52.211-8 - Time of Delivery
As prescribed in 11.404(a)(2), insert the following clause:
(a) The Government requires delivery to be made according to the following schedule:
REQUIRED DELIVERY SCHEDULE
ITEM NO. QUANTITY WITHIN DAYS AFTER DATE
OF CONTRACT
CLIN 0001 87 16 WEEKS (ARO) OR SOONER
TBD 16 WEEKS AFTER FIRST
DELIVERY SCHEDULE (OR
SOONER)
The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.
OFFEROR’S PROPOSED DELIVERY SCHEDULE
ITEM NO. QUANTITY 16 WEEKS OR SOONER
WITHIN DAYS AFTER DATE
OF CONTRACT
CLIN 0001
(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
(End of Clause)
Alternate I (Apr 1984). If the delivery schedule is expressed in terms of specific calendar dates or specific periods and is based on an assumed date of award, the contracting officer may substitute the following paragraph (b) for paragraph (b) of the basic clause. The time may be expressed by substituting "on or before"; "during the months __________"; or "not sooner than __________ or later than ___________" as headings for the third column of paragraph (a) the basic clause.
(b) The delivery dates or specific periods above are based on the assumption that the Government will make award by __ [Contracting Officer insert date]. Each delivery date in the delivery schedule above will be extended by the number of calendar days after the above date that the contract is in fact awarded. Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror results in a binding contract. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails.
Alternate II (Apr 1984). If the delivery schedule is expressed in terms of specific calendar dates or specific periods and is based on an assumed date the contractor will receive notice of award, the contracting officer may substitute the following paragraph
(b) The delivery dates or specific periods above are based on the assumption that the successful offeror will receive notice of award by__ [Contracting Officer insert date]. Each delivery date in the delivery schedule above will be extended by the number of calendar days after the above date that the Contractor receives notice of award;
provided, that the Contractor promptly acknowledges receipt of notice of award.
Alternate III (Apr1984). If the delivery schedule is to be based on the actual date the contractor receives a written notice of award, the contracting officer may delete paragraph (b) of the basic clause. The time may be expressed by substituting "within days after the date of receipt of a written notice of award" as the heading for the third column of paragraph (a) of the basic clause.

SECTION SAP PROV - SAP PROVISIONS
The following have been modified:
52.212-2 ADDENDUM
THE FOLLOWING BEST VALUE DETERMINATION IAW FAR 13.106 LISTED WILL BE USED
TO EVALUATE THE QUOTES USING LOW PRICE TECHNICALLY ACCEPTABLE
EVALUATION CRITERIA:
QUOTERS – PLEASE SEE THE FOLLOWING FOR EVALUATION CRITERIA
The following Best Value Factors listed will be used to evaluate the Quotes using Low Price Technically Acceptable Evaluation Criteria – GO – NO GO Criteria:
DELIVERY
PAST PERFORMANCE
PRICE
Technical Acceptance Factor #1: Delivery
Quoters will need to fill out the clause 52.211-8 for evaluation by the Government. All vendors who can meet the Governments required delivery date for min QTY 87 will be deemed technically acceptable. The time of delivery for the minimum QTY 87 is of greatest importance.
Technical Acceptance Factor #2: Past Performance Past performance will be evaluated by the Supplier Performance Risk System (SPRS).
IAW the provision 252.213-7000, the Government will review the Quoter's "Summary Report" for Product Service Code (PSC) information. The Government will also utilize the "Suppliers Risk Report".
Below is a snapshot of the supplier color legend listed in the report in each report..
Summary Report:
The Government will review the summary report score for the PSC(s) associated with this effort only.
Supplier Risk Report:
The Government will review the supplier risk score as well as the suspected counterfeit area.
Past performance will be based on GO / NO GO basis. An unacceptable (NO GO) equals a yellow or red listing in the SPRS system for the PSC(s) in the summary report as well as the supplier risk score/suspected counterfeit area. A quoter with no past performance (scores in either summary or supplier risk report) will be evaluated as neutral.
Price Evaluation:
The Government has a minimum QTY need of 87 Xilinx chips P/N: XC6SLX9-2FTG256I to be delivered no later than 16 weeks or less ARO. This is the main driver and any additional QTY beyond the minimum QTY of 87 will be a supplement price evaluation to the minimum evaluation. The Government will only evaluate vendors pricing (after those who have been deemed technically acceptable) who can meet the min QTY. The lowest price in this case will be the lowest overall price for a vendor who can provide the minimum QTY of 87 within 16 weeks and the lowest unit price that allows the most additional QTY (beyond the minimum of 87) up to the Simplified Acquisition Threshold of $250,000.00.
Examples below:
Three vendors (A, B and C) that have been deemed technically acceptable (Min delivery QTY of 87 within 16 weeks and is a go in past history.
Vendor A CLIN 0001 Min QTY of 87 x $250.00= $21,750.00 (delivered within 16) weeks CLIN 0002 QTY of 1,083 x $210.00= $227,220.00 Total $248,970.00
Vendor B CLIN 0001 Min QTY of 87 x $240.00= $20,880.00 (delivered within 16) weeks
CLIN 0002 QTY of 1,037 x $220.00= $228,140.00 Total $249,020.00
Vendor C CLIN 0001 Min QTY of 87 x $245.00= $21,315.00 (delivered within 16) weeks CLIN 0002 QTY of 990 x $230.00= $227,700.00 Total $249,015.00
(Note: Numbers are fictitious for example purposes only)
Awardee would be Vendor A. They have most cost in delivering the minimum QTY of 87 deliver the most additional QTY.
