4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1) implemented at FAR 6.302-1(a)(2)(iii), provides the statutory authority to limit competition to other than full-and-open competition as only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
LCE, specifically its employee Mr. John Mazurana, is the only contractor that can satisfy the necessary requirements. The T-AOEs are a critical asset to the fleet and due to obsolescence
N102-14-D-8003 issues, the MCS upgrade is critical to their continued viability to support the US Navy battle groups. Mr. Mazurana has been a part of the project for the upgrade of the MCS aboard the T-AOE 6 Class ships. He has been working on this project for more than seven years. This significant amount of direct experience related to this project makes him the sole SME who could perform the duties of this requirement. Mr. Mazurana’s thorough knowledge of the MCS contract and it requirements makes him uniquely qualified to continue the ongoing support of this project. The duplication of costs in having another contractor obtain the amount of knowledge and experience the Mr.
Mazurana possesses would be extremely high, if possible at all.
In addition, Mr. Mazurana has been maintaining a share point site which allows access to all the historical project records for both MSC and non-MSC personnel involved in this project. The continued support of these records to allow access for all project team members is critical to the continue progress on this project. Also, this project is on a tight schedule with regards to CDRL review and turnaround, and Mr. Mazurana’s experience and knowledge of the contract make him an invaluable part of the project review team and significantly contributes to its ability to meet the schedule. To compete this contract would adversely affect both the data management and development processes, and would result in unacceptable delays that could be avoided by maintaining continuity of personnel on the project development and review teams.
The extent and nature of the harm the Government would incur if full and open competition was utilized are as follows:
Mr. John Mazurana has over seven years of experience directly related to the MCS on the T-
AOE Class vessels and the project for their replacement. For another contractor to gain the knowledge and experience to match Mr. Mazurana’s expertise, it is estimated that the cost to the
Government would be over $100,000. The estimated labor hours required for another contractor to perform the reviews and engineering anaylsis to begin working on this contract are shown below.
80 labor hours to review the MCS replacement contract and all modifications.
320 labor hours to review all relevant drawings related to the MCS and the T-AOE Class vessels.
80 labor hours to review the MCS Technical Manuals.
160 labor hours to review the MCS design documents.
80 labor hours to gain familiarity with the ship class.
80 labor hours to duplicate the share point site and ensure all records are retained.
As detailed above, a total of 800 labor hours are required for another contractor to gain the level of familiarity and knowledge with the T-AOE Class vessels and the MCS replacement project that Mr. Mazurana possesses due to his past involvement with the project. Using an estimated
SME labor rate of $125.00, which is a reasonable rate based on GSA scheduled contracts for engineering SMEs, the total cost to the Government of using an SME other than Mr. Mazurana is
$104,100.00. The Government has determined that these costs could not be reasonably recouped through the use of competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed contract was synopsized on the FEDBIZOPS website on August 28, 2013. No companies expressed interest in the procurement. No additional market research was conducted because it is not practicable, for the reasons discussed in Paragraph 5 above, for any company other than LCE to provide the required services.
7. Determination of Fair and Reasonable Cost.
Prior to award, the rates offered by LCE will be compared to the company’s current GSA rates and rates paid under previous, similar contracts to ensure the Government is being provided with a fair and reasonable rate. The Contracting Officer has determined the anticipated cost to the
Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contacts for the specific services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
