DEPARTMENT OF THE NAVY
NAVSUP FLEET LOGISTICS CENTER NORFOLK 700 ROBBINS AVENUE, BUILDING 2B PHILADELPHIA, PA 19111-5083
JUSTIFICATION AND APPROVAL FOR USE
OF OTHER THAN FULL AND OPEN COMPETITION
IN REPLY REFER TO: 260.3A EK
1. Contracting Activity. NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office.
2. Description of the Action Being Approved: Award of a sole source CPFF action with Accenture Federal Services. The resulting contract is a bridge action to a portion (less than 6%) of the services currently being provided under N00189-16-D-0013-0002. The resulting contract will provide for a six-month period of performance pending award of a competitive SeaPort-e task order.
3. Description of Supplies/Services: In August 2018, the Logistics and Readiness IT Executive Committee (LOG IT EXCOMM) approved the 200-page Digital Transformation Plan, and execution activities are ramping up for the FY19 investment of approximately $775M. The resulting contract will continue services in support of DCNO for Fleet Readiness and Logistics (N4) and Warfare Systems (N9) digital transformation of Navy capabilities to meet warfare, readiness, and compliance requirements, including financial auditability and cybersecurity.
The scope of this effort is for a Logistics Digital Transformation Team (DTT) to provide IT strategy and digital transformation subject matter expertise; recommended methods and approaches for strategy development, strategy governance, and oversight of strategy execution; and management support to the LOG FAM in the pursuit of digital transformation. The scope is limited to the purview of OPNAV as a portfolio manager and resource sponsor, and therefore applies to concepts, methods, and approaches, rather than development of specific requirements or solutions.
The nature of this work involves significant investment of time and resources in engaging with disparate stakeholders and SMEs at many echelons of the Navy, as well as with internal or commercial research on industry best practices. The outputs include presentations, reports, models, simulations, governance tools, working groups, workshops, and management summits, as well as necessary supporting documents.
The duration of this bridge action will cover approximately six-months beginning 28 Sep 2018 and continuing through 31 march 2019. This bridge will be funded with FY18 OM&N funding which is considered appropriate for this action.
4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority authorizing other than full and open competition is 10 U.S.C. 2304(c)(2), Unusual and compelling urgency as implemented by far 6.302-2.
5. Rationale Justifying Use of Cited Statutory Authority.
Coordinating digital transformation activities is complex: there are 230 IT systems and 1,600 IT applications across 10 major commands (NAVSEA, NAVAIR, SPAWAR, NAVSUP, NAVFAC, SSP, CNIC, USFF, CPF, MSC) and 8 resource sponsors (OPNAV N41, N42, N45, N46, N96, N97, N98, N9I).
The nature of this requirement is very time-sensitive, as the investments made in POM-19 will begin execution and lock in functional and technical capabilities early on, via a rapid prototyping/acquisition paradigm. These include several ACAT I/II-scale formal acquisitions operating independently except for the coordination functions of OPNAV N414, which require additional contractor support. A six-to-twelve-month disruption would put both the FY19 spend and the FYDP investment at significant risk, financially and would negatively impact system implementation in the Fleet. This is unacceptable.
Due to the extensive learning curve associated with this workload, Accenture is the sole source that can provide the required expertise for these highly specialized services without a lapse in contractual coverage; they are the only source with the necessary personnel, expertise, and security clearances in place to be able to provide the services for the interim period. Therefore, pursuant to FAR 6.302-2(a)(2), the need for the services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to negotiate a sole-source bridge with Accenture.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
As noted above, Accenture is the only source capable of providing the required services within the required timeframe. In that Accenture is the only source with the necessary personnel, expertise, and security clearances in place to be able to provide the services for the interim period, no efforts have been made to solicit other offers.
7. Determination of Fair and Reasonable Cost. The Contracting Officer will determine the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition:
The resulting contract will provide interim coverage pending award of a competitive SeaPort-e task order. No barriers to future competition exist
9. Contracting point of Contact. Ms. Helen Tyson, who can be reached at (215) 697-9653, or at helen.tyson@navy.mil.
