CLASS JUSTIFICATION AND APPROVAL

IN REPLY REFER TO

CJ&A # DL13412

N00178-16-R-2007

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contractive Activity

The Naval Surface Warfare Center Dahlgren Division (NSWCDD), Contracts Department, Code 024,

2. Description of the Action Being Approved

Award of a Basic Ordering Agreement (BOA) on a sole source basis for 10" Ruggedized Control Touch Panels (Milcots P/N URP10XG-4D- 30B-AFR), repairs, and upgrades to hardware, software, and firmware to Milcots, LLC. Authority to act under this Class J&A (CJ&A) expires 28 February 2021.

3. Description of Supplies/Services

The proposed BOA will provide for the procurement of 10" Ruggedized Control Touch Panels (Milcots P/N.URP10XG-4D-30B-AFR), and repairs and upgrades to the hardware and associated software and firmware infrastructure. The period of performance for the proposed BOA is 5 years.

While it is expected that the majority of this ordering agreement will be utilized for material procurements issued as orders, the BOA will provide a streamlined avenue to procure repairs and upgrades to the control touch panels and associated software and firmware infrastructure to enable them to remain operable and up to-date.

The Government's minimum needs have been verified by the certifying technical and requirements personnel. The estimated value of the BOA is $2,070,000 and will utilize th~ following funds as indicated below:

CJ&A # DL13412

FY17 Ji'Y18 Ji'Y20 FY21 Total 000 $390,000 $390,000 $390,000 $190,000 $1,940,000 000 $ 26,000 $ 26,000 $ 26,000 $ 130,000

Milcots, LLC is the sole manufacturer of the Ruggedized Touch Control Panels and sole provider of associated repairs and upgrades. These systems were privately developed by Milcots and Milcots is the sole provider of the hardware and software components required to outfit and upgrade NSWCDD's existing Gun Weapon System (GWS) infrastructure. Based on market research and validation held late FY14, the Milcots Ruggedized Touch Control Panels are the only ruggedized panels that meet the limited weight and ~ootprint restrictions.

Management Systems (BMS) software engineers and GWS electrical and mechanical engineers are developing a new gun control s stem for a lar e caliber wea on for installation in

The system an operator gunner contra e in close proximity to the gun mount. This design differs from that used in the deployed .small caliber gun system. These rugged panels have a proven and already validated since the are built to survive harsh environments such as seen on llllllllor from the shock blasts of large caliber guns. In addition, the panels are operable by a gloved person, and their displays and function keys are observable in low light

The Government requires that equipment commonality across the· different weapon systems. The deployed small caliber gun system will be back fitted with the Ruggedized Touch Control Panels. The panel supports requirements for reduced e weight and footprint qualities advantageous

Validation trials were held late FY14 and integration events started in May 2015. These panels are being procured for integration events starting in FY17. Previous procurement has occurred for materials and minor nonrecurring engineering to ruggedize and enhance the functionality of the keys via contracts N00178-14-P-4302 and N00178-13-P-4118. The justification for sole sourcing the previous procurements was based on compatibility with the existing BMS infrastructure. The Ruggedized Touch Control Panels must be compatible in all aspects (form, fit, and function, and mechanical footprint} with existing systems presently installed. No other rugged panel has been found that meets the functionality and system interface requirements.

The Government has spent five (5) years and more than $1.5 million on design, development, integration, proof testing and validation efforts. Selection and procurement of another ruggedized touch control panel will in a duplication of the efforts described above and costs in excess of $1.5 million that is not expected to be recovered through use of competitive procurement.

Award of this Basic Ordering Agreement to any vendor other than Milcots would result in the inability to outfit, integrate, use, and maintain the current GWS infrastructure aboard the 1111

It would so require reproofing a new system redesign the ing BMS GWS infrastructure to maintain current capability at NSWCDD and within the fleet.

on the above information, Mi is the only source that has the capability of satisfying the Government's requirement for the procurement of Ruggedized Control Touch Panels, repairs, and hardware, software and firmware upgrades for the BMS platform.

A Sources Sought for the proposed acquisition was posted on the Federal Business Opportunities (FEDBIZOPS) website on 31 August 2015 requesting Capability Statements from interested vendors.

Capability Statements were received from two vendors, NAG Marine and DRS Network & Imaging Systems, before the identified submit by date of 14 September 2015. The two Capability Statements were evaluated by the technical team.

The technical team determined in their evaluation of NAG's and DRS's Capability Statements that neither company has a product that meets the Government's requirements. From a form, fit, and function standpoint, the footprint of the NAG and DSR's product lines did not align with the current BMS configuration and therefore would not be physically compatible with the existing infrastructure. The BMS program would have to undergo a large redevelopment and revalidation effort to retrofit the NAG and DSR's product lines to be compatible with the BMS infrastructure.

The technical evaluation resulted in a technical recommendation that neither company's product lines would meet the Government's minimum requirements.

The proposed acquisition was then synopsized on the Federal Business Opportunities (FEDBIZOPS) website on 9 October 2015. No additional responses were received.

Initial market research was completed and found Milcot's Ruggedized Control Touch Panels were the' only items that met.the government's requirements. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above~ for any .company other than Milcots to provide the required supplies and services.

Individual or classes of orders to be issued under this Basic Ordering Agreement will be published on the Federal Business Opportunities website. Any responses received will.be considered.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by this CJ&A will be fair and reasonable. Similar quantities of this requirement have been purchased from this offerer in the past and cost/pricing information was received on those past procurements.

This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraphs 5 and 6, Dahlgren Contract Division has no plans at this time to compete future contracts for the type of ruggedized control touch panels covered by this document.

The circumstances surrounding the need to obtain the required supplies and services without providing full and open competition will be reviewed annually by the Procuring Contracting Officer .
