About this file

This amendment to a solicitation from the Department of the Navy seeks proposals to provide polygraph services for the Naval Criminal Investigative Service. Offerors must propose unit prices for polygraph examinations and no-show rates across four lots covering locations in Hawaii, the Southwest/Northwest, Southeast, and Washington DC/Mid-Atlantic/Midwest regions. Prices should be all-inclusive of direct, indirect costs and profit. The period of performance is five years from September 2020 through August 2025. Proposals are due by July 2020 and will be evaluated based on management approach and past performance. The incumbent contractor performed an average of 2,000-2,400 examinations annually across multiple task orders.

What is the methodolgy for delivering equiment to test sights prior to exam?

Limestone is used and all polygraph equipment is provided by NCIS PSFO. A couple portable polygraph charis can be made available, but generally, no no charis are provided. Equipment will either be shipped to the PM to be sent to examiners or to general locations where examiners can pick up. PM will need to account for equipment.

yes, in a case by case need

4 24 2b Please provide additional details on the quality control process of each examination.

Fridays 2 exams would be due on Monday, if three calendar days and examiner may have 2 exams scheduled for Monday. Important if internet is a challenge in hotel or lodging over weekend or if Friday afternoon exam runs long. Is this three calendar days, or three working days?

Three working days, but currently Gov examiners generally get their exams in the same day, so typically that happens and three working days is more than enough time to accomplish this.

16 15 3.3.4 & 3.3.5

Is all QC performed by NCIS? What timeframe will QC provide feedback on incomplete or failure to meet QC and Federal polygraph standards?

All QC is by NCIS senior QC personnell and, generally QC is completed within one day, but QC has up to five days to get this completed.

17 16 4.1.4 Are Original DODPI, DACA, NCCA gradution certificates an exception to the 7 year ineligibility?

Examiners used to conduct exams should not be out of the 7 year scope to being a federally certified examiner. They have to have been a running, certified examiner.

18 16 4.2.8 Must APA and AAPP cources be approved by COR in advance of attending?

No, but they NCIS needs to be notifed and the course should be approved by NCCA to account for CE credits.

19 17 5.1.1 Must each site be physically inspected, or can it be approved via a video walk thru of the site?

Sites should, if at all possible be physically inspected. If not possible the COR will make the call if the space is suitable.

20 18 5.2.7 Does a public parking lot near the testing site fullfill this requirement?

Will the examinee be responsible for paying for his/her own parking fees, as long as the lot location is provided?

Examinees should not be responsible to pay for parking as the exam is a gov requirment.

Any motion sensors besides seat motion sensor utilized?

No, it is not in use and seat sensors are currently in use and feet sensors will be in the very near future.

22 18 6.2 Will all contractors be attending this orientation meeting?

Will the meeting be conducted by NCIS in an NCIS facility? How many days will this orientation meeting be held?

Will NCCA approved CEU's be credited during this orientation meeting?

Will there be more than one orientation session held, in case additional examiners are hired at a later date?

This is accomplished by the contract vendor however they seem fit to ensure proper training to accomplish adequate/proper CSP exams.

23 19 10.1.1.3 Will the CSP polygraph examination be conducted within 50 miles of the contract examiners home?

No, exams will be done within 50 miles of the examinees place of work.

24 19 10.1.1.7 Will a copy of NCIS polygraph operating procedures, authorized questions and a decision analysic chart be allowed in the authorized contractor testing rooms?

yes.

25 20 10.1.1.9 If we are using contracted offices to administer exams, will we receive an electronic copy of the examinee application including personal data during the exam preparation stage?

No, pre-employment exams oe ESS exams will not be administered. Only CSP exams.

26 20 10.1.1.10 If we are conducting exams at an authorized rented space, then are these sites included in "any NCIS facility?" Does this mean all reports and scoring will be completed at the office?

No, and no, reports can be accomplished anywhere, but of course scoring should happen immediately after administering the exam.

27 21 Will each examiner be given a SAAR-N to access the polygraph reporting system?

Will this occur prior to orientation, so it can be used at that time for training purposes?

Yes, each examiner will have access and in theory will be accomplished prior to training.

28 22 Will NCIS have access to examiners electronic fingerprints previously submitted thru AFIS when working for other federal agencies?

No, not understood why this would be necessary.

29 11 2.2 Where are the Government Offices located where polygraphs will be performed??

Government offices are located all over the continental US and HI potentially wherever there is an NCIS presence. In the past Contract polygraphs were performed at govt spaces in Patuxent River, MD, Pensacola, FL, Monterey, CA. and in TX.

30 11 2.2 In what locations should the Contractor's Offices be located to perform the examinations?

The contract vendor would be expected to perform polygraph examinations at locations throughout the United States. The locations are expected to vary per command Task Order and each year. The loactions are very fluid and anywhere there are 10 or more needed examinations in a given area the contract vendor would be expected to complete them.

31 12 2.3 and 2.4 What is the method in which NCIS provides the contractors with the examinee's information? Ie. Government Portal, Secure email, Contractor's secure portal?

Typically SAFE site is used.

32 N/A For the current, incumbent contract, what were the total number of exams performed for the contract period of performance for Lot I? Lot II? Lot III? Lot IV?

The information broken down by lot is not immediately available, but the total number being conducted averaged between 2000- 2400 annually.

33 12 2.6 Sessions are defined as a 4-hour time period. Can the Contract Examiner perform 2 exams per day?

yes

34 13 3.1.9.1.4 and 3.1.9.1.5

The RFP section 3.1.9.1.4 states "provide means to receive appointment requests..." but section 3.1.9.1.4 states "Use the government system of Lighthouse to remotely view and schedule appointments. Will the Contractor utilize the government's scheduling system or will government entities need access to the Contractor's system?

The contract vendor can use whatever system they wish to be most efficient, however the information would also have to be put into our Lighthouse system to be viewed.

35 13 3.1.9.5 Will the Government Sponsor the Prime Contractor's Facility Clearance?

unknown, but I believe so.

36 16 4.2.4 RFP states "Initial polygraph orientation training...is provided by contracted PM". Is there additional training/Government provided orientation that will be conducted/required?

An overall orientation of the NCIS Polygraph Services Field Office needs/expectations can be accomplished, then further training to specific examiners will need to be accomplished by the contracted PM.

37 19 10.1.1.3 Contractors will be required to pass or have a current NCIS approved CSP polygraph examination prior to assignment to the contract. What is the timeframe within the onboarding of the examiner for which these are conducted by NCIS? Can/are later contract examiner hirers examinations be performed by approved contract examiners since the QC is done by NCIS?

No examiner current testing is requred at this time.

38 77 Does "extended amount" mean the calculation of # of Exams X Price Per Exam?

Yes, it should be calculated by multiplying the number of exams for each Lot/Location by the exam price for that specific Lot/Location.

(c) The COR will act as the Contracting Officer’s representative for technical matters, providing technical direction and discussion as necessary with respect to the specification or statement of work, and monitoring the progress and quality of contractor performance. The COR is not an Administrative Contracting Officer and does not have authority to take any action, either directly or indirectly, that would change the pricing, quantity, quality, place of performance, delivery schedule, or any other terms and conditions of the contract (or task order), or to direct the accomplishment of effort which goes beyond the scope of the statement of work in the contract (or task order).

(d) It is emphasized that only a Contracting officer has the authority to modify the terms of the contract, therefore, in no event will any understanding, agreement, modification, change order, or other matter deviating from the terms of the basic contract between the contractor and any other person be effective or binding on the Government.

When/if, in the opinion of the contractor, an effort outside the existing scope of the contract (or task order) is requested, the contractor shall promptly notify the PCO in writing. No action shall be taken by the contractor under such direction unless the PCO or ACO has issued a contractual change or otherwise resolved the issue.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2020)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the

Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the

Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent

Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA

(j) Unique entity identifier. (Applies to all offers that exceed the micro-purchase threshold, and offers at or below the micro-purchase threshold if the solicitation requires the Contractor to be registered in the System for Award

Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one.
