DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION

BUILDING 505

PATUXENT RIVER, MARYLAND 20670-1127

IN REPLY REFER TO:

J&A_16_0234

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves, on a sole source basis, a nine (9) month

Cost Plus Fixed Fee (CPFF) and Cost Reimbursable Indefinite Delivery Indefinite Quantity (IDIQ) bridge contract to Mantech Systems Engineering Corporation (Mantech), 12015 Lee Jackson Hwy, Fairfax, VA

22033-3300, for AIR 4.1.10’s Reliability and Maintainability support services. This stand-alone bridge contract allows for continued support once the existing contract, N00421-11-D-0027, expires and the follow-on, being competed under Solicitation N00421-15-R-0043, is awarded. The estimated total value is

$8.8M inclusive of labor and other direct costs. The current contract’s task orders are expected to run out of ceiling in August 2016 and the bridge contract period of performance is anticipated to be from 1

September 2016 to 31 May 2017. In addition to the initial nine (9) months, FAR 52.217-8 Option to Extend

Services will be incorporated into the contract to permit an extension up to six (6) additional months at an estimated value of $5.8M. With the optional extension, the total contract value is estimated at $14.6M for a period of 15 months.

3. Description of Supplies/Services.

This J&A will cover the full scope of the existing Statement of Work (SOW), which contains requirements for engineering and technical support for reliability, maintainability, testability, quality assurance, diagnostic and system safety analyses during the design, development, production and in-service cycles of all Naval aircraft and their systems. This support encompasses carrier based tactical aircraft, shipboard capable vertical/short takeoff and landing aircraft, maritime support aircraft, unmanned aircraft, tactical weapons systems, support systems and equipment and aircraft launch and recovery equipment.

Aircraft Programs supported under this contract will include, but not be limited to the Joint Strike Fighter

(JSF), MV-22, CV-22, H-1, P-8, MH-60S, CH-53K, AMCM, H-60 Legacy, Presidential Helicopter VH-9A, F/A-18 and the EA-6B. These efforts are focused across a broad business base comprised of Integrated

Program Teams (IPT's), Externally Directed Teams (EDT's), and Enterprise Teams (ET's), which support all Naval Air Programs.

Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

4. Rationale Justifying Use of Cited Statutory Authority.

These services are currently being provided under contract N00421-11-D-0027 with Mantech. The follow-on competitive contract action is in process; however, the current task orders will run out of ceiling in

August 2016.

Pursuant to FAR 6.302-1(a)(2)(iii)(B), only Mantech can perform the required continuation of effort without unacceptable delays to the AIR 4.1 program. Work stoppage in critical warfighter capability installations, as well as significant delay and disruption in the long term life-cycle engineering across multiple programs will occur without award of this bridge contract. Mantech, as the incumbent, is intimately knowledgeable and the only contractor capable of meeting current tasking needs in the time allotted to avoid a gap in services.

Awarding to any other firm would inject delay into the schedule, as their personnel would face a learning curve and cause degradation of performance quality. Due to the complexity of R&M issues as related to

Naval aircraft systems, extensive indoctrination and training on NAWC-AD R&M work packages and toolsets is required prior to contractor staff becoming functional members of the integrated product team.

For example, extensive training of at least six weeks and, at times, as much as four months, will be needed prior to contractor staff being assigned to the program's IPT. The aforementioned delays are unacceptable to the Government, as they would compromise mission readiness for Navy customers. As such, Mantech is the only responsible source capable of providing the services to satisfy the Government’s requirements within the scheduled timeframe.

5. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The requirement in DFARS PGI 206.302-1 has been waived by Class Waiver of DFARS PGI 206.302-1

“Request for Information/Sources Sought (RFI/SS) Requirement for Bridge Actions” dated 9 June 2015.

Pursuant to FAR 5.201, a synopsis was posted on 03 March 2016 via FedBizOpps and to date, no other potential sources have expressed an interest in this requirement or contested a proposed award on a sole source basis to Mantech Systems Engineering Corporation.

6. Determination of Fair and Reasonable Cost.

Government’s estimated costs for this action are based on prior history and utilization of Mantech’s actual costs under current contract N00421-11-D-0027. In accordance with FAR 15.402, the Contracting Officer shall ensure all supplies and services provided under this contract are procured at a fair and reasonable price. The Contracting Officer will obtain sufficient cost and/or pricing data, utilize available indirect rate information, and consider previous estimated and actual cost history when making this determination.

7. Actions to Remove Barriers to Future Competition.

Market research was conducted by AIR-4.1.10 to ensure the acquisition approach was the most suitable for acquiring the required services. The statement of work was reviewed and updated to remove any restrictive language and a sources sought announcement was advertised on the FedBizOpps website.

Additionally, as requested by the NAVAIR Office of Small Business (OSBP), another sources sought was conducted based on a NAICS/keyword search within the Small Business Administration (SBA) Dynamic

Small Business Search (DSBS). A total of seven businesses submitted capability statements in response to the sources sought announcement. Further research included an internet search, as well as a search of the Federal Procurement Data System (FPDS). Based on the market research results, the Government is currently processing the follow-on contract as an unrestricted competition.
