CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) (TAILORED)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The proposed acquisition is unrestricted. The associated North American Industrial Classification System (NAICS) Code is 561210 Facilities Support Services. The size standard is $38.5 million.

BASIS OF AWARD: The Government will solicit and award this contract using simplified acquisition procedures, in accordance with FAR Subpart 12 and 13.5. It is the Government’s intention to issue a single firm-fixed price with cost Clins purchase order on an “all or none” basis for services.

The Government intends to award to the quoter who represents the Best Value to the Government. The evaluation factors are and will be assessed separately. Technical capability, Past Performance and Price are approximately equal in weight for evaluation purposes.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options(s).

EVALUATION: Vendors responding to this announcement shall submit their quote in accordance with FAR 52.212-1. Please include company’s cage code and tax ID. The Contract Award will be based on a Best Value determination, considering the following evaluation factors listed in no particular order.

Submission of quote shall include the following:

(1) Technical capability defined as a) Mangement Plan:The vendor shall submit a Management Plan that demonstrates sufficient resources are dedicated to the performance of this requirement and is organized to efficiently carry out services. The vendor shall outline how they intend to accomplish the overall requirement and discuss organization, personnel, and methodology to accomplish this effort. The Government will assess the vendor’s Technical quote with respect to its compliance with the solicitation requirements and the risk associated with the vendor’s approach. Quoter shall provide relevant certification and resumes that demonstrate experience and skill levels as set forth in the PWS. Offeror shall include a recruiting plan that demonstrates sound procedures for recruitment, retention, and training of personnel.

(2) Past Performance: The vendor shall provide no more than three (3) past performance references on contracts/task orders. The past performance shall have been within the last three (3) years and be of similar scope, magnitude and complexity to that which is detailed in the RFQ. Vendors who present similar contracts should provide a brief explanation demonstrating the relevance of the contracts/purchase orders to the requirements of the RFQ.

Agency name
Contract number(s)
Dollar value
Brief description of the work completed
Point of contact information (to include email address)

If no past performance is available, the vendor shall affirmatively state that they possess no relevant directly related or similar past performance.

In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available, the quoter will not be evaluated favorably or unfavorably on past performance. Quoters without a record of relevant past performance will receive a “neutral” rating, which will have neither a positive nor negative effect. If there is no record of relevant past performance, quoters must affirmatively state this.

To obtain past performance information, the Government may send out a Past Performance Questionnaire to the quoter's references. Make sure your reference information is up to date. DO NOT GIVE THE NAME OF REFERENCES UNLESS YOU HAVE MADE SURE THAT THE INDIVIDUAL CAN BE REACHED AT THE REFERENCED TELEPHONE NUMBER, E-MAIL ADDRESS, OR POSTAL ADDRESS THAT YOU HAVE PROVIDED. The Past Performance Reference Form is included at Attachment 1.

(3) Price: All quotes submitted shall be the Quoter’s Best Pricing. The Government intends to make a single contract award, on an “all or none” basis, to satisfy this requirement.

Award will be made on the basis of the Best Value to the Government. The Government intends to evaluate quotes and award a contract without discussions with vendors. Vendors should not expect requests for clarification or additional information from the Government. Therefore, the vendor’s initial quote should contain the vendor’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions with vendors if later determined by the Contracting Officer to be necessary and in the best interest to the Government. The Government may reject any or all quotes if such action is in the public interest; and may waive informalities and minor irregularities in quotes received.

SUBMISSION REQUIREMENTS. Quoters shall include:

1) Completed FAR provision 52.212-3 – Check appropriate boxes at 52.213-3(b) (2) and (3) and put company name on document. If no changes are necessary, clearly state so in submission package.

2) Clearly state ability to meet specified delivery time after receipt of contract.

3) Provide the following information: CAGE Code and DUNS Number.

SUBMISSION OF QUOTES. Quotes related to this RFQ shall be received by the Contracting Department by the date and time indicated in block 8 on the front page of the solicitation to be considered for award. The information submitted shall be clear and legible (Note: repetitively copies data loses its clarity and legibility.)

Quotes may be submitted via email to kathy.wilcox@usmc.mil (PREFERRED METHOD); via USPS to Commanding General, Attn: Contracting Department, P.O. Box 8368, Camp Lejeune, NC 28547-8368; or via hand delivery/courier (UPS, FEDEX, Etc.) to Contracting Department, Attn: Kathy Wilcox, Bldg. 1116, Camp Lejeune, NC 28542. (h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that --

(1) The offeror and/or any of its principals ( ___ ) are, ( ___ ) are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency,

(2) ( ___ ) Have, ( ___ ) have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(3) ( ___ ) Are, ( ___ ) are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) ( ___ ) Have, ( ___ ) have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
