SECTION C

SUMMARY OF ADDITIONAL ENVIRONMENTAL REQUIREMENTS:

These action items must be added to the specifications section of the contract or resolved before contract award.

Hazardous Materials 1 The Contractor will ensure proper handling, storage and proper disposal of all hazardous material.

2 The Contractor is responsible for ensuring that personnel are trained in the

Hazardous Communication (HAZCOM) Standard prior to hazardous material usage.

3 The Contractor will maintain records throughout the course of the project of all manpower and material expenditures and will ensure accountability for material in the Contractors possession.

4 The use of hazardous materials in this project may be subject to the installation's regulatory reporting requirements under the Emergency Planning and Community Right- To-Know Act (EPCRA). The following information shall be submitted to the NAS PAX HazMat/EPCRA Program Manager, Leslie Churilla 301-757-4930 as soon as possible:

5 SDS and product specs for all hazardous materials to be applied/used.

6 General description of the intended use for each product.

7 Total amount used (preferably weight).

8 Span of dates the products are used.

9 Maximum amount of product that will be on site AT ONE TIME.

10 Ensure contractors working on new construction projects remove all unused hazardous materials and waste generated by the project.

• NDWINST 5090.1 4 May 2018

Air Quality and Emissions 11 Ensure the contractor provides a copy of each technician’s HVAC certification and the certification for each piece of equipment*. Contact the Air Quality Program Manager, Leslie Churilla 301-757-4930 for assistance and additional information.

12 Repair of a large appliance (i.e., containing >50 lbs of refrigerant per circuit) must comply with all applicable requirements of 40 CFR 82, Subpart F. Contact the Air Quality Program Manager, Leslie Churilla 301-757-4930 for assistance: o Contractor shall immediately notify the Air Quality Program Manager if the appliance is suspected to be leaking. Contractor shall provide to the Air Quality Program Manager, the actual or estimated lbs of refrigerant lost, and determine the current leak rate of the equipment (i.e., lbs of refrigerant lost since the last time it was checked) [40 CFR 82, Subpart F].

12.0 If this leak rate exceeds the appropriate threshold*, the repair must be completed within 30 days of discovery. A repair must bring the leak rate below this threshold. If the repair cannot be achieved within 30 days, all refrigerant remaining in the circuit MUST be immediately evacuated and the circuit taken offline and mothballed until the repair/replacement can be completed. Contractor shall report the circuit’s operating status to the Air Quality Program Manager as soon as possible. o Initial and follow-up verification tests are BOTH required to be completed within 30 days of the repair, per

40 CFR Part 82. o In accordance with 40 CFR §82.157, notify the Air Quality Program Manager of the leak rate, refrigerant type, and the amount of new refrigerant that is charged to the circuit to bring it back to full. Include all relevant dates for the repair: date leak is discovered, date of repair (or shutdown/mothball), date of initial verification test and result, date of follow-up verification test and result.

13 Per 40 CFR 82-97, if refrigerant(s) is recovered from an appliance and not reinstalled (i.e., is sent out for disposal/reclamation), ensure the contractor provides a signed statement to the Air Quality Program Manager, Leslie Churilla 301-757-4930, with the following information:

13.0 Identify the appliance/circuit from which the refrigerant was removed; o Date the refrigerant is recovered from each appliance/circuit; o Type and quantity of refrigerant recovered from each appliance/circuit; and o Name and address of the certified technician who recovered the refrigerant; o Name and address of the person to whom the recovered refrigerant is transferred for reclamation or disposal*; and

13.1 Date that the recovered refrigerant is transferred for reclamation/disposal*.

14 Do not procure new equipment containing an Ozone Depleting Substance (ODS) (e.g., R- 22 refrigerant), per OPNAVINST 5090.1D, Chapter 22. Notify the Air Quality Program Manager, Leslie Churilla 301-757-4930 of the refrigerant type and charge amount used in new HVAC equipment.

Program Manager Comments:

Follow the above action items and incorporate as appropriate into all specifications (e.g., RFPs SOWs) associated with this project. Additional information is provided below:

*Technicians must be certified per EPA requirements at 40 CFR 82 [OPNAVINST 5090.1D, Chapter 22].

Equipment used to recover, recycle, or reclaim refrigerant must also meet EPA standards.

*Threshold leak rates that require action, by equipment type [40 CFR 82.156 (Subpart F)] (Note: EPA recently lowered these thresholds, effective January 1 2019):

15 Industrial process refrigeration – 30% refrigerant loss from the circuit per 12-month period (or the equivalent)

16 Commercial Refrigeration – 20% of the circuit 17 Comfort cooling – 10% of the circuit 18 All other equipment – 10% of the circuit

*Effective on January 1, 2018, technicians who dispose of more than 5 lbs of refrigerant, must keep detailed records on both the recovery of refrigerant from the appliance, and the refrigerants’ ultimate transfer for disposal/reclamation (per 40 CFR 82, as amended).

In terms of the routine communications/submittals that the EV/Air Quality Compliance Program will need to be receiving from Carrier (or the Facility Coordinators):

A. Carrier to track/document PM/repair actions performed on each CIRCUIT. For example, Chiller #1/Circuit A vs. Chiller #1/Circuit B. The regulation pertains to each circuit, so we need to be able to differentiate PMs/repairs done on one circuit vs. the other in the same chiller.

B. All leak check records (including date and results/observations) (performed annually with the PM)

C. Same day notification that a circuit with >50 lbs of refrigerant is suspected of leaking.

We don’t need to know how much has been lost, just that an observation of a leak was made.

D. All records documenting the quantity of refrigerant in the circuit measured on a given day… if a circuit is evacuated and the refrigerant is pulled out for any reason, it needs to be weighed and we need to record the date and lbs. This is required for quantitative leak rate monitoring. If the measurement indicates no leak, that is just as important as confirming a leak, and EV needs to record it.

E. Refrigerant recovery/removal records as described in the 4th bullet above. This goes for any amount of refrigerant >5 lbs that is removed from the circuit and taken offsite for disposal/recycling.

F. Descriptive PM and repair service records for any action that involves the removal/recharging of refrigerant in the circuit. At a minimum: the refrigerant type and the amount of new refrigerant that is charged to the circuit to bring it back to full, and all relevant dates for the repair: date leak is discovered, date of repair (or shutdown/mothball), date of initial verification test and result, date of follow-up verification test and result. All other PM/repair records (not involving refrigerant removal/recharging) must be made available to the EV Department upon request.

G. If Carrier has any kind of SOP or business practice they can share that describes how they maintain EPA-compliant and inspection-ready records on the equipment they service, please provide them.

PRESENCE OF NORMAL CIRCUMSTANCES:

This proposed action will not affect public health or safety. No wetlands or migratory bird populations will be affected by this action, and no listed threatened or endangered species are located in the vicinity. No structures in the vicinity are potentially eligible for the National Register of Historic Places (NRHP). According to various archeological surveys, no archeological sites are known to exist in this area. The proposed action does not have the potential for significant environmental effects on hazardous waste sites, according to the Federal Facilities Agreement. This action will not involve effects on the human environment that are highly uncertain, involve unique or unknown risks, or that are scientifically controversial.

Finally, the proposed action does not establish a precedent nor threaten a violation of Federal, State, or local environmental law.

GENERAL CONFORMITY RULE DETERMINATION:

(1) In accordance with Section 176(c) of the Clean Air Act, the action is located in an attainment area (St. Mary’s County, MD) for NAAQS levels PM10, NO2, SO2, Carbon Monoxide, Ozone, and Pb, and is not subject to the conformity rule. This project will also meet the Northeastern Transport Region levels of 50 tons/year for Ozone.

CONCLUSION:

Subject proposed action can be categorically excluded from further National Environmental Policy Act (NEPA) processes per OPNAVINST 5090.1D, Reference (c), Chapter 10, Section

3.14 Table 10-6:

(8) Routine repair and maintenance of buildings, facilities, vessels, aircraft and equipment associated with existing operations and activities (e.g., localized pest management activities, minor erosion control measures, painting, and refitting).

52.204-13 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE (OCT 2018)

(a) Definitions. As used in this clause--

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management (SAM) records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that--

(1) The Contractor has entered all mandatory information, including the unique entity identifier and the EFT indicator (if applicable), the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into SAM;

(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''.

System for Award Management (SAM) means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—

(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;

(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12;

and

(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b) If the solicitation for this contract contained the provision 52.204-7 with its Alternate I, and the Contractor was unable to register prior to award, the Contractor shall be registered in SAM within 30 days after award or before three days prior to submission of the first invoice, whichever occurs first.

(c) The Contractor shall maintain registration in SAM during contract performance and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement. The Contractor is responsible for the currency, accuracy and completeness of the data within SAM, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in SAM after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in SAM to ensure it is current, accurate and complete. Updating information in SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(d)(1)(i) If a Contractor has legally changed its business name or ``doing business as'' name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to--

(A) Change the name in SAM;

(B) Comply with the requirements of subpart 42.12 of the FAR; and

(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (d)(1)(i) of this clause, or fails to perform the agreement at paragraph (d)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in SAM. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the EFT clause of this contract.

(3) The Contractor shall ensure that the unique entity identifier is maintained with the entity designated at www.sam.gov for establishment of the unique entity identifier throughout the life of the contract. The Contractor shall communicate any change to the unique entity identifier to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the unique entity identifier does not necessarily require a novation be accomplished.

(e) Contractors may obtain additional information on registration and annual confirmation requirements at https://www.sam.gov.
