DEPARTMENT OF DEFENSE

WASHINGTON HEADQUARTERS SERVICES

1155 DEFENSE PENTAGON

WASHINGTON, DC 20301-1155

ACQUISITION

DIRECTORATE

LIMITED SOURCES JUSTIFICATION

Upon the basis of the following justification, I hereby approve the use of restricting consideration of the proposed contractual action pursuant to the authority of FAR 8.405-6.

JUSTIFICATION

1. AGENCY AND CONTRACTING ACTIVITY: [FAR 8.405-6 (c) (2) (i)]

Agency:

Office of the Secretary of Defense, Acquisition, Technology, & Logistics, Assistant Secretary of Defense, Research and Engineering, Emerging Capabilities, Joint Capabilities Technology Demonstration Office 5611 Columbia Pike, Suite 04d09 Falls Church VA 22041

Contracting Activity:

Department of Defense Washington Headquarters Services, Acquisition Directorate 1155 Defense Pentagon Washington, DC 20301

2. NATURE/DESCRIPTION OF ACTION(S): [FAR 8.405-6 (c) (2) (ii)]

This justification approves an extension to Analytic Services Inc. (ANSER) in accordance with FAR 52.217-8. The extension is for a two-month base period plus two (2) one-month options.

The performance of the current contract HQ0034-11-A-0008-0002 ends on July 31, 2016.

3. DESCRIPTION OF SUPPLIES/SERVICES: [FAR 8.405-6 (c) (2) (iii)]

The contractor will support the Joint Capability Technology Demonstration Office (JCTD) as it performs critical and sensitive analysis, prototyping, and demonstrations of technology services for national security in support of ongoing efforts to shape and counter emerging threats, with special emphasis on innovative and architecture-level concepts, cross-Service and cross- Defense/Intelligence concepts, and research and development projects to demonstrate new technologies. The goal and focus of JCTD is on producing risk-reducing prototypes designed to address Combatant Command (COCOM) threats and/or prototypes and demonstrations coordinated through interagency and Service partnerships. The estimated dollar value for this two month extension is approximately $527,000.00. If all options are exercised the total is $1,060,421.68.

4. AUTHORITY AND SUPPORTING RATIONALE: [FAR 8.405-6 (c) (2) (iv)]

Under FAR 8.405-6(a)(1)(i)(B), Analytic Services Inc. is currently the “Only one source capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.” ANSER is familiar with the strategic operations that are conducted on a daily basis, has the required staff with the requisite clearances, and the specific technical expertise necessary. Only continued, uninterrupted support from the incumbent contractor until the end of November can prevent a disruption to the current studies and projects.

The JCTD office is in the process of conducting reviews for developing prototypes designed to address priority Combatant Command (COCOM) threats. In addition, the JCTD office has oversight of more than 50 previously approved prototype developmental efforts and is in the midst of generating the President’s Budget input to support new and ongoing projects.

Specifically, the JCTD office is developing capabilities to counter the current and future threats and supporting the SECDEF’s technical strategies and Chairman’s gap assessment. The JCTD office routinely teams with the Services, Allies and interagency partners to develop and field capabilities of mutual interest. Without this level of expertise and continuity in support, the JCTD office will fail to complete projects and analysis in time to meet the needs of combatant commands and service partners. There is insufficient time to hold a competition for a contract to cover this extension, especially in light of the current competition that is ongoing for the new contract.

The extension time frame is critical to the JCTD effort. The project reviews which are slotted for funding and allocation during this time would experience a loss of continuity and process in operational implementation. The impact would be a halt in developmental efforts and a resulting delay or elimination of needed capabilities to the operational warfighter.

In addition to these statements, this extension is being requested by exercising FAR Clause 52.217-8, which was included within the solicitation and resultant task order at time of award;

however, the pricing of the option was not included in the total evaluated price of the price reasonableness evaluation. Since the FAR clause states “the Government may require continued performance of any services within the limits and at the rates specified in the contract,” new CLINs 5001 and 5002, 6001 and 6002, 7001 and 7002 will be created to reflect the same monthly pricing allowed for in the Option Period Four CLINs 4001 and 4002.

5. REPRESENTATION OF THE BEST VALUE: [FAR 8.405-6 (c) (2) (v)]

The Contracting Officer will ensure that the final price for this modification is fair and reasonable in accordance with the FAR 52.217-8. As indicated above, at the time of original award evaluation, although the amounts for the additional period were not evaluated, the original total evaluated price was considered the best value to the Government. Had the extension prices allowed for under the FAR 52.217-8 clause been included in the original evaluation for each competitor, each competitor’s pricing would have been increased by an additional half-year value of their Option Year Four pricing, causing the best value determination result to be exactly the same.

6. DESCRIPTION OF MARKET RESEARCH: [FAR 8.405-6 (c) (2) (vi)]

Market research reveals that there are vendors that can perform these services, but in order to complete the new competition, an additional four months of service may be required under the current effort to avoid a break in service. Under the strategic sourcing program, the Technical Engineering Analytical Management Support (TEAMS) Blanket Purchase Agreements (BPAs) became available in October 2015 for new task orders. The TEAMS BPAs include 7 teams; each comprised of small and large businesses with a total of 31 contractors. All orders are to be competed on an unrestricted basis. The TEAMS BPA supports Better Buying Power 3.0 by creating a superior competitive and technical structure which is designed to increase the acquisition team’s productivity and a more focused and requirements oriented end product.

According to the market research, the TEAMS BPA is the optimal vehicle for JCTD and needs to sequence appropriately to achieve the best results.

7. ANY SUPPORTING FACTS: [FAR 8.405-6 (c) (2) (vii)]

As previously stated, disruption during the extension timeframe will have a direct negative impact on the JCTD office’s implementation of prototypes and budgetary support. A disruption in services would cause serious injury to the JCTD program with significant negative impact to fielding operational capabilities needed by the Combatant Commanders, the Department of Defense and our interagency partners. Many JCTD prototypes directly support time sensitive requirements requested by the COCOMS due to their in-theater application by the warfighter.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: [FAR 8.405-6 (c)

(2) (viii)]

The competition for the next contract is under way through a Request for Quote issued July 1, 2016 to all of the TEAMS BPAs Contractor Teaming Arrangements. It is estimated that the new contract award will be put in place by September 26, 2016. However, due to the complex nature of this work, if after evaluations it is determined that discussions are necessary, then the new award date may not occur until end of November.

9. TECHNICAL/REQUIREMENTS CERTIFICATION: [FAR 8.405-6 (c) (2) (x)]

I certify that the facts and representation under my cognizance which are included in this justification and which form the basis for this justification are complete and accurate.

10. CONTRACTING OFFICER CERTIFICATION: [FAR 8.405-6 (c) (2) (ix)]

I have reviewed this Limited Sources Justification and find it to be accurate and complete to the best of my knowledge and belief.

Sharon Hilton Contracting Officer

11. COMPETITION ADVOCATE: [FAR 8.405-6(d)(2)] I have reviewed this Limited Sources Justification and find it to be in accordance with FAR

8.405. I hereby approve this acquisition to be conducted on the basis of other than full and open competition.
