The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The estimated requirements and appropriations for fiscal years FY18 are identified below:

The anticipated contract will provide a Firm Fixed Price (FFP) line item for a quantity of FSSS for an estimated cost of

. The anticipated funding will be from Other Procurement, Navy.

The first delivery of a quantity of FSSS will take place after award and subsequent deliveries will be per ending in Fiscal Year 19.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (2). Unusual and Compelling Urgency.

5. Rationale Justifying Use of Cited Statutory Authority

The Government has an immediate requirement for award of a contract and urgent delivery of FSSS to defend deployed forces against the

The need for the FSSS on an unusual and compelling urgency basis is to counter an

As it currently stands, these locations are left unprotected from requirement for deployment of the FSSS cannot wait for a competitively procured contract and the production lead time required for a new contractor to set-up a production line.

NSWC Crane issued a Technical Instruction under N00178-04-D-4119 FC46 to SAIC for the design and fabrication of a prototype of the FSSS. Fabrication of the prototype system has been completed and Operational Test and Evaluation (OT&E) is currently being accomplished at the Army Test and Evaluation Center, Yuma Proving Grounds, Yuma, AZ. The production drawings/models and associated lists are . The physical configuration audit, which will verify and validate the Technical Data Package (TDP), required for a competitive procurement, will not be completed for several more months, due to the on-going OT&E.

At this time the requiring activity has determined that the TDP is complete to a level sufficient to award a contract to SAIC to fulfill the urgent requirement for FSSS.

The milestones required for an award of a competitive contract with complete and validated Drawings/Models and Associated Lists “build to print” package and the milestones using urgent sole source procedures are as follows:

Milestone Chart

Comparison of Full and Open competition

vs. Sole Source

Competitive Sole Source to SAIC

Milestone Date Date SSA approves SSP 7/21/2018 NA RFP issued 7/27/2018 3/7/2018 Offer received 8/10/2018 4/18/2018 SSA selects source Offeror/Govt. begins discussions

11/27/2018 4/25/2018

Contracting Officer Awards Contract 01/15/2019 5/2/2018 Government Approval of First Article Unit 6/30/2019 NA Production Rate of Shipment to Theatre

SAIC has the requisite knowledge, based upon the design and fabrication of the prototype unit, to immediately go into production of the FSSS without the delay that any other contractor would encounter in taking the production drawings/models and associated lists and start the initialization of a production line to meet the unusual and compelling urgent delivery schedule for delivery to forward deployed forces to defend against the . A competitive award process would delay issuing the solicitation by 142 days, and add additional time to the award process, resulting in an award approximately 258 days later than if the award were processed as a sole source urgent procurement. If the competitive process were used, a First Article test would be required which would add another estimated 167 days to the process. As shown by the milestone chart, a sole source urgent buy would result in delivery of the by , sooner than the FSSS units could be delivered using competitive procedures.

Therefore, award to any source other than SAIC, would result in substantial and unacceptable delays to protection of deployed forces from the .

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research conducted indicates that it is not practicable to award a production contract to any other source, for the reasons discussed in paragraph 5 above.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this Justification & Approval will be fair and reasonable. The NSWC Crane contracting office anticipates using cost and price analysis to determine a fair and reasonable price. Assistance from the Defense Contract Audit Agency (DCAA) and the Defense Contract Management Agency (DCMA) will be utilized as appropriate to analyze, evaluate, and negotiate based upon detailed cost and pricing data, as required, which will be certified by SAIC at the conclusion of negotiations.

8. Actions to Remove Barriers to Competition

A Request for Proposal (RFP) for a competitive indefinite delivery/indefinite quantity contract (N00164-18-R-WQ78) is in process for additional quantities of the FSSS.

The requirement that this document seeks approval for is for the minimum quantity needed to fulfill the immediate need that CENTCOM has for the FSSS. All future procurement of the FSSS and any sustainment efforts are anticipated to be awarded on a competitive basis.
