PERFORMANCE WORK STATEMENT
National Defense University, Information Resources Management College
Student Support Services
1.0 DESCRIPTION OF SERVICES.
The contractor shall provide a qualified and experienced contractor to perform general admissions, registration and tuition collection support services.
2.0
BACKGROUND.
The Information Resources Management College (iCollege) serves as the Department of Defense (DoD) principal educational resource for Chief Information Officer (CIO) and his senior staffs. As such, the iCollege is responsible for a number of programs associated with Information Assurance and Information Technology. The Registrar Office performs general admissions, registration and tuition collection functions for the College, and the Registrar’s Office staff performs student and administrative services for approximately 300 courses and events annually. The office is an integral part of the organization and is the lead on institutional research and assessment, information systems management and integration, analysis and reporting. Additionally, the iCollege relies heavily on the Registrar’s Office for support to over 50 faculty, 10 staff, and 1800 students. To effectively carry out these responsibilities, contractor support is required.
3.0
OBJECTIVE.
The objective of this procurement is to perform general admissions, registration and tuition collection functions for the College and perform student and administrative services for approximately 300 courses and events annually. The office is the primary source of institutional research, analysis and reporting.
The contractor shall:
3.1.1. Perform Student Information System (SIS) administrator functions: Support the College in development and maintenance of its SIS. Manage routine system maintenance including course setups, data integrity and cleanups. Extract information from SIS for ad hoc or scheduled reports. Make recommendations concerning improvements in processes and customer satisfaction. Participate with representatives of higher authority on planning future operational changes, as well as document new policies and procedures; represent IRMC at university SIS meetings.
3.1.2. Perform program management functions: Contractor will coordinate special groups of student and projects. Provide continuous evaluation of the program and make independent decisions about program administration. Inform leadership of program status and develop reports and briefings on the progress of projects. Provide requisite administrative guidance to IRMC leadership to ensure compliance with policies and procedures.
3.1.3. Conduct institutional research: Compile and disseminate historical data on enrollments, degrees conferred, and retention and graduation rates for College and University use. Conduct ad hoc studies on significant policy issues. Maintain a compendium of statistics on faculty and staff. Manage and report on various scheduled projects. Conduct and analyze surveys. Evaluate selected performance indicators for the College’s Strategic Plan.
3.1.4. Student Customer Service. Provide professional, friendly and timely responses to students on routine system and administrative questions. Communications will be through email, telephone and fax. Perform required personal development with industry/curricular materials to ensure up-to-date curricular and academic process knowledge for student responses.

5.0 GUIDELINES.
Procedures are established and available via Registrar’s Office regulations, policies and procedures. The contractor must interpret and adapt guidelines and work directions for application to specific cases or problems. The contractor must analyze results of applying guidelines and recommend changes.
6.0 SCOPE AND EFFECT.
The purpose of the work is to support the IRMC student services operations, including planning, developing, executing, and assessing operational effectiveness and efficiency. As the IRMC’s primary information source for student information, work is observed at high levels of the Department of Defense, NDU, and federal agencies. These operations have an impact upon the proficiency of senior-level military officers and civilian officials within the DoD.
7.0 PHYSICAL DEMANDS.
Work is primarily sedentary, and does not require unusual physical requirements.
8.0 WORK ENVIRONMENT.
The work performed is in adequately lighted and climate controlled office.

All reports and documentations shall be prepared in Microsoft Word, Excel, and PowerPoint and provided on disk or CD ROM; and electronically via email. Reports and documents formats will be as coordinated with the Contracting Officer Representative.
Acceptance criteria shall include an assessment of whether the deliverable meets all requirements stated.
10.0 GOVERNMENT FURNISHED EQUIPMENT. The government shall provide, the facilities, equipment, materials, and/or services listed below. The Government will furnish the necessary workspace for the contractor staff to provide all support outlined in this SOW to include desk space, telephones, computers and other items necessary to maintain an office environment. All other supplies shall be furnished by the contractor.
All reports and documentations developed and conducted under this contract shall become Government property. The Government shall retain the right to distribute and use the information at will.
11.0 PERIOD OF PERFORMANCE. The Period of Performance will be for a six (6) months Base Period, plus one (1) Year Option Period, subject to the availability of funds.
a. Hours of Work. Contractor staff shall adhere to Government work hours and workdays. The contractor is not required to perform services on these Holidays.

The contractor is responsible for providing services during the office’s core business hours (7:00 am to 4:30 pm) Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this statement of work when the Government facility is not closed for the above reasons.
b. Place of Performance/Travel. The primary place of performance for this effort is at the Fort McNair, Building 62, IRMC spaces. Some travel for this effort is anticipated. No official Government travel is required under this effort.
c. Security Clearances. The security classification of work to be performed under this effort is unclassified and no security clearance is required. The NDU Security Directorate will follow standard guidelines to conduct a National Agency Check with Inquiries (NACI) as an investigation and background check of the contractor employee. The contractor employees will comply with all applicable US Government security directives and regulations during the performance of work. Contractor employees will read and be familiar with the NDU facility security information, and will properly wear the appropriate building pass or badge. Contractor personnel are responsible for safeguarding building passes and other badges, and must immediately report a lost or stolen badge to the COR and/or the NDU Security Office (202) 685-2131.
d. Physical Security. The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
e. Key Control. The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contract Officer Representative and Contracting Officer.
f. Privacy Act. This project may require personnel to have access to Privacy Information. When this occurs, personnel shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency rules and regulations.
g. Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. All contractor personnel will be required to obtain and wear badges in the performance of this service.
h. Quality Control: The contractor shall utilize their own internal Quality Control processes in the performance of this contract. The quality control plan and supporting documentation shall be made available to the Government for review upon request, should there be repeated unsatisfactory performance.

52.212-1 INSTRUCTIONS TO QUOTERS--COMMERCIAL ITEMS (FEB 2012)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC

(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,000, and offers of $3,000 or less if the solicitation requires the Contractor to be registered in the Central Contractor Registration (CCR) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The offeror should indicate that it is an offeror for a Government contract when contacting the local Dun and Bradstreet office.
(k) Central Contractor Registration. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the CCR database accessed through https://www.acquisition.gov or by calling 1-888-227-2423 or 269-961-5757.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

Per FAR 52.212-1(f)(2)(i)(A), quotes should be submitted by e-mail to Charles Reilly charles.reilly@navy.mil. All quotes shall be separated into two sections:
Volume I Technical Quote
Volume II Price Quote
The completion and submission of the above items will constitute a proposal and will be considered the quoter’s unconditional assent to the terms and conditions of this solicitation and any attachments and/or exhibits hereto. Alternate quotes will NOT be accepted. An objection to any of the terms and conditions of the solicitation will constitute a deficiency and make the quote unacceptable.
Volume I Technical Quote This volume shall address the corporate experience and past performance factors and include all information required for quote evaluation. This section of the quote shall exclude any reference to the price aspects of the proposal.
Volume II Price Quote This volume shall include the completed solicitation documents and a complete and detailed price breakdown with any and all supporting information. Volume II should include any reps or certs as required by the RFQ.
Volume I, Technical Quote, is limited to a maximum of 7 pages in length inclusive of any charts, diagrams, and/or other graphics as follows:

(Use Corporate Experience/Past Performance Information Form attached to the solicitation) Each “page” is defined as one sheet, 8 ½ “ x 11”, with at least one inch margins on all sides, using a font with a point size of 12 or greater (e.g., "Times New Roman" style with 12 point font). Lines shall, at a minimum, be single-spaced. Pages shall be consecutively numbered. Multiple pages, double pages, two-sided pages, or foldouts will count as an equivalent number of 8 ½" x 11" pages. The cover sheet, table of contents (not to exceed one page per volume), tabs, and dividers will not count toward the page limit. The one exception to the font size requirement shown above is that the "corporate experience and past performance information forms" may be completed with a point size of 10 or greater.
Volume II, “Price Quote,” is not page limited.
NO RESUMES ARE TO BE SUBMITTED WITH THE QUOTE
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and technical factors considered. NOTE: However, the Government may decide not to evaluate the technical proposal of an offeror whose total price is higher than the total price of another proposal rated acceptable or higher and the Contracting Officer determines that any possible technical superiority of the offeror's proposal would not warrant the price premium of the offeror's quote and that, therefore, the offeror's quote could not be the best value. The evaluation of quotes will consider the offeror’s technical quote more important than the offeror’s price quote. The Government will reserve the right to award to other than the lowest priced quoter. The government reserves the right to award on initial quotes.
Prices will be evaluated on the basis of price analysis. Price analysis pertains to the quoter’s ability to submit a firm fixed price quote which is realistic and reasonable for the full contract performance and which indicates that the quoter understands the nature and scope of work to be performed. An unrealistic overall firm fixed price quote, as well as unrealistic individual price that were used to develop the quoter’s overall firm fixed price proposal, as determined by the Contracting Officer, may also be considered in risk assessment and the quoter’s overall quote may be downgraded.
The Contracting Officer reserves the right to determine that your overall firm fixed price quote represents an unacceptable level of risk, based on the information submitted by the quoter, and/or based on the overall quote assessment described above. This includes the right to downgrade your overall quote, due to prices that are considered to be too low to support successful performance and compliance with all contract requirements.
The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Corporate Experience
Past Performance
The technical evaluation factors are listed below in descending order of importance with Corporate Experience and Past Performance being of equal importance.
(i) Corporate Experience
The offeror shall demonstrate relevant corporate experience. Relevant corporate experience is experience (within the past five years) that is of the same or similar scope, magnitude, and complexity to that which is described in the PWS.
To demonstrate its corporate experience, the offeror shall identify up to three (3) of its most relevant contracts or efforts within the past five (5) years, and provide any other information the offeror considers relevant to the requirements of the solicitation. Offerors should provide a detailed explanation demonstrating the relevance of the contracts or efforts to the requirements of the solicitation. If subcontractor experience is provided as part of the THREE most relevant contracts, it will be given weight relative to the percentage of effort being provided by that particular subcontractor in the offer submitted. The references will be evaluated in the aggregate in order to allow offerors who may not have the entire scope, magnitude, and complexity of the requirement under one individual contract to still be considered acceptable if experience with the full scope, magnitude, and complexity of the requirement can be demonstrated within the allotted number of references as described above.
The offeror should complete a “Corporate Experience and Past Performance Information Form” for each reference submitted. The form is an attachment to the solicitation. The forms will count toward the page limit described above. For additional information regarding a particular reference beyond that which will fit on the form, the offeror may continue onto another sheet of paper. Such continuation sheet(s) for submitted references will count toward the page limit. Relevant references submitted under the Corporate Experience factor will also be considered in the evaluation of Past Performance. Only a single set of up to three references shall be submitted.
(ii) Past Performance The offeror shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contacts or efforts (within the past five years) that is of similar scope, magnitude, and complexity to that which is described in the solicitation. The Government will evaluate the relevant references submitted under Corporate Experience factor. Only a single set of up to three references shall be submitted.
The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Quoters lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance. However, the quote of an quoter with no relevant past performance history, while not rated favorably or unfavorably for past performance, may not represent the most advantageous quote to the Government and thus, may be an unsuccessful proposal when compared to the quotes of other quoters. The quoter should provide the information requested above for past performance evaluation, or affirmatively state that it possesses no relevant directly related or similar past performance. If an quoter fails to provide any past performance information which is similar in scope, magnitude and complexity to that which is detailed in the RFQ or fails to affirmatively state that it possesses no relevant directly related or similar past performance, the quote may not be awardable. The Government will consider the quality of the quoter’s past performance. This consideration is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the quoter’s past performance will be used as a means of evaluating the relative capability of the quoter and other competitors to successfully meet the requirements of the RFQ. In determining the rating for the past performance evaluation factor, the Government will give greater consideration to the contracts which the Government feels are most relevant to the RFQ.
If the quoter’s quote is determined unacceptable in any of the technical evaluation factors and/or subfactors, the quote may not be considered for award. The Government reserves the right to award the contract to other than the lowest priced quoter.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the quoter's specified expiration time, the Government may accept an quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (DEC 2012)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via https://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (o) of this provision.
(a) Definitions. As used in this provision --
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Inverted domestic corporation, as used in this section, means a foreign incorporated entity which is treated as an inverted domestic corporation under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). (4) FSG 89, Food and Related Consumables;
(5) FSC 9410, Crude Grades of Plant Materials;
(6) FSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) FSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) FSC 9610, Ores;
(9) FSC 9620, Minerals, Natural and Synthetic; and
(10) FSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
