2. Is a tailgate on the rock truck a requirement?

ANSWER: No.

3. On page 11 paragraph 4, there is still a requirement to submit our own literature/brochure, and that the manufacturer brochure/spec sheet would not be acceptable. During one of our calls it sounded like this would be removed, but it is still in place. Will it be removed?

ANSWER: This language corrected to reflect the following language “Firms offering "equal" items shall provide the make, model, description of the items, and provide their own or the manufacturers product literature/brochures”.

4. In addition to the contract you are creating, we have our own rental contract that must be signed by the appropriate party within your organization. Who would that person be?

ANSWER: Upon contract award, the Contracting Officer will review the rental contract to ensure all terms and provisions are acceptable to the Government. If the awardee and the Contracting Officer reach agreement on the terms and provisions of the rental contract, the contracting officer will sign the rental contract.

5. Who will assess the equipment condition and do a pre-rent inspection from your organization? Where will that task be completed at? Where will the pre-rent condition be notated in your contract?

ANSWER: The assessment will be conducted by the Contracting Officers Representative at the vendor’s facility. A Limited Technical Inspection (LTI) Sheet will be completed to annotate the pre-rent condition.

6. Once the pre-rent condition of the equipment has been assessed by both your POC and ours, and the condition has been confirmed, what will be the process of notification to you or your POC for damages that have occurred while on rent? What will our responsibilities be to make sure that damages have been notated? How long will we have to respond to a down machine or damaged machine?

ANSWER: The Contracting Officer Representative will inform the Contracting Officer of the situation. The Contracting Officer will then notify the vendor of the required action(s). All damage will need to be annotated on the leased equipment’s record jacket. The response time shall be within 72 hours.

7. What is the process for collecting payment for damages done to the equipment while on rent? What is the process for modification to the contract to report damage, verify repairs are made, and receive payment?

ANSWER: Damages are being funded by a not-to-exceed (NTE) unscheduled maintenance CLIN. When repairs are required the CLIN will be exercised for the amount determined. Requests for payment are submitted after repairs are completed.

8. Where do we notate on the contract that we authorize the military mechanic on-site to perform standard non-routine maintenance in accordance with our procedures? Where do we notate on the contract that we authorize the military to perform standard equipment oil/filter changes in accordance with our procedures?

ANSWER: The Government will not be performing non-routine maintenance. This is classified as unscheduled maintenance which will be performed by the vendor. However, in accordance with the solicitation, the Government will conduct preventive maintenance.

The standard equipment oil/filter changes is annotated on attachment 1 of the solicitation in column “C” and “D” of the excel sheet titled “Government Maintenance”.
