JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warf are Center (NSWC) Crane Division, Global Department Contract Branch, Code 0222.

2. Description of the Action Being Approved

Award of a Firm-Fixed Price (FFP) contract on a brand name only basis for a Model J200 Laser-Induced Breakdown Spectrometer (LIBS) from Applied Spectra, Inc. 46665 Fremont Blvd, Fremont, CA 94538 to support material elemental analysis capabilities within

3. Description of Supplies / Services

The Failure and Materials Analysis Branch (GXMS) requires one

(1) Laser-Induced Breakdown Spectrometer (LIBS), Model ASI J200, manufactured by Applied Spectra, Inc. As delivered, it is a fully operational, user turnkey elemental (chemical) analysis instrument capable of performing component failure analysis for microelectronic components in support of

. The Applied Spectra LIBS will contain the following added features from the baseline model:

• Ablation beam: to be the focused, quadrupled (4 th harmonic) of a Nd:YAG primary beam, wavelength of 266 nanometers

• Automated control of i maging CCD carnera(s) / LED lighting of samples

• Dual range simultaneous (signal intensity) detection capability: (1) lower sensitivity for Broad-band wavelength detection for high concentration range, for wide - range elemental surveys, and (2) higher sensitiv ity detection of

• X-Y stage aut omated movement for X-Y r astering, a nd the generation o f 2-D elemental false-color maps, cove r i ng at least 2" x 2" (SO mm x SO mm) areas

• Capable of utilizing the X-Y stage automated movement for X-Y rastering, in concert with Z-dimension of depth profiling , f or construction of 3-D Elemental Maps

• Software f or analysis o f spectral data recorded in LIBS experiments, analysis o f data for mult i ple shot de pth profiling, 2 - D and 3-D e l emental mapping

The Government's minimum needs have been verified by the certifying technical and r equ irements p e rsonnel.

The estimated dollar value of this action is $266 , 000 as tabulated b e low:

Appropriation FY18 Total

Grand Total $266,000 $266 , 000

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1). Onl y one responsible source and no other will satisfy the agency requirements.

S. Rationale Justifying Use of Cited Statutory Authority

As set forth below, Applied Spectra is the only responsible source capable of prov iding the required supplies.

This procurement will be i ssued as Brand Name only for the Appl ied Spectra Laser - Indu ced Breakdown Spectrometer Model ASI J200 analysis equipment, operating software, installation, training, and standard twelve (12) month warranty. The requirements set forth in Paragraph Three are driven by customer requirements that exceed GXMS's current capabilities. Currently, GXMS performs the material sampling analysis using manual preparation of microelectroni c component samples which is a labor i ntensive process . By upgrading current capabilities to the Applied Spectra LIBS NSWC Crane will automate the preparation and analysis in a self - contained instrument to meet customer requirements.

In conducting market research to satisfy the Government's minimum requirements for the LIBS , NSWC Crane identified three potential sources. In evaluating the various LIBS products commercially available only Applied Spectra's LIBS meet all of the Government's minimum requirements. Applied Spectra's LIBS contains two unique capabilities essential to the Government's material analysis requirements .

First, only the Applied Spectra LIBS is capable of performing 2- D and 3-D elemental mapping that will bring a level of identification of component faults and flaws at the elemental distribution level that is a distinct improvement from the conventional methodology currently being used. The advantage of acquiring a LIBS product utilizing 2-D and 3-D elemental mapping is testing efficiencies resulting in reduced labor operating costs.

The methodology currently in use for analyzing sample elemental distributions is based on multi-layered sectioning and analysis.

The current methodology is an intensively manual process involving epoxy-potting of analysis parts, followed by sectioning, and precision wheel polishing of components and parts, typically in cycles. The cyclically prepared specimens are subjected to various modes of instrumental analysis that identify elemental content. Instrumentation analysis time and part sample preparation requires an average of labor hours. A LIBS with 2-D and 3-D Mapping Analysis capability will require an average of hours for the instrumentation operation and data analysis. Assuming a fully burdened labor rate of Pay Band 3 employee (NSWC Crane) of about per hour, it is projected the Government will have a yearly savings of approximately $70,000 with the utilization of the LIBS.

Analysis Samples/Yr Hours/Sample Labor Rate Total Cost Method

Current $77,730.00

LIBS $ 7,773.00

Yearly Cost Savings: $70,0 00.00

The Applied Spectra LIBS using the 2-D and 3-D elemental mapping provides significantly different and more insightful information than the traditional approach, particularly relative to t he third dimension of mapping. 2-D and 3-D elemental mapping would greatly enhance the Code GXMS's capability to support through increased precision and quality of data. While some other suppliers offer similar features , none off er all of these in one single package necessary t o fulfill

NCH 53.6-2 (MAY 2016) Page 3 of6

J&A Number: CR-180022 the Government's unique requirements in this case. This proprietary equipment may only be purchased from the original equipment manufacturer, Applied Spectra. There are no resellers available; therefore, full and open competition is not feasible.

Second, only the Applied Spectra LIBS is capable of performing dual range detection, in which two ranges of element atomic emission intensity are simultaneously detected in a single instrumentation scan. Dual range detection has the ability to simultaneously obtain coarse-grained and fine-grained detection of elements which are both a survey mode and a highly focused mode operating at the same time. The LIBS analysis process is destructive by its nature. Without the dual mode application sample analysis cannot be conducted in a survey mode and then repeated for the highly focused mode since each sample is unique. The capability to perform dual range detection is important for Failure Analysis because more data is generated from conducting both the coarse-grained and fine-grained detection as opposed to the current method of conducting a single detection.

6. Description of Efforts Made to Solicit Offers from as Many Off erors as Practicable

Through market research conducted by NSWC Crane Flight Division, Applied Spectra, Inc . was identified as the only source that can meet the Government's requirement. In accordance with DFARS 206.302-1, a Request for Information (RFI)/Sources Sought was issued on 20 April 2018 with a closing date of 4 May 2018 to determine the availability of sources to provide a turnkey LIBS at NSWC Crane. The RFI resulted in three companies of interest;

and Applied Spectra, Inc. It was determined by the Subject Matter Expert that Applied Spectra, Inc. was the only vendor that could meet the Government's minimum requirement. The product was capable of meeting the 3-D elemental mapping and dual detection range capability.

doesn't have a turnkey product capable of dual range detection, utilizes the X-Y stage automated movement for X-Y rastering, and include software supporting principal component analysis. Both were informed on 6 June 2018 that their products do not meet the Government's minimum requirements. To date the Government has not received a response from .

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be

NCH 53.6-2 (MAY 2016) Page 4 of6

J&A Number : CR-180022 fair and reasonable in accordance with FAR 15.404-l(b) price analysis.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph Five, NSWC Crane Division has no plans at this time to re-procure this specialized equipment. If additional requirements emerge, NSWC Crane will conduct market research to assess whether competition is feasible.
