About this file
This document is a Sole Source Justification for a maintenance agreement for Illumina MiSeq DNA sequencing instruments. The U.S. Department of Agriculture, Food Safety Inspection Service (FSIS) intends to award a sole source fixed price purchase order to Illumina, Inc. for maintenance of these instruments, which are extensively used by FSIS laboratories. The justification states that Illumina is the only authorized provider of maintenance services for their own equipment, and a change in instrumentation would represent an unacceptable cost and delay. The estimated value of the acquisition is $1,230,217.47, and the proposed contract award date is April 7, 2024. This is a special notice, not a formal solicitation, but interested sources may submit capability statements for the agency's consideration in determining whether a competitive procurement should be conducted in the future.

United States Department of Agriculture Limited Source/Brand Name Justification
FAR 13.106-1(b)(1) – Simplified Acquisitions Control No. (if applicable) ______________________
1. Identification of the agency and the contracting activity.
Contracting Activity:
USDA, FSIS, Office of Administrative Services Procurement Management Branch 5601 Sunnyside Avenue Beltsville, MD 20705
2. Description of supply or service required to meet the agency’s needs.
This service consists of a maintenance agreement for Illumina Miseq DNA sequencing instruments MiSeq, performed by Illumina. Specifically, the laboratories need to acquire the “Silver Support Plan,” which includes the following services:
Full coverage for parts, labor, and travel; Reagent replacement upon HW failures; 1 PM; Remote Technical Support 18x5; 2 business day on-site response target; control SW and HW updates;
on- site applications support; discounts on advanced training; remote monitoring
3. The rationale or circumstances for limiting competition.
Only Illumina is authorized to perform maintenance on its own Illumina Miseq instrumentation, as confirmed by email on May 7, 2024 (included in this file). The laboratory uses Miseq instrumentation extensively in its work, and it is integrated into the labs’ method.
The acquisition of different DNA sequencing instruments would represent an unacceptable cost, as Miseq instrumentation is already owned by the laboratories.
In addition, the acquisition of different DNA sequencing instruments during the labs’ current research would represent an unacceptable delay. This is because a change in instrumentation would necessitate a completely new method, which would require months of testing, revision and creation of the new method, additional training for laboratory personnel, notification of the public, and possibly the acquisition of additional ancillary equipment, since Illumina Miseq instrumentation is already deeply integrated with the laboratories’ other testing equipment and specific reagents.
4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
The laboratories and Illumina were consulted regarding the sole authorization of Illumina to service its Miseq instrumentation. Illumina does not authorize any re-sellers to perform this service. Because the required service is propriety to Illumina, no further market research was conducted.
5. Estimated price, including all options, if applicable.
The estimated value of this acquisition is $1,230,217.47.
6. Recommended source(s).
The recommended source of this service is Illumina, Inc. No other vendors expressed an interest in this service, which is proprietary to Illumina.
