INSTRUCTIONS TO QUOTERS

The Government anticipates the award of a Firm Fixed Price contract as a result of this solicitation; however, the Government reserves the right to award no contract at all, depending on the quality of quotes submitted.

BASIS OF AWARD: Award will be made on the basis of the lowest price technically acceptable (LPTA) of quotes meeting or exceeding the acceptability standards for non-cost factors.

EVALUATION. Contractors responding to this announcement shall submit their quote in accordance with FAR 52.212-1. Submission of quote shall include the following: (1) Technical Acceptability and (2) Price.

TECHNICAL COMPLIANCE: To ensure technical acceptability:

a. The Contractor must clearly demonstrate the ability to meet the technical requirements. A mere statement that the vendor “will meet the Government’s requirements” is insufficient.

b. Quotes will be evaluated and ranked according to price, from lowest to highest. The Government reserves the right to evaluate only the technical quote of the lowest price offeror. Other technical quotes may not be evaluated unless the Government determines the lowest price offeror to be unacceptable or non-responsive. In the event the Government determines the lowest price offeror to be unacceptable, the technical quote of the next lowest price offeror will be evaluated. This process will continue until a technical quote is determined to be acceptable.

c. The Government intends to evaluate quotes and award a contract without discussions with vendors. Quoters should not expect requests for clarification or additional information from the Government. Therefore, the Offeror’s initial quote should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions with Quoters if later determined by the Contracting Officer to be necessary and in the best interest to the Government. The Government may reject any or all quotes if such action is in the public interest; and may waive informalities and minor irregularities in quotes received.

Quotes shall be submitted no later than the close date and time in block 8 on page 1 of the SF1449 RFQ to be considered for award. All quotes shall be delivered to Ms Elizabeth Rolle via email: elizabeth.rolle@usmc.mil/ or via mail: Marine Corps Installations National Capital Region - Regional Contracting Office (MCINCR-RCO), 2010 Henderson Road, Quantico VA 22134.

Quoters are responsible for ensuring their quotes have been received by the date and time in block 8 on page 1 of the SF1449 RFQ. Quoters should contact the above to ensure the Government has received their quote. Delivery delays that cause a quote to be late are not the responsibility of the Government agency and such late quotes will be rejected.

The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. (i) Any such clause is unenforceable against the Government.

(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an ``I agree'' click box or other comparable mechanism (e.g., ``click-wrap'' or ``browse-wrap'' agreements), execution does not bind the Government or any Government authorized end user to such clause.
