Indicators.

i) Contractor Security Officers must become familiar with the relevant characteristics of the SBX-1 prior to assuming their duties. As appropriate, these include, but are not limited to: general arrangement of the SBX-1, proper operation of the installed and portable security equipment, weapons and gear, firefighting equipment, lifesaving equipment, exposure suit, emergency duties, etc.

j) Functional Relationship: A professional and cooperative relationship between contractor Security Officers and the SBX-1 crew is critical to mission success, and must be maintained at all times. It is essential that the Assistant ATO/Shift Leads and Master appreciate their individual responsibilities and dependence upon each other. Embarked contractor Security Officers shall follow all lawful commands of the Master (including directions regarding the use of force) and act as much as possible, as part of the crew.

C1.13 Communications Telephone contact is preferred for items requiring immediate resolution.

C1.14 FUNCTIONAL RESPONSIBILITIES

a) Contractor Security Officers shall not perform tasks other than security functions aboard the vessel unless otherwise confirmed in writing by the Contracting Officer.

b) Use of force by contractor Security Officers shall be in accordance with DOD Directive 5210.56.

However, the Master has overall authority on board and responsibility for the vessel and can veto the use of force by contractor Security Officers that he believes is inappropriate or unlawful. The Master can also personally direct the use of force by contractor Security Officers when the use of force is lawful under Use of Force rules and the Master concludes that the use of force is necessary and appropriate. It is understood that the Master does not have to directly authorize the use of force by contractor personnel that is otherwise lawful under the Rules for Use of Force.

c) It is imperative for the Master and contractor Security Officer on watch to work together as a team while implementing force protection measures. This will require the contractor Security Officer/Assistant ATO to maintain situational awareness while the Master is navigating the ship, as well as determining the intent of approaching vessels. The contractor Security Officer shall keep the Master informed of the tactical force protection picture to allow the Master to maneuver his vessel so as to best protect his vessel and crew.

Consultation between contractor Security Officers and ship’s Master prior to the employment of force or protective measures is recommended when feasible, but is not required in the event that time does not permit such consultation.

C1.15 Staffing

C1.15.1 Underway Crew Size While underway the contractor shall provide a Security Officer Team comprised of 15 people separated into three labor categories as follows: one Assistant Anti-Terrorism Officer, two Shift Leads, and twelve Marine Security Officers. The Assistant ATO and Shift Leads are supervisors and exempt from overtime pay (requirements for these positions are stated in the VSP). Underway, this armed Security Officer Team shall always reside on the vessel unless conditions require otherwise. In those cases, special accommodations will be made to provide for billeting and messing, and capability to respond to incidents. The responsibilities/requirements for each labor category is defined throughout the contract document.

C1.15.2 In-Port Crew Size While in port the contractor shall provide a Security Officer team comprised of eight people separated into three contract labor categories as follows: one Assistant ATO, one Shift Lead, and six Marine Security Officers (requirements for these positions are stated in the VSP). Inport, this armed Security Officer Team shall always reside on the vessel unless conditions require otherwise. In those cases, special accommodations will be made to provide for billeting and messing, and capability to respond to incidents (this will be a reimbursable item).

C1.15.3 Contingency Underway Manning (Operational SSL-A) A minimum of three people shall form the SBX- 1 on-duty guard force while the vessel is underway. These include one Assistant ATO or Shift Lead, one Roving Security Patrol/Response Force person, and one Security Console Operator (requirements for these positions are stated in the VSP). The remaining off-duty security personnel shall form the Designated Immediate Response Force.

Elevated threat levels may require additional security watch standers IAW Vessel Security Plan, any overtime incurred here is reimbursable iaw C1.4.2.

C1.15.4 Limited Test Support Underway Manning (LTSS utilizing Sponsor Security Requirements) A minimum of two people shall form the SBX-1 on-duty guard force while the vessel is underway LTSS utilizing sponsor security. These include one Assistant ATO or Shift Lead and one Security Console Operator. The remaining off-duty security personnel shall form the Designated Immediate Response Force. Elevated threat levels may require additional security watch standers IAW Vessel Security Plan, any overtime incurred here is reimbursable iaw C1.4.2.

C1.15.4.1 In-Port Manning (Operational SSL-A) A minimum of seven people shall form the SBX-1 on-duty guard force while the vessel is in port in an operational (SSL-A) status. These include one Assistant ATO or Shift Lead, one Security Console Operator, one Entry Controller, two Roving Security Patrol/Response Force personnel, and two Line-of Detection Waterside Compensatory Rovers as covered in the SI-538-2 and VSP.

C1.15.5 In-Port Manning (utilizing Sponsor Security Requirements) A minimum of two people shall form the SBX-1 on-duty guard force while the vessel is in port in a non-operational (Sponsor Security Requirements) status.

These include one Entry Controller and one Alarm Monitor/Security Console Operator. Two Vessel O&M contract personnel will form the designated in-port Response Force. Use of force by Vessel O&M contract personnel will be in accordance with MSC ALMSC message 018/2012, which references DODD 5210.56 of 1 Apr 2011 (Carrying of Firearms and the Use of Force by DoD Personnel Engaged in Security, Law and Order, or Counterintelligence Activities). The on duty guard force shall only carry arms within the lifelines of the vessel in accordance with ALMSC message 018/2012 para 4.A, with the exception of using the portable toilet on the pier. During these short-duration breaks, the entry controller will notify the security console operator and pier sentry when leaving and returning in to his post.

C1.16 Personnel Clearances The Contractor shall ensure that all Security officers are U.S. Citizens and have a final secret security clearance before boarding the vessel (interim security clearances are not acceptable for contractor personnel). One contractor on board at all times will be required to have a security clearance with a government provided COMSEC and CRYPTO briefing. The Contractor is responsible for obtaining all required security clearances.

C1.16.1 Crew Screening The Contractor is responsible for providing a complete crew list to the COR no later than four working days prior to the date the security personnel will embark onboard the vessel in accordance with COMSCINST 5521.1(series). All security personnel will be screened through EPIC. The Contractor shall submit the Full Name, Billet, SSN, Date of Birth, US Passport number, nationality for all security personnel using the Government provided MSC/EPIC Force Protection Personnel/Crew list Submission Template to allow screening by the El Paso Intelligence Center (EPIC). The template must be filled out in its entirety by the contractor and resubmitted electronically in Microsoft Excel format to the following mailbox msc_pm23_goco-epic@navy.mil.

Submit security personnel as they are identified to go to SBX-1. When a security personnel member is replaced, only submit that security personnel member instead of submitting the entire crew list again when the new security personnel member is submitted. All new personnel must be screened at the beginning of the hiring process prior to being sent to the SBX-1. All personnel shall be resubmitted at least once in each 12-month period.

C1.17 Contractor Responsibility for Safety Nothing in this Performance Work Statement, nor any Government action or failure to act in surveillance of this contract, shall relieve the Contractor of its responsibility for the safety of the contractor’s personnel and property, the Government’s personnel and property, and the general public whether it is Instructor/Only support or turnkey. Furthermore, nothing in this performance work statement shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local Laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

C1.18 Berthing Accommodations Berthing space on the SBX is limited to 8 staterooms, all of which are dual bunks (2 beds per stateroom). Persons berthed together should be of the same sex unless it is as spouses and arrangements made, create no undue disruptions to ships operations, and are in the best interest of the command.

C1.19 On-board Storage The Contractor‘s general storage is limited to that provided in the staterooms described in C1.18.

C1.20 Travel Personnel Travel will be necessary. Travel origination for employees will be based on each employee’s residence within the Continental United States, Alaska or Hawaii for purpose of determining maximum allowable limit. Travel costs are reimbursable. All travel shall be in accordance with the Joint Travel Regulations.

C1.21 Food and Recreation Facilities on-board the SBX-1 include limited recreation facilities including gym and cafeteria. The Government, through the MSC Vessel Operations contractor, shall provide all necessary food for consumption by security contractor personnel (3 meals a day and personnel assigned to nightwatch with hot lunches served between the hours of 2330-0030). Due to the limitations onboard, not all dietary restrictions may be provided for.

C1.22 Reporting Criteria The Assistant ATO shall submit reports to the Master (ATO) and the Contracting Officer’s Representative as required by the terms of this contract.

C1.23 Deliverables Deliverables shall be submitted in accordance with the associated CDRL.

a) Transition Plan The Contractor shall provide a plan to accommodate the transition between the incumbent contractor and the performing contractor. The Transition Plan shall include a mobilization schedule as well as a VSP POAM (see Section C 1.12c). This is a one-time deliverable due with the proposal. The mobilization timeline/contract turn-over of personnel, property, familiarization, training and weapons accountability shall be conducted in seven (07) to ten (10) consecutive days. All transition costs (including VSP development) shall be for the Contractor's account except as specifically otherwise provided in the contract.

b) Staffing Plan (CDRL A002) The COR, Master and GOMSR shall be provided with the contractor’s staffing plan. The initial staffing plan is required with the contractor’s proposal and the final staffing plan is required 2 weeks after contract award and updates must be submitted two weeks before implementation except in emergency situations or as required by FPCON. Due to the unique nature of mission and vessel operations aboard the SBX-1, personnel schedules may frequently change to support operational missions and OSV transit scheduling.

c) Daily Logs and Briefings (CDRL A003) Daily security and AT/FP briefing shall be in accordance with the CDRL, including information such as Vessels of Interest (VOI), Integrated Electronic Security System status and discrepancies, etc. The contractor shall maintain a Daily Activity Log/Blotter of all activities, incidents or threats.

d) Vessel Security Plan (CDRL A004) The Contractor shall update and maintain the VSP IAW 5530.3 (Series) submit to the MASTER, COR and MSC N34 for concurrence and the Assistant ATO shall review/update at least annually thereafter unless a change in procedures is necessary. The contractor shall be responsible for implementing the VSP.

e) Security Plan Verification Records (CDRL A005) The Contractor shall collect and maintain records demonstrating that the requirements of the Vessel Security Plan are met.

f) Administrative Procedures and checklists (CDRL A006) The Contractor shall develop and maintain the Security Administrative Procedures and Security Officer Response procedures and check lists as required.

g) Firearms and Ammunition Control (CDRL A007) The Contractor shall maintain control of and responsibility for firearms and ammunition aboard the vessel IAW OPNAVINST 5530.13 (series) (Physical Security of Conventional Arms, Ammunition, and Explosives), OPNAVINST 8015.2 (series) (Conventional Ordnance Inventory Accountability), the NAVSUP P724 (latest rev) (Conventional Ordnance Stockpile Management, Policies and Procedures), NAVSEA OP4 (Ammunition & Explosives Safety Afloat),…
