The following have been modified:

52.212-1 ADDENDUM

PROPOSAL REQUIREMENTS

A copy of the offeror's warranty shall be submitted with the initial offer.

WORLD WIDE WEB SOLICITATION INFORMATION

Some solicitations available posted on the WWW site may not include all documents of the solicitation package.

Drawings and Contract Data Requirement Lists (CDRLs) are examples of documents that may not be included due to technical issues. Under those circumstances, a notice will be provided with each solicitation package listing documents not available on WWW. Hard copies of the documents may be obtained by contacting the solicitation Point of Contact (POC) listed in the solicitation document.

Any amendments to the subject solicitation will be posted to the FedBizOpps http://www.fbo.gov . The complete solicitation package, including all amendments, should be received and reviewed prior to submitting a response. It is the responsibility of the offeror to obtain all amendments and/or other applicable documents prior to submission of the offer. Under these circumstances, offerors are reminded to include acknowledgement of acceptance of these amendments in their offer.

ELECTRONIC SUBMISSIONS OF OFFERS, TO INCLUDE NECO, E-MAIL AND FAX, IN RESPONSE

TO THIS SOLICITATION ARE NOT ACCEPTABLE.

(a) General

This provision specifies the organization, format and content of an offeror's technical and price proposals to be submitted in response to this solicitation for evaluation by the Government. The purpose of the instructions contained in this provision is to provide for uniform submission of all offerors' proposals. Uniformity is expected to facilitate Government efficiency and accuracy in the technical and price evaluation and source selection process.

The contents of the offeror's proposal shall be organized to conform to the requirements specified herein.

The proposal material submitted by offerors shall define the offeror's technical approach that would satisfy the requirements of the Performance Specifications, the Statement of Work (SOW), and solicitation requirements.

Offerors' technical and price proposal shall be prepared in accordance with the requirements of this provision.

Clarity and conciseness of the material presented may have a bearing upon proposal evaluation. While only relevant material should be included, the material must be complete. Any offeror's experience, capability, knowledge and understanding not specifically described in the submitted proposal will not be assumed to exist by the Government during evaluation.

The technical proposal and the cost/price proposal shall be submitted separately. The technical proposal shall not contain any cost/pricing information.

Full, accurate and complete information shall be set forth in the submissions to facilitate a thorough and timely evaluation by the Government. This will be an acquisition effort utilizing a best value approach. The Offeror(s) product samples and proposals will be evaluated to ensure that their system complies with the criteria listed in the solicitation.

Offerors are cautioned that the Government reserves the right to make award based on initial offers without discussions with offerors. Therefore, it is imperative that the information provided in the offeror's response to the solicitation be complete and accurate and that the prices proposed be the offeror’s best terms. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, if considered necessary by the contracting officer, discussions may be conducted with those offerors determined to be in the competitive range.

(b) The offeror shall submit the following information:

(1) SOLICITATION PACKAGE: Completed signed solicitation package to include signed Amendments, all representations and certifications executed, and a cover letter. The cover letter shall be signed by an individual authorized to commit the company to the proposal. The cover letter required by this paragraph is in addition to the requirements of FAR 52.212-1, paragraph (b). Two (2) hard copies and one (1) CD- ROM required.

It shall state

Solicitation Number (N00164-17-R-JN52) Commercial and Government Entity (CAGE) number, Duns Number, Taxpayer Identification Number (TIN), Name, address and telephone number of the cognizant DCMA Office (can be found at http://www.dcma.mil/ ) Proposal validity through 30 September 2017.

Names, telephone numbers and email addresses of persons authorized to conduct negotiations, as well as the names of the official authorized to bind the offeror’s organization shall be clearly identified, Any exceptions taken to any requirements of the solicitation, to include but not be limited to technical exceptions, clauses and or provisions. The cover letter shall indicate in which volume and on what page of the offeror’s proposal the exception is addressed.

A copy of the offerors SAM registration information from the SAM website. This does not count towards the page limitation of the cover letter.

(2) Proposals shall not contain classified information.

(3) Mailed or Commercial Delivery of Proposals. Mailed or commercially delivered proposals shall be sent to the following address:

If using an overnight courier, it is the offeror’s responsibility to ensure that the courier service has access to NSWC Crane. Only approved couriers will be given access to the base to make delivery.

(c) Technical Proposal.

Each technical proposal shall enable Government evaluating personnel to make a thorough evaluation and arrive at a sound determination as to whether or not the proposal will meet the requirements of the government as specified in the solicitation. To this end, each technical proposal shall be so specific, detailed and complete as to clearly and fully demonstrate that the prospective contractor has a thorough knowledge and understanding of the requirements.

Statements which paraphrase the specifications or attest that "standard procedures will be employed," are inadequate to demonstrate how the offeror proposes to comply with the requirements of the solicitation, and this clause.

Statements that the offeror "understands" the methods and procedures for performing the described requirements will be considered inadequate as will statements such as "straightforward engineering techniques" and the "highest quality control procedures". The material must be sufficiently detailed to demonstrate an understanding of the technical Factors and Subfactors and the solicitation requirements. See the below paragraph (h) FACTOR I – TECHNICAL for detailed instructions. Two (2) hard copies and one (1) CD-ROM required.

(d) Past Performance Proposal See detailed instructions under element (j) FACTOR II -Past Performance below.

(e) Price Proposal

The offeror shall submit prices for items listed in SECTION “1.0”. The prices shall include all shipping and be proposed F.O.B. Destination. The prices are to be provided in the Pricing Matric by Box, with the quantity breakpoints (if different) completed. Two (2) hard copies and one (1) CD-ROM required. All pricing shall be confined exclusively to the pricing proposal. No pricing information is permitted in the technical proposal.

(f) Exceptions.

Offerors are not encouraged to take exceptions to this solicitation; however, any exceptions taken to the specifications, terms and conditions of this solicitation shall be explained in detail and set forth in the Cover Letter.

Offerors are to detail the particular section, clause paragraph and page to which they are taking exception.

ANY EXCEPTION TO THE GOVERNMENT'S TECHNICAL REQUIREMENTS/SPECIFICATIONS

MUST BE INCLUDED IN THE TECHNICAL PROPOSAL AND THE COVER LETTER.

The following information, as a minimum, shall be included in the Title Page for each Factor:

RFP Number Name of Offeror Date of Submission Factor Title

Requirements for the contents of each of the submitted written proposals are identified below. The order of presentation in the offeror's submitted written proposal shall correspond to the order of the Factors and Subfactors discussed below. The content requirements described below address major topics of concern to the Government.

Failure to respond to any of these topics will be consider a "deficiency". Any additional text provided must be relevant and demonstrate capabilities beneficial to the overall requirements described in this solicitation. Each written proposal must be separate and contain sufficient information to permit a detailed evaluation. Previously submitted data, if any, will not be used in the evaluation of your response to this solicitation.

(g) Product Samples:

Offerors shall provide 1,400 rounds as product samples for the 5.56mm Special Ball Long Range ammunition (AA53) that is being solicited. Please submit product samples to the following address:

N00164

NSWC CRANE DIVISION

BLDG 2390

300 HWY 361

CRANE, IN 47522

MARK FOR: J. SCOTT JOHNSON (CODE JXNN, 812-854-5857)

Product samples will first be evaluated by NSWC Crane against Performance Specification DTL-JXNN-F17-0017, Go/No Go criteria. The DTL-JXNN-F17-0017, Go/No Go criteria is listed under 52.212-2 Evaluation -- Commercial Items. Any product sample, provided as part of the proposal, that fails to meet any of the Go/No- Go requirements, as defined herein, will cause the proposal to be given no further consideration for award.

Proposed product samples passing all Go/ No Go criteria requirements tests will then be subjected to further product sample evaluation in accordance with (IAW) the Factor and Subfactor requirements of this solicitation (see Subfactor A below).

Product sample(s) for the item indicated in this solicitation is required and must be furnished as part of the offer. The sample(s) must be received on or before the time set forth for receipt of offers noted in Block 8 of page 1 of this solicitation.

Proposals are due by the date and time in Block 8 on Page 1 of the solicitation. Please notify the Contract Specialist at emily.a.johnson@navy.mil when a hard copy is being sent and provide a copy of the shipping label.

(h) FACTOR I – TECHNICAL

In addition to the product samples, the offerors shall submit a written proposal in response to the factors and subfactors described in the solicitation in such detail to allow the Government to evaluate the proposal.

Each Factor within the written proposal shall be submitted in separate Sections. The following are the factors and subfactors. (SEE FAR clause 52.212-2 for relative order of importance)

SUBFACTOR A – PRODUCT SAMPLE EVALUATION

Offerors shall ensure that product samples submitted are functional working units and are the exact units being proposed by the offeror to satisfy the requirements in the solicitation. If an offeror submits a defective product sample or the product sample malfunctions during testing it will not be returned to the offeror for rework or replacement. 1,400 identical rounds per each proposal (if submitting multiple proposals) are required.

Resubmission of product sample(s) will not be allowed during the Product Sample Evaluation [and Final Proposal Revision phase]. An unacceptable rating in the Product Sample Evaluation subfactor will render the offeror technically unacceptable and the offer will be ineligible for award.

SUBFACTOR B – WRITTEN TECHNICAL PROPOSAL

Describe system characteristics and performance with respect to the thresholds specified in the Performance Specification. Provide documentation to demonstrate that the system meets or exceeds each requirement specified in the Performance Specification. If your system does not meet the minimum requirements of the Performance Specification, describe the exceptions. If the offeror’s Product Sample does not fully comply with each and every requirement identified in the performance specification, the proposal shall describe in detail how the offeror is going to comply with those requirements that are not satisfied.

Offerors shall complete the Prerequisite Written Technical Proposal Documentation Matrix provided as Attachment (03) to summarize compliance with the technical requirements to the paragraph in the Offeror’s proposal that demonstrates the Offeror’s ability to meet the requirements listed in the Performance Specification.

The matrix shall be cross-referenced to the Performance Specification by paragraph number and title to facilitate

Government verification that all items have been addressed.

SUBFACTOR C – DELIVERY/PRODUCTION SCHEDULE

Offerors shall address compliance and ability to satisfy the delivery schedule requirements as stated in the RFP.

(j) FACTOR II – PAST PERFORMANCE

1.) The offeror shall provide a maximum of five (5) past performance references on prior contracts that are recent and relevant to this requirement. See below for what constitutes a “recent” and “relevant” prior contract for purposes of this solicitation. The offeror shall contact past performance references directly and request that they complete and submit directly to the agency, the Past Performance Questionnaire (PPQ) (Attachment (02) – Past Performance Questionnaire) to the address in Block 9 of SF1449, Page 1 of the Solicitation or to emily.a.johnson@navy.mil in accordance with the timeline set in Block 8 of SF1449, Page 1 of the Solicitation. .

The completed questionnaires shall be sent directly from the reference POC to the contract specialist, Emily Johnson, e-mail: emily.a.johnson@navy.mil. Under no circumstances shall the questionnaires be returned to the offerors. Any information provided by the offeror’s references is subject to verification/validation by the Government during the evaluation process. The Government may make contact and follow up with the listed references identified on the Contractor Past Performance Data matrix.

The Offeror may provide information on problems encountered on the identified contracts as well as the Offeror’s corrective actions.

2.) Offeror shall provide a one (1) page matrix identifying the following information for each of the PPQs sent out:

1) Organization/Customer

2) Brief Description

3) Contract Number

4) Telephone & E-mail of Organization/Customer Point of Contact (POC)

Proposals must prove PPQs have been sent to each POC; failure to send the PPQ to each POC may result in exclusion of the offeror’s proposal from consideration for award. The offeror shall exert its best efforts to ensure that at least two POCs per relevant contract submit a completed PPQ directly to the Government.

3.) Offerors should include a discussion of any significant achievements and explain any rectification of Past Performance problems that are relevant to the proposed efforts.

4.) For the purposes of this solicitation, recent contracts are defined as those on which performance occurred during the last three (3) years. In determining relevancy, the offeror should consider the size, content, and complexity type and value of the contract, and the type of requirement compared to this solicited requirement. The offeror should also consider the level or amount of effort. Only past performance dealing with 5.56mm Special Ball Long Range ammunition (AA53) or a similar caliber (7.62mm) will be considered relevant. The offeror must provide details (if its Past Performance reference is based upon “related technology” as a reference) including how the “related technology” is applicable to the solicited effort. Should the offeror not explain how the related technology is applicable, the reference may not be considered relevant. If an offeror has no current or relevant past performance information for itself, its predecessor companies, its key personnel who will perform this contract, or its major or critical subcontracts, the Offeror should so state that and explain.

5.) Each offeror shall submit present and past performance information for itself on projects of similar size, scope, and technical complexity. The Offerors may choose to submit present and past performance information for subcontractors, team members, or joint venture partners that have experience in projects of similar size, scope, and technical complexity with its proposal. The total number of past performance references for each offeror shall not exceed five (including any references submitted by subcontractors, team members and/or joint ventures). Offerors shall include in their proposal the written consent of their proposed major subcontractors to allow the Government to discuss the subcontractor’s past performance assessment with the offeror during negotiations. This section shall provide a list of current and relevant contracts on which the offeror has performed in the format requested in the Proposal Requirements portion of this document. This information, as well as other information the Government may obtain elsewhere via Government databases (CPARs, PPIRs etc.) and other government agencies (DCMA, DCAA etc.), will be used to evaluate the offeror's past performance. The Government reserves the right to solicit feedback beyond what is identified in the questionnaire. NO CLASSIFIED PAST PERFORMANCE SUPPLEMENTS WILL BE ACCEPTED. Two (2) hard copies and 1 CD-ROM required.

(k) FACTOR III – PRICE

(a) Price Proposal - The offeror shall complete the price matrices. Pricing shall not be submitted in any other area of the proposal.

(b) The offeror shall provide any recommended quantity break changes to improve price to the Government.

(c) CLIN 0002 Data shall not be separately priced within vendor’s proposal.

(l) ALTERNATE PROPOSALS

In addition to submitting completed price matrices for the items that your company is proposing on, a proposal with alternate stair-step quantities may be submitted. If a company elects to submit an alternate proposal, it will be evaluated by the Government if determined to be advantageous to the Government. If the alternate proposal involves a different configuration of the round then an additional 1,400 rounds of the alternate configuration is required to be submitted for the product sample evaluation.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

GO/NO-GO CRITERIA

Offerors shall provide 1,400 rounds of 5.56mm Special Ball, Long Range, MK 262 MOD 1 as product samples for this requirement being solicited. Product samples will be evaluated by NSWC Crane personnel against the performance specification identified in this solicitation. The 1,400 product sample rounds must be of identical configuration. If an offeror submits multiple offers which entail differing configurations, 1,400 rounds are required per proposal/configuration proposed.

Evaluation of the product sample(s) will initially consist of confirming that the product samples meet the Go/No-Go criteria of specification paragraph number 3.3.1 (Projectile Weight), 3.3.2 (Cartridge Case), 3.3.3 (Propellant),

3.3.4.1 (Primer), 3.4.2 (Primer Seating Depth Above Flush), 3.5.1 (Velocity), 3.5.2 (Chamber Pressure), and 3.5.4 (Dispersion). Product Sample(s) failing the Go/No-Go requirements will be rejected and both the product samples and the written technical proposals will not be further evaluated. Product samples that successfully pass this initial evaluation will continue with the full evaluation.

a) All product samples which are not destroyed in testing will not be returned to the contractor.

b) Product samples provided do not count toward deliverable quantities specified in the Schedule of Supplies specified.

c) Product samples provided can be packed in commercial package.

d) Product samples provided can have a commercial headstamp.

e) Product samples provided shall be manufactured using the same materials, equipment, processes and procedures as will be used in regular production.

As part of the technical evaluation, laboratory measurements and field tests may be used to determine product compliance with the performance specification.

PROPOSAL EVALUATION

In addition to the product sample(s), the offerors shall submit a written proposal in response to the factors and subfactors described in the solicitation in such detail to allow the Government to evaluate the proposal. The following factors shall be used to evaluate offers:

FACTOR 1 – TECHNICAL SUBFACTORS

A. Product Sample Evaluation B. Written Technical Proposal C. Delivery/Production Schedule

FACTOR II – PAST PERFORMANCE

FACTOR III - PRICE

Factor I is significantly more important than Factor II, and Factor I is significantly more important than Factor III.

Factor II is significantly more important than Factor III. Factors I and II (factors other than price), when combined, are significantly more important than Factor III (price). The price factor becomes more important as the degree of equality of Factors Other Than Price increases, or when the price is so significantly high as to diminish the value of the technical superiority to the Government.

Under Factor I (Technical), Subfactor A is more important than Subfactor B. Subfactor A is significantly more important than Subfactor C. Subfactor B is more important than Subfactor C. Factor III, Price, will not be rated, but will be considered in determining the “best value” to the Government.

Price will not be rated, but will be considered in determining the “best value” to the Government. Past Performance information may be evaluated upon receipt prior to the closing date of the solicitation. The best value determination may result in the Government being willing to pay more for higher technical capability.

For evaluation and award purposes, the Government will favorably consider proposed rounds that exceed the dispersion requirements listed in specification DTL-JXNN-F17-0017. This may entail, as part of the best value award decision, a price premium for the superior dispersion.

STANDARDS FOR EVALUATION:

FACTOR I: TECHNICAL RATINGS

The technical rating reflects the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weakness(es), and/or deficiencies.

Technical Risk will be considered during the evaluation. Technical Risk is manifested by the identification of weakness(es), considers potential for disruption of schedule, degradation of performance, the need for increased Government oversight, or the likelihood of unsuccessful contract performance. If negotiations are required, offerors will NOT be permitted to resubmit product samples. Product samples will not be reevaluated. The same source selection strategy will be utilized following receipt of Final Proposal Revisions.

If no product samples meet the requirements of the specifications after all evaluation is complete, offerors may be permitted to resubmit product samples and/or written technical proposals for reevaluation. As a result, the Product Sample subfactor and/or Written Technical Proposal subfactor rating(s) may change. The same source selection strategy will be utilized following receipt of the final revisions.

Adjectival Ratings for Factor I and Associated Subfactors A-C

Table 1: Combined Technical/Risk Ratings

Rating Description

Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.

FACTOR II: PAST PERFORMANCE RATINGS

The Government will assess each offeror’s and proposed significant subcontractor’s past performance. The assessment will be an unbiased judgment about the quality of an offeror’s past performance. The Government will use its subjective assessment to make a comparative assessment of an offeror’s capability. Past Performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with the Specification, Drawings, Statement of Work, contract schedule and contract terms and conditions. Past performance is also a measure of the risk of performance associated with the offeror.

This factor focuses on relevance of past performance to this requirements and the quality of relevant past performance. Past performance relative to this requirement will be assessed by considering aspects such as the following; however, these do not constitute separately evaluated subfactors:

a) Quality of product or service

b) Timeliness of performance

c) Business Relations

d) Overall Customer Satisfaction

The Government may base its judgment about the quality of an offeror’s past performance on:

a) Records of objective measurements and subjective ratings of specified performance attributes, if available, and

b) Statements of opinion about the quality of specific aspects of an offeror’s performance, or about the quality of an offeror’s overall performance.

In addition to the sources identified by the offeror, the Government may review Contractor Performance Assessment Reporting System (CPARS) and/or DoD Past Performance Information Retrieval System ratings and other existing past performance ratings on relevant contracts. The Government may also review other relevant past performance information contained in local files and other sources, including Federal, State, and local Government agencies, Better Business Bureaus, an offeror’s customers and business associates, published media and electronic databases.

General trends in a contractor’s past performance will also be considered.

The Government reserves the right to limit the number of references it decides to contact and to contact references other than those provided by the offeror. The evaluation will take in account the same type of information regarding significant subcontractors proposed in the offeror’s proposal.

The Contracting Officer is not responsible for locating or securing any information not furnished with the offer. The SSA/Contracting Officer may, however, utilize all available information, including information not provided by the offeror, in the past performance evaluation. The Government reserves the right to review less than all information submitted, and to only analyze sufficient information to make a reasonable determination of each offeror’s past performance rating. If insufficient information regarding the offeror’s corporate history is available, the offeror is encouraged to submit for evaluation, evidence of relevant past performance on the part of the offeror’s key/principal employees, as either a prime or subcontractor.

There are two aspects to the past performance evaluation. The first is to evaluate the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection utilizing the relevancy ratings in Table 3 below.

Table 3: Past Performance Relevancy Ratings

Rating Definition

Relevant Present/past performance effort involved essentially the same or similar scope and

Magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of

Effort and complexities this solicitation requires.

The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts utilizing the confidence ratings in Table 4 below.

Table 4: Past Performance Confidence Assessments

Rating Definition Substantial Confidence

Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Offerors that have no record of past performance (i.e. new businesses) must submit a signed and dated statement to that effect. If an offeror submits a certification statement and the Government has no information available regarding the offeror’s past performance, that offeror will receive a Neutral rating for past performance. If offerors (prime and significant subcontractors) provide reference information that is deemed not relevant and current as defined in Section 4.0, the offeror will receive a neutral past performance rating for those contracts.

FACTOR III: PRICE

Pricing will be evaluated based upon both an examination of the unit pricing proposed and the estimated delivery order quantities per year, multiplied by the offered price for that quantity range, all years summed for CLIN 0001, to arrive at an evaluated Total Estimated Price (TEP). Contract Data, CLIN 0002, is “Not Separately Priced”.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
