J&A 18-063

JUSTIFICATION FOR OTHER ThAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF AGENCY AND CON1~RACTING ACTIVITY: The requiring activity is the Commander, Naval Computer and Telecommunications Area Master Station Atlantic (NCTAMS LANT); the contracting activity is the NAVSUP FLC Norfolk Contracting Department, Philadelphia Office.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This is a sole source action to be awarded as a new contract with SBC Global Services, dba AT&T Illinois, Chicago, IL. The placement of a Firm, Fixed Price (FFP) contract is anticipated for the services described in paragraph 3.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The instant requirement is for commercially available integrated, switched voice and data telecommunications services via Central office based, dial tone facilities at the Naval Station (NAVSTA) Great Lakes, Illinois under the auspices of the Naval Computer and Telecommunications Area Master Station Atlantic (NCTAMS LANT), Norfolk, VA.

The requirement is to obtain Central Exchange (CENTREX) services for approximately 4,900 telephone stations and approximately 4,200 voice mail services on NAVSTA Great Lakes and tenant activities located in the Great Lakes, IL area. The required services include analog and digital circuit service, hosted voicemail services including individual mailboxes and auto attendants, local area calling, ISDN Basic Rate Interface service, ISDN Primary Rate Interface circuits, high capacity (T1flS 1) digital circuit service and maintenance and service responsibilities as defmed in the current illinois Commerce Commission regulations. The service provides access to the Public Switched Telephone Network (PSTN) and Defense Switched Network (DSN).

To perform the required CENTREX services, the contractor must have access to a Central Office/cable plant with a major switch within 30 miles ofNaval Station Great Lakes. The Contractor must be able to deliver telephone service directly to Rate Demarcation Point (RDP) located in each of the buildings at Naval Station Great Lakes and must be able to respond to repairs and installations within a prescribed timeline so their resources need to be in the immediate area. The Contractor must also have the ability to reserve a block of approximately 5,400 numbers in the 847-688-xxxx telephone exchange for use by the Government.

The instant requirement represents a follow-on to Contract N00189-15-P-Z931 awarded on a sole source basis to SBC Global Services, Inc. DBA, AT&T Illinois, Chicago, IL. The current contract performance period expires on 30 September 2018.

The contract will be for a base period of six months, with services commencing on 01 October 2018 and continuing through 31 March 2019. The customer requested the abbreviated 6-month base period to shift the POP start date away from the start of the Government fiscal year. The contract will include the provision of four (4) one-year options. The total potential period of performance consists of fifty-four (54) months. The total cost of the six-month base perio’ and the total estimated cost of this requirement, inclusive of option is

4. IDENTIFICATION OF STATUTORY AUTHORITY: 41 USC 190 l(e)(2) - a sole source acquisition under the authority of the Special Rules for Commercial Items, as implemented by FAR 13.501(a).

J&A Number 18-063

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY: Inclusive with the CENTREX service, AT&T provides and maintains the outside cable plant delivering services to Rate Demarcation Points located in each of the buildings throughout the NAVSTA Great Lakes (i.e., the contractor owns the cable plant). Therefore, for another firm to provide CENTREX service at NAVSTA Great Lakes, this new firm would need to build an outside cable plant and transition the service to the replacement infrastructure. It is estimated that the initial capital outlay to do so would exceed S1OM. While the Government has considered acquiring the Cable Plant and providing it as GFP in order to facilitate a competitive acquisition, the Govermnent does not have the financial resources at this time to acquire the Cable Plant from AT&T. Additionally the Navy has publicly stated that an enterprise “Unified Communication” voice service will be deployed to replace the legacy systems in the future, therefore any company who would choose to compete against AT&T for this contract would likely not have time to recover theft capital investment costs before the Navy migrated the services to the enterprise platform. Given this, AT&T is considered the only source who could provide the required services described herein.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS

PRACTICABLE: A pre-solicitation synopsis will be posted to the Government-wide point of entry and all interested vendors will be invited to identify their capabilities to perform the requirement. Note however, that a Sources Sought was issued on August 092018, to aid market research and determine if there were any additional businesses capable of providing these services. Three responses to the Sources Sought were received, one from the incumbent AT&T, The latter two responses were reviewed by the requiring activity and contracting office to determine if they are capable of supporting this requirement.

their capability statement that they have contracts with Local Area Providers that allow them to resell POTs or “plain old telephone services” line services and features; however, POTS differs from CENTREX services as it is basic analog services with no other special or customizable features. CENTREX service provides switching at the provider’s central office instead of on the customer’s premises. Centrex services are highly customizable. If Naval Station Great Lakes were to switch all their lines to POTS lines, they would lose many of the required features such Call Forwarding features, conference calling and usage billing by line number as well as access and interoperability with the Defense Switched Network (DSN). Using POTS service would also increase the government overall cost. Intra-CENTREX calls using four digit dialing between buildir ‘is are free, whereas calls between any two POTS lines within Illinois incura local per miiv’te toll call chargc is focused on maintaining Government owned equipment and systems. It does not address the delivery of commercial telephone or CENTREX services as sought in the requirement. , did not identify their capability to deliver the services required.

Additional market research was conducted by the requiring activity in an attempt to breakout the sole source nature of this requirement. Market research indicated that had previously expressed interest in the instant requirement. However, after being afforded an opportunity to survey the NAVSTA Great Lakes site decided not to pursue this requirement any further due to the extent of initial capitalization costs involved did not respond to the sources sought for this instant requirement. To date, no other companies have expressed interest in becoming qualified to compete for the instant requirement to be acquired under the proposed contract.

J&A Number 18-063

7. DETERMINATION OF FAIR AI~11) RESONABLE COST: The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION: DFARS 213.501 requires that non-competitive follow-on acquisitions of supplies or services previously awarded on a non-competitive basis, include the additional documentation required by 206.303-2(b)(i) and follow the procedures at PGI 206.304(a)(S-70). These citations require that the justification package include a copy of the previous justification to assist the approval authority in determiningwhether the planned actions to remove any barriers to competition cited on the previous justification were completed. The approving official has reviewed the prior J&A and has considered the market research performed for this follow-on requirement, including the results of the sources sought synopsis, and has determined that the actions to attempt to remove barriers to competition have been completed. However, the circumstances limiting sources have not changed, and therefore the follow-on requirement remains a limited source action. Future requirements will be handled on a case by case basis. Future sole source requirements shall be subject to additional market research and will require the posting a sources sought notice to identify additional potential sources in the hope of fostering a competitive environment.
