JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Surface Warfare Center, Dahlgren Division (NSWCDD);

Dahlgren Contracts Department.

2. Description of the Action Being Approved

4. Statutory Authority Permitting Other Than Full and Open

Competition

This justification is based upon the authority of 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1. Only one responsible source and no other suppliers or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

This proposed acquisition is for X-Com switching, multiplexing, and conversion systems, associated subassemblies, and related services. This is a follow-on to multiple IDIQ contracts including N00178-06-D-2002 with X-

Com, Inc., and a Firm Fixed Price (FFP) contract N00178-13-C-

2001 with X-Com, Inc. Since 1998 the Navy land based sites have invested more than in X-Com components. X-

Com uses proprietary technology for fiber optic conversion and multiplexing of

While other switching vendors exist, none are directly compatible with X-Com LRUs. The X-Com proprietary

Low Level Serial (LLS) switching technology is presently the only LLS technology that has been proven with COTS and tactical LLS interfaces.

There are no long term or large scale production efforts feasible because technology is being phased out of use.

As the Navy brings in new baselines and modernizes old ones, is being eliminated from the configuration. The

Navy is the only user of technology, which leaves limited motivation for outside competition to invest in new production. Because of this, there is no need for long term procurement options, and not enough longevity in the program life to realize cost savings through competition.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPS) website on 15 May 2013 and only X-

Com, Inc. expressed an interest in this requirement. For the reasons discussed in paragraph 5 above, it is not practicable for any company other than X-Com, Inc. to provide the required supplies. In an effort to identify competitive interest, W51, as part of their market research has continuously reviewed potential switching and conversion vendors, had meetings with other vendors, reviewed publication reviews via the internet and attended trade conferences regarding this procurement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

W51 continuously reviews the switching marketplace and switching technology. For future requirements, W51 will reassess the switching market to review the state of non-developmental switching products.

For the reasons set forth in Paragraph 5, NSWCDD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWCDD will assess whether competition for future requirements is feasible. In an effort to identify competitive interest, W51, as part of their market research has continuously reviewed potential switching and conversion vendors, had meetings with other vendors, reviewed publication reviews via the internet and attended trade conferences regarding this procurement. Through these methods, W51 has determined that X-COM, Inc. is the only proven small-scale and short-term cost effective solution to meeting the switching requirements listed herein.
