DEPARTMENT OF THE NAVY

NAVAL AIR SYSTEMS COMMAND AIRCRAFT DIVISION

21983 BUNDY ROAD, BUILDING 21983

PATUXENT RIVER, MARYLAND 20670

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved.

This Sole Source Justification and Approval authorizes and approves the issuance of a Firm Fixed Price (FFP) contract action on a sole source basis with L3 Brashear for the repair the Kineo Tracking Mount

(KTM).

3. Description of Supplies/Services.

Repair of one KTM, #229, by field replacement of the elevation inductosyn and resolver.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The Atlantic Test Range (ATR) inventory of KTMs are highly complex optical tracking systems, and can only be repaired or upgraded by the manufacturer, due to the proprietary nature of these systems.

Anything associated with engineering services to the KTMs, either hardware or software, must be addressed by L3.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A combined synopsis/solicitation was posted in Beta.SAM.gov on 6 January 2020 with the Government’s intent to award to L3 Brashear. In this case, no other contractor has the knowledge or capability to perform the repairs and upgrades. Only L3 has the expertise and proprietary knowledge to repair and upgrade a KTM. Responses were due on 9 January 2020. Only one quote, from L3 Brashear, was received as a result of the solicitation.

7. Determination of Fair and Reasonable Cost.

Based on a price justification letter from L3 Brashear certifying the pricing provided for the KTM repair is consistent with that provided to others for similar or equivalent work, the Contracting Officer has adequate information and background to determine a fair and reasonable cost.

8. Actions to Remove Barriers to Future Competition.

The ATR will continue to monitor the market for vendors that can provide the expertise and capability to provide a complete system needed to satisfy and support requirements. If another potential source emerges, ATR will assess whether competition for future requirements is feasible.

Per NAVAIR Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
