CLAUSES INCORPORATED BY FULL TEXT
52.212-1 ADDENDUM “INSTRUCTIONS TO QUOTERS”
1. Multiple Offers
1.1 Quoters shall not submit multiple quotes presenting alternative terms and conditions for satisfying the requirements of this solicitation.
2. Overview
2.1 The Marine Corps Installations – National Capital Region (MCI-NCR) has a requirement for Headquarters Marine Corps (HQMC) Law Enforcement and Corrections Branch (PSL). In accordance with FAR Part 12 and Part 13, the MCI-NCR Regional Contracting Office is issuing a solicitation for the acquisition of Law Enforcement Management Support, as a follow-on effort to the current contract. The projected workload described in the solicitation reflects the historical workload. The requirement for this solicitation remains the same as M00264-16-P-0219. The current contract has a total of one (1) full time equivalent (FTE). The suggested labor category is Logistics Analyst for all tasks; however, quoters may recommend/quote other labor categories. The successful quoter will be required to sign a Non-Disclosure Agreement (NDA) at the time of award. Providing a signed NDA is not an evaluation factor or an element of an evaluation factor; however, it is a compliance requirement.
Required specifications are listed in Schedule of Supplies/Services and a Performance Work Statement (PWS) within this solicitation. The Government intends to make a single firm fixed-price (FFP) award as a result of the solicitation and it is the Government’s intent to award on an “all-or-none” basis to satisfy this requirement. Under no circumstances will the final performance period extend beyond 12 months. The Government intends to evaluate quotes and award a contract without discussions with vendors. Vendors should not expect requests for clarification or additional information from the Government. Award will be based on the initial evaluation of quotes received in response to the solicitation. Therefore, quoters are cautioned that their initial quotes should contain their best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions with vendors if later determined by the Contracting Officer to be necessary.
2.2 The Government will award a single award resulting from this solicitation to the responsible Quoter whose quote, conforming to the solicitation, represents the best value to the Government, price, and other factors considered. The following factors, listed in descending order of importance, shall be used to evaluate quotes:
| - | Factor 1 Technical Capability; |
| - | Factor 2 Past Performance; and, |
| - | Factor 3 Price |
In determining the best value, Factor 1 - Technical Capability is more important than Factor 2 – Past Performance, but all non-price factors (Factors 1 and 2) when combined, are significantly more important than Factor 3 – Price. Although Factor 3 – Price, is the least important factor, it becomes increasingly more important when Quoters receive similar ratings for the non-price factors.
2.3 Each Quoter shall submit a quote that clearly and concisely describes its response to the requirements of the solicitation. Use of general or vague statements such as “standard procedures will be used” will not satisfy this requirement. Unnecessary elaboration or presentations beyond what is sufficient to present a complete and effective solution are not desired and may be construed as a lack of understanding of the requirement.
3. Guidance
Quotes must be prepared in accordance with these instructions. Failure to do so may result in the Quoter’s submission being determined unacceptable and ineligible for award. Each Quoter’s submission shall be screened by the Contracting Officer upon receipt to ensure completeness and compliance with the instructions contained in the Request for Quote (RFQ). Elimination of a Quoter is at the sole discretion of the Contracting Officer.
The purpose of this procurement is to obtain Law Enforcement Management support services as outlined in the Performance Work Statement.
4. Confidential Information
The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of award qualifications and quotes/proposals submitted to federal agencies. If a Quoter’s submissions contain information that he/she believes should be withheld from such requestors under FOIA on the grounds that they contain “trade secrets and commercial or financial information” (5 USC 552(b)(4)), the Quoter should mark its submissions in the following manner:
The following notice should be placed on the title page: “Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act. Material considered privileged or confidential on such grounds is contained on page(s) _______.”
Each individual item considered privileged or confidential under FOIA should be marked with the following notice: “The data or information is considered confidential or privileged, and is not subject to mandatory disclosure under the Freedom of Information Act.”
5. Submission of Questions and Quotes
5.1 Questions
All questions must be received by 10 July 2017 at 1:00 PM EDT. All questions submitted for this solicitation must be electronically sent to the following e-mail addresses: monica.curley@usmc.mil
Note: Due to the firewall at Quantico, please be advised that it is the Quoter’s responsibility to ensure all electronic submittals of questions are received by the Contracting Officer in the timeframe given above.
5.2 Quotes
Quotes must be received by the Contracting Officer no later than 24 July 2017 at 1:00 PM EST. 52.212-2 ADDENDUM “EVALUATION OF QUOTES”
1. General:
1.1 The Government will select the best overall Quoter, based on integrated assessment of the evaluation factors described below. The Government will award a single firm-fixed price award resulting from this solicitation to the responsible Quoter whose quote, conforming to the solicitation, represents the best value to the Government, price, and other factors considered.
The following factors, listed in descending order of importance, shall be used to evaluate quotes:
· Factor 1 Technical Capability;
· Factor 2 Past Performance; and
· Factor 3 Price
1.2 Relative Importance of Factors. The relative importance of each factor, listed in descending order of importance, is as follows: Factor 1 - Technical Capability, Factor 2 – Past Performance, and Factor 3 – Price. In determining the best value, Factor 1 - Technical Capability is more important than Factor 2 – Past Performance. All non-price factors (Factors 1 and 2) when combined, are significantly more important than Factor 3 – Price. Although Factor 3 – Price, is the least important factor, it becomes increasingly more important when Quoters receive similar ratings for the non-price factors. Prospective Quoters are forewarned that a quote meeting solicitation requirements with the lowest evaluated price may not be selected if award to a higher evaluated priced Quoter is determined to be most advantageous to the Government.
1.3 The Government intends to evaluate quotes and award without discussions with Quoters. However, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
2. Technical Volume
2.1 Factor 1 - Technical Capability.
2.1.1 The technical capability will be evaluated for its quality and the extent to which the quoter’s approach on how well the Quoter demonstrates their technical approach is capable of accomplishing of all requirements outlined in the tasks in the PWS. The Government will evaluate the Quoter’s approach to ensure there is a clear understanding of the procedures required to provide the Law Enforcement Management support. The Government will evaluate the quoter’s approach of the relevant technical processes and support outlined in the PWS. Evidence of the quality of the technical capability/approach includes:
· Provide a demonstrated understanding of the performance work statement (PWS) requirements;
· Demonstrate how the quoter proposes to handle the complexities and minimize risks that are inherent in the PWS requirements; and
· Demonstrate that the proposed personnel in direct support of the PWS show experience, expertise, qualifications, and direct correlation to the PWS requirements.
· Data previously submitted, or presumed to be known, i.e. descriptions of previous projects performed for the Government, cannot be considered as a part of the quote unless physically incorporated in the quote. Clarity, completeness, and conciseness are essential.
· Letters of Commitment for all Key Personnel who are not currently employed by the Quoter
2.3 Adjectival Ratings for Factor 1 – Technical Capability
2.3.1 The Technical Evaluation Panel (TEP) will assign Factor 1 an adjectival rating from the Table below that best describes their consensus evaluation of the factor being evaluated, and will identify each quote’s strengths, weaknesses and deficiencies.
Combined Technical/Risk Rating:
Color
Rating
Description
Blue
Outstanding Quote indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple
Good Quote indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green
Acceptable Quote meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow
Marginal Quote has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red
Unacceptable Quote does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Quote is unawardable.
2.3.2 A quote that receives a final “Unacceptable” rating for Factor 1 will result in the entire quote being determined to be “Unacceptable”. An unacceptable quote will not be considered for award.
3 Past Performance Volume
3.1 Factor 2 - Past Performance.
The Government will evaluate the Quoter on performance under existing and prior Government contracts and or task orders for similar products or services. Quoters shall submit no more than six (6) total recent and relevant performance efforts for evaluation. Information on up to three (3) recent contracts performed by a Quoter’s significant teaming partners / subcontractors and significant subcontractors considered most relevant in demonstrating their ability to perform the proposed effort may be submitted. The Government considers a significant subcontractor and / or teaming partner to be a company who provides 20% or more of the support required, and / or a company who provides a critical portion of the effort required and / or influences the results of performance. The maximum number of past performance efforts submitted by the prime Quoter and its teaming partners may not exceed six (6) total. Therefore, if three subcontractor efforts are submitted, the maximum number of efforts submitted by the prime would be three efforts.
A current point of contact for each past performance effort shall be provided by completing the Past Performance Questionnaire (Attachment I). References other than those identified by Quoters may be contacted by the Government, and the information received from those other references may be used in the past performance evaluation. In the case of offerors for which there is no information on past performance or where past contract performance information is not available, the quoter may not be evaluated favorably or unfavorably on the factor of past contract performance. In this case, the quoter’s past performance is unknown and assigned a performance confidence rating of “neutral”.
Past performance information may be obtained from any other sources available to the Government, to include, but not be limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and, the Defense Contract Management Agency (DCMA). The Past Performance Evaluation Team may review this past performance information and determine the quality and usefulness as it applies to the Past Performance Confidence Assessment. More recent and relevant performance may have a greater impact on the Performance Confidence Assessment than a less recent or relevant effort. A strong record of recent and relevant past performance may be considered more advantageous to the Government. If a PPIRS entry exists for the proposed past performance effort, the information and ratings contained in the PPIRS entry will take precedence for the Past Performance Evaluation Team over any other source of past performance information.
3.1.1 Past Performance Recency Assessment: Recent efforts are those which have been performed during any portion of the last three (3) years from date of issuance of this RFQ, including those efforts currently being performed. For those efforts currently being performed, the Quoter must have been performing for at least six (6) months from the date of issuance of this RFQ to qualify as a recent effort. Past performance information that is not considered recent and will not be further evaluated. However, if any part of the performance submitted falls within the recency timeframe, the contract / task order in its entirety may be evaluated. For each instance of a Quoter’s past performance that meets the recency timeframe, Government evaluators will then assess relevancy of that instance of past performance. Quoter’s past performance that does not meet the recency timeframe will not be further evaluated.
3.1.2 Past Performance Relevancy Assessment: If the Government evaluators consider the Quoter’s past performance reference to be recent, then the Government will assess the relevancy of the referenced past performance task order / contract in accordance with the Past Performance relevancy definitions in the table below. The Government shall evaluate relevancy by assessing whether the past performance effort proposed is relevant to the Technical Capability Factor, Management Approach Factor, and the Price Factor contained in the RFQ. Evaluations will not assess an overall relevancy rating at the Factor level. Further, the Government is not bound by the Quoter’s opinion of relevancy. The past performance questionnaires and information obtained from other sources will also be used to establish the degree of relevancy, which will inform quality rating for past performance.
The following table reflects the Past Performance Relevancy Ratings:
Past Performance Relevancy Ratings:
Rating
Definition
Very Relevant
Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant
Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant
Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant
Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
3.1.3 Past Performance Quality Assessment: Aspects of quality include how well a Quoter meets or exceeds contractual requirements, how problems encountered in the course of contract performance were addressed, and the effectiveness of corrective actions taken. The Government evaluators will consider the performance quality of recent, relevant efforts. Past performance efforts that are not deemed both relevant and recent will not be further evaluated for quality. For each recent, relevant past performance citation reviewed, all aspects of performance that relate to this procurement may be considered. The quality assessment may result in positive or adverse findings.
