About this file
This document is a justification and approval for other than full and open competition on a federal contract. The contract is for the procurement of a linear valve from Sargent Aerospace & Defense LLC as the only known manufacturing source. The government does not own the technical data or rights to the part, which is needed to purchase or contract repairs from additional vendors. Market research was conducted including searches of government databases and contractor websites, with no other potential sources identified. The procurement was synopsized on March 22, 2022 with no other offers received. Pricing will be determined through analysis of historical costs adjusted for inflation. The Naval Supply Systems Command intends to continue encouraging new vendors to submit technical data packages for approval but has no immediate plans to compete this requirement due to Sargent's exclusive data rights.

The proposed contract action was synopsized on the government-wide point of entry on 03/22/2022 and as a result
Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows
A technical review, which consisted of searching several government databases including ITIMP, FLIS and ERP, has been completed on this item. Search criteria included Part Number, Design Control Activity, Cage Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved sources of supply, historical sources of supply and past contracts. Based on this market research, technical has determined that the only known manufacturing source is CAGE 78062, Sargent Controls & Aerospace. Additional Market Research conducted by the Contract Specialist included the following methods: UNICOR, AbilityOne, GSA Advantage, SAM search, WEBFLIS, Haystack and review of the procurement history. This item has been procured new five times since 2010 with the most recent in 2021. All procurements and repairs were made through only one source, Sargent Aerospace & Defense LLC. Both WebFlis and Haystack show two supply sources for this NIIN - Sargent Aerospace & Defense (78062) and Honeywell International (59364). Honeywell International is listed because they were the original design agent when the part was provisioned. However, they no longer own the drawings or manufacturer the part. Based on this market research the contracting officer has determined that this item is unique to the Government. There is no commercial item available to satisfy the Government's need. The only known manufacturing source is SARGENT AEROSPACE & DEFENSE LLC (78062).
The estimated price for this requirement falls below the threshold for requiring certified cost or price data. A price analysis will be conducted using historical pricing, the Producer Price Index (PPI) data, and learning curve. The offeror may be requested to submit information other than cost or pricing data for determining price reasonableness. If the proposed pricing exceeds TINA, certified cost or pricing data will be required and obtained. A cost analysis will be performed on the submitted data. Costs to the Government will be fair and reasonable.
To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document.
