MILITARY SEALIFT COMMAND

471 EAST C STREET

NORFOLK VA 23511-2419

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Services and Ship Support (N102).

2. Description of the Action Being Approved: Modification to Contract N32205-17-D-1003 to increase the maximum ceiling for the base year from $254,764.98 to $675,000.00 This modification also includes an increase in the amount allotted for travel from $30,000.00 to $60,000.00. An increase of $735,000 now changes the base period’s grand total to $1,019,764.98. The modification will allow continued performance by the current contractor, The Columbia Group (TCG), on an other than full and open competition basis for MSC Fleet Automation Replacement Long-term Support. Increasing the maximum ceiling will allow the Government to issue new task orders for maintenance and sustainment (not upgrades or enhancements). The current performance period expires on 30 March 2018.

3. Description of the Supplies/Services: Increasing the ceiling will result in TCG’s continued performance on the following applications:

a. Reviews of existing automation, control and monitoring system designs; proposal packages;

performance specifications (PSpec); Government Furnished Information (GFI); and Contract Data Requirements Lists (CDRL) specifications.

b. Reviews of the existing control system architecture, machinery and equipment functions for operational control and monitoring, safety alarm and shutdown, damage control and system health data acquisition including control algorithms and software developed through analysis, land based testing and refined during operational testing. Most of the functionality of the present control systems will be retained, but through a comprehensive analysis and system review, the Contractor shall suggest capability enhancements and future system expansion.

c. Recommendation of the most appropriate, current industry and Government standards and detail the requirements for hardware and software integration and acceptance testing required for automation, control and monitoring systems of this complexity to minimize the risk, improve system reliability, and promote consistency throughout the fleet.

4. Statutory Authority Permitting Other Than Full and Open Competition: This is an other than full and open competition procurement under the statutory authority of 10 U.S.C.2304(c)(1) as prescribed by FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Rationale Justifying Use of Cited Statutory Authority:

a. Award to any source other than TCG would result in unacceptable delays in fulfilling the Agency’s requirements. (See 10 U.S.C. 2304(d)(1)(B)).

b. The contract was competitively awarded. As part of the negotiation process, individual labor category pricing was considered. TCG proposed the lowest priced technically acceptable labor pricing as well as the overall lowest priced technically acceptable offer. It has been less than a year since this contract was awarded and there is no indication that a resolicitation would produce lower pricing at this point.

c. Additionally, TCG is currently performing similar services under multiple task orders, is familiar with the workload, uses economies of scale to keep the pricing reasonable for each task order, and completes each task order within the prescribed period of performance.

d. This ceiling increase is tied to the following tasks that are pending due to ceiling restrictions.

Task Order Amount Task Order # 005 $60,000.00 Task Order # 006 $100,000.00 Task Order # 007 $35,000.00 Task Order # 008 $100,000.00 Task Order # 009 $80,000.00 Task Order # 010 $50,000.00 Task Order # 011 $100,000.00 Task Order # 012 $80, 000.00 Task Order # 013 $70,000.00

Travel $60,000

TOTAL $735,000.00

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: There is insufficient time to solicit offers from other sources for services to begin October 2017. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than TCG to provide the required services without a break in service.

7. Determination of Fair and Reasonable Cost: This ceiling increase will use the Base Period rates already established on the contract and determined fair and reasonable at the time of award. Further, each task order will be evaluated to determine the price is fair and reasonable.

8. Actions to Remove Barriers to Future Competition: The underlying contract for this requirement was issued under full and open competition. Furture solicitations for this requirement will also be issued on the same basis. For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contact increases, if required, for the types of services covered by this document. If other potential sources emerge, MSC will assess whether competition for furture requirements is feasible.
