3. Description of Supplies/Services
This is a modification to the scope of the Contract, which was awarded using other than full and open competition. Indefinite Delivery Indefinite Quantity (IDIQ) Contract N00178-13-D-1011 w9s awarded November 30, 2012 for a total ceiling amount of $5,502,264. As Contract allows for FFP orders for the delivery of gun Actuator Systems in support of the Ba.ttle Mana (BMS) program. The Contract was awarded for a five year period and will end November 29, .2017.

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304 (C) (1). Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying use of Cited Authority
Moog, Inc. is the only responsible source that can satisfy the Government's requirements. The Weapon$ Control Systems Development Branch (G84) of the Engagement Systems Department leverage the effort that was expended in developing the 11111111 actuator set under N00178-13-D-1011 for the development mon controller for seamless integration into other systems.
The Moog Electric electro-mechanical been modified from Commercial f
Actuators are highly specialized of the BMS GWS. The actuators have Off The Shelf(C th the softw o etary Moog Actuators and software code; the controller serves as the interface between the two. The internal control loops were designed to provide the translation of BMS control loops, which drive the actuator's position. This internal control loop is proprietary (although not patented) to Moog. Additionally, since Moog is the Original Equipment Manufacturer of the controllers, there is no other responsible party to make the necessary hardware modifications

$1.92M was consumed in the testing and evaluation phase of the program. This estimated is based al experience with testing and certification of the 11111111· .Using the existing software will allow the Governmen the existing hardware.

Thi e a 100 percent duplication of previous efforts creating additional costs to the Government of $4.32M, if not more, due to inflationary factors and would delay the Government's deliv rds to twelve (12) months based on previous efforts.
6. Description of Efforts Made to Solicit Offers from as Many Offers' as Practicable.
The proposed modification was synopsized via posting on the Federal Business Opportunities website on 16 July 2014 in accordance with FAR 5.2. No other sources have expressed an interest.
Market research was performed by Senior NSWCDD BMS engineers, program management, project leads, and G Department Procurement Leads on any other solution that met the minimum requirements of the Government. No ot~er actuator system was found that met the form/fit/function and mechanical footprint requirements of the current Government design.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8 .. Actions to Remove Barriers to Competition
DL13108.1
The Naval Surface Warfare Center, Dahlgren Division, will eventually develop the software for the controller sets, and has made investments in necessary specialized tooling. This in house capability will alleviate the reliance on the current proprietary software and will allow the government to competitively source the required hardware for the controller sets and actuators.
