LIMITED SOURCE JUSTIFICATION (FAR PART 8.405-6)

Software for the Acquisition Performance Management System

Amendment to Initial Limited Sources Justification Previously Approved on 06 June 2018

This acquisition is conducted under the authority of Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 501) Multiple Award Schedule Program Federal Acquisition Regulation (FAR) 8.401, and is justified by the following facts and rationale required under FAR 8.405-6 (a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

The initial Limited Sources Justification was predicated on the award of a Blanket Purchase Agreement (BPA). In the interim between the approval of the initial Limited Sources Justification and the award of the BPA, the requirements were changed from the award of a BPA to a single task order. A Limited Sources Justification for that action was approved on 6 June 2018 and was posted at https://beta.sam.gov/opp/9f03886e55e964e36c9ce1aa083cb9e8/view on 16 August 2018.

(1) Agency and Contracting Activity.

The Department of Homeland Security, United States Coast Guard (USCG), Assistant Commandant for Acquisition (CG-9), Office of Contract Operations (CG-912), Formal Contracts Division III (CG-9123) proposes to issue a modification to increase the scope of work on a limited sources basis under Task Order No. 70Z02318FADW07400 under General Services Administration (GSA) Federal Supply Schedule (FSS) Information Technology (IT) Schedule 70 Contract No. 47QTCA18D0081.

(2) Nature and/or description of the action being approved.

In support of CG-9, the USCG issued Task Order No. 70Z02318FADW07400 to Executive Information Systems LLC (EIS) on 16 August 2018, on a limited sources basis in accordance with FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. EIS is the only authorized reseller of the required software licenses for SAS Institute Inc. (SAS) proprietary software.

In support of the USCG Office of Financial Systems Business Requirements (CG-86), CG-9123 proposes to issue a modification to Task Order No. 70Z02318FADW07400 to allow for an increase in the quantity of licenses required in support of CG-86’s effort to create a Financial Management and Procurement Data Repository (FMPDR) solution through the use of the existing Acquisition Performance Management System (APMS). The modification to Task Order No. 70Z02318FADW07400 will restructure the USCG’s licensing posture for SAS software licenses, providing maximum flexibilities in data usage and user allocations in support of the FMPDR while reducing the burden in contract administration, as the USCG’s usage will be able to increase without a need to continuously modify the task order.

The SAS software licenses are currently purchased according to the number of system users and by server size and number of server cores. A core is part of the central processing unit (CPU) of the server; it operates as the brain of the server. Usually servers contain a number of cores, each of which can perform operations separately or work together to perform operations on the same set of data. Currently, APMS licensing is based on the number of system users and cores in each server. Any dramatic increase in data size, such as pulling in all existing Core Accounting System (CAS) and Finance and Procurement Desktop (FPD) data and all future USCG Financial System Modernization Solution (FSMS) data, would necessitate additional server cores. Also, by becoming the FMPDR, APMS will increase its user numbers dramatically. Anyone who accesses CAS and FPD for financial and procurement data will require access to APMS to get that same information in the future.

By restructuring the licenses to a subscription model, the USCG will be able to use the required software and apply it across as many users and cores as necessary based on increased data size.

This will save the USCG money in the future as the service stands up and continue to add data to the Financial Management and Procurement Data Repository.

The estimated total value of firm-fixed price Task Order No. 70Z02318FADW07400, including all options, is increased from $2,940,425.92 by $1,845,626.71 to $4,786,052.63. The total estimated increase is broken down as follows:

Period of Performance FROM BY TO Base Year (8/15/2018 to 8/14/2019)

$1,045,298.76 - Remains Unchanged

Option Year 1 (8/15/2019 to 8/14/2020)

$665,715.10 - Remains Unchanged

Option Year 2 (8/15/2020 to 8/14/2021) $451,187.51

Option Year 3 (8/15/2021 to 8/14/2022) $383,361.85

Option Year 4 (8/15/2022 to 8/14/2023) $394,862.70

Total $2,940,425.92 $1,845,626.71 $4,786,052.63

The proposed contractor remains the same:

Executive Information Systems LLC 6901 Rockledge Dr Ste 600 Bethesda, MD 20817

(3) Description of Supplies/Services.

This modification to the task order will restructure the type and increase the number of software licenses to allow for a higher number of users and data throughout the system. Changing from a per-seat/per-server core model to a subscription format will allow for greater user and data increases as may be needed each year of performance. This will permit continued support for CG-86 and add the FMPDR functionality.

(4) Identification of the justification and the rationale.

The justification and rationale remain the same as the original Limited Sources Justification.

(5) Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d).

The Contracting Officer continues to determine that obtaining SAS software licenses from EIS represents the best value and provides the lowest overall cost alternative to meet the needs of the Government. The modification to this order represents the best value and results in the lowest overall cost alternative, considering price, special features, and other administrative costs discussed herein, to meet the Coast Guard’s needs.

(6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This section has been changed to add that EIS continues to be the sole authorized reseller of SAS software. As no other software can supplant the system currently in operating and maintenance phase, there is no alternative.

(7) Any other facts supporting the justification.

This section remains unchanged from the original Limited Sources Justification.

(8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made.

This section has been changed to supplement the original Limited Sources Justification. The original Limited Sources Justification was posted on 16 August 2018 and the Contracting Officer did not receive any inquiries in response to the posting. In accordance with FAR 8.405-6(a)(2)(i), a notice will be published in accordance with FAR 5.301 and this Amendment to the Original Limited Sources Justification will be posted at the GPE at http://www.Beta.SAM.gov for a minimum of 30 days. Any responses to this Amendment to the Original Limited Sources Justification will be noted and taken into consideration for future procurements.

In accordance with FAR 8.405-6(c)(2)(ix), I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
