About this file

This justification and approval document describes a bridge contract awarded for administrative support services. The Department of the Navy, Office of Naval Research required continuity of support services for its Mission Capable, Persistent and Survivable Naval Platforms Department pending completion of a new competitive award. The incumbent contractor, Avian Inc., provided these services since 2015 and was awarded a sole source bridge contract from January to August 2020 for approximately $4 million. The contract supported 12 full-time equivalents across administrative, business, financial and programmatic functions. A notice of intent to award the bridge contract sole source was posted in October 2019 with no other responses received. The justification cited the incumbent's experience and need for continuity until a competitive award could incorporate additional requirements absorbed from a dissolved department.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below:

JUSTIFICATION

1. Identification of Agency and Contracting Activity.

Department of the Navy, Office of Naval Research (ONR).

2. Nature/Description of Action.

The Office of Naval Research (ONR) intends to issue a sole source, bridge contract action to continue support services currently provided by Avian Inc. for administrative, business, financial and programmatic support services for the Mission Capable, Persistent and Survivable Naval Platforms Department (Code 33). This period of performance will be from 5 January 2020 to 27 August 2020 (eight months).

3. Description of Supplies/Services.

The contractor shall provide administrative, business, financial and programmatic support services for Code 33. This includes support for the management and execution of science and technology programs, preparation of documentation required for travel, preparation of funding documents, tracking execution status for specified ONR programs, assisting with human resource functions, providing general program management support and management expertise in the planning, management, and execution of ONR programs. The level of effort for this contract covers approximately

12 full-time-equivalent support personnel. The estimated value of this action including labor and other direct costs is $

4. Identification of Statutory Authority.

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1), Only one responsible source, as implemented by Federal Acquisition

Regulation (FAR) § 6.302-1 -- Only One Responsible Source and No Other Supplies or

Services Will Satisfy Agency Requirements.

5. Demonstration of Contractor’s Unique Qualifications.

The current task order for these support services expires on 4 January 2020. Code 33 requires continuation of these services pending completion of a follow-on award. ONR recently experienced a command reorganization, which centered on the elimination of the

Expeditionary Maneuver Warfare and Combating Terrorism Department (Code 30).

ONR’s Mission Capable, Persistent and Survivable Naval Platforms (Code 33) acquired additional responsibilities from the dissolved Code 30. This caused an increase in the requirements for support services within ONR’s Mission Capable, Persistent and

Survivable Naval Platforms Department (Code 33). Additional time is required in order to incorporate this increase into the support requirements, which cannot be completed prior to the expiration of the current contract on 4 January 2020. It is anticipated to align the period of performance of the follow-on task order re-compete requirement with another Code 33 contract for the same type of support services. Based these circumstances, only the incumbent contractor, Avian Inc., can successfully provide the support services Code 33 requires during the relatively short bridge period. Avian has been successfully performing these services under contract N00178-14-D-7635/EE01 since 5 January 2015, and it is fully capable of continuing performance under the bridge contract to avoid disrupting the operational capability of Code 33 until the Government is able to complete the follow-on source selection. The Government anticipates awarding the follow-on task order on or before 27 August 2020.

6. Description of Efforts to Ensure Other Potential Sources Were Sought.

Pursuant to FAR 6.302-1(d)(2), a Notice of Intent to Award a Sole Source was posted to the Government-wide Point of Entry, www.fbo.gov, on 11 October 2019 and closed on

25 October 2019. No responses were received.

7. Determination of Fair and Reasonable Cost.

The Contract Specialist shall determine the cost to be fair and reasonable prior to award in accordance with FAR 15.404.

8. Description of Market Research.

Market research specific to this eight-month bridge action was not conducted because only the incumbent contractor can successfully provide continuity of services during the bridge period. In addition, a Notice of Intent to Award to a Sole Source was posted to www.fbo.gov for two weeks (11-25 October 2019) and no responses were received from any other interested parties.

9. Any Other Supporting Facts.

If a bridge contract is not established, there will be significant negative impacts to the overall operations of ONR Code 33. Code 33 develops and delivers technologies that enable superior warfighting and energy capabilities for naval forces, platforms and undersea weaponry. Code 33 currently operates with limited Government personnel and this bridge contract will ensure continuity of the administrative, business, financial and programmatic support services that this Code requires.

A competitive procurement for the revised Code 33 requirement, to include http://www.fbo.gov/ responsibilities absorbed from the former Code 30, will be prepared, competed and awarded on or before 27 August 2020 to ensure that the best value is obtained for the

Government.

10. Listing of Interested Sources.

A Notice of Intent to Award a Sole Source was posted to www.fbo.gov from 11 October

2019 through 25 October 2019. No interested sources responded.

11. Actions Taken to Remove Barriers to Competition.

As discussed herein, the Government plans to complete and award a competitive source selection for administrative, business, financial and programmatic support services for

Code 33 on or before 27 August 2020.

12. Statement of Delivery Requirements.

The contractor shall provide monthly status reports, ad hoc reports and presentations, and a final report as described in the performance work statement.

13. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation.

A Management and Oversights Process for the Acquisition of Services-Streamlined

(MOPAS-S) has been approved on 6 November 2019 for this requirement.

14. Explanation of all actions attempted to make the immediate acquisition competitive and the cost /benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.

The proposed bridge contract discussed herein is expected to cover a relatively short period of time in order to successfully compete the redefined new requirement. Given the short duration of the bridge contract, no benefit to the Government would be obtained by attempting to conduct a competition for this bridge effort. The follow-on award will cover a five–year period of support service for Code 33.
