USMC Contract Support User Agreement for the Marine Corps Enterprise Network (MCEN)

APPENDIX A

General:

For the purposes of this document, the word "user" refers to contracted support personnel wishing to connect non-government furnished computing assets to the MCEN/Marine Corps Domain. Signatory of this document agrees to all terms and conditions applied within.

Privacy Expectations:

After a contactor owned device is delivered to the Regional G6 for the contractor user and made compliant, the contractor users do not have a right, nor should they have an expectation, of privacy while accessing the MCEN, to include accessing the Internet and using e-mail and voice communications. To the extent that employees wish that their private activities remain private, they should avoid using the Marine Corps Domain and instead use their private email services. By acceptance of this user agreement, employees imply their consent to the disclosing and/or monitoring of their Marine Corps Domain only, including the contents of any files or information maintained or passed through the Marine Corps Domain. Information, Intellectual Property, documents, and files created on the MCEN are the property of the US Government.

(U) By signing the Marine Corps Contractor User Agreement and Acknowledgement form, I consent to the following:

· (U) I am currently employed as an official contractor with the United States Government (USG);

· (U) I understand that by connecting my contractor-provided device to the Marine Corps Domain I am subject to appropriate use only, along with authorized use cases. Specifically, I understand that only the Marine Corps Domain is approved for use up to USG UNCLASSIFIED//FOUO voice and data (e.g. NIPR e-mail and .mil web browsing). I will not access data outside of the Marine Corps Enterprise Data Domain with the contractor-provided device. Limited personal use is acceptable within reason as well as contractor required actions (e.g. timecards). I will remain complaint with the DoD consent banner and not attempt to circumvent any blocked IPs or Web Addresses;

· (U) Processing classified information at a higher level than designated, UNCLASSIFIED//FOUO, on the unclassified device could lead to a compromise of classified information. Such processing is strictly prohibited, constitutes a security violation, and could lead to administrative action, USG seizure of the device, and/or referral to the appropriate law enforcement authorities;

· (U) Within the MCEN, I am accessing a USG Information System (IS) that is provided for USG authorized personnel use only. The USG routinely intercepts and monitors communications on this IS for purposes including, but not limited to, penetration testing, communications security (COMSEC) monitoring, network operations and defense, personnel misconduct, law enforcement, and counterintelligence investigations;

· (U) Communications using, or data stored on, this USG IS are not private, and are subject to routine monitoring, interception, and search, and may be disclosed or used for any USG-authorized purpose. At any time, the USG may inspect and seize data stored within the Marine Corps Domain, or traversing network traffic to and from the Marine Corps Domain, on my authorized contractor-provided device;

· (U) This USG IS includes security measures (e.g., authentication and access controls) to protect USG interests, and to separate a Personal Domain for my benefit and right to privacy;

· (U) I will not download or transfer sensitive USG data to a personal device or public email account (Gmail, MSN, Yahoo, etc.). Sensitive USG data includes documents or data whose loss, misuse, or unauthorized access can adversely affect the privacy or welfare of an individual (personally identifiable information), the outcome of a charge/complaint/case, or USG financial operations (e.g. For Official Use Only, Sensitive But Unclassified, USMC Contract Support User Agreement for the Marine Corps Enterprise Network (MCEN)

Controlled Unclassified Information, etc.). Sensitive USG data also may include proprietary information or other source selection information, the release or disclosure of which is prohibited;

• (U) I will not share my contractor-provided device with unauthorized individuals or family members, due to the sensitivity of the Marine Corps Domain (potential access to USG e-mail, documents, etc.);

• (U) I will not intentionally bypass any technical controls or policies enforced by the USG within the Marine Corps Domain nor will I intentionally modify hardware components to bypass USG security and management controls;

• (U) I understand any government-provided third party application, to include the actual Marine Corps Domain provisioning, may decrease the performance, memory, or storage of my device;

• (U) I will not connect any non-government furnished external devices, to include: Smartphones, iPods, MP3 players, Hard Drives/Disks, Printers, or any other devices. Exemptions to this rule are: mice, trackballs, keyboards, and monitors. If it can carry data, you cannot connect it unless Government furnished or authorized. If the contractor has questions about what may be permissible, they should request clarification and permission for their local G-6.

• (U) The USMC reserves the right to seize any device if necessary to assess and counteract any adverse effects on the Marine Corps network (e.g., spillages), and for any policy infractions and user agreement violations. Further actions will be taken with the principle contracting office to coordinate eventual return of the device;

• (U) When regaining physical control of the contractor-owned device, I shall inspect the device for signs of tampering. Suspected unauthorized use or tampering must be immediately reported to the proper USG authorities;

• (U) When a device is lost, damaged, or improperly destroyed, the incident shall be reported to the Regional G6 to which the user is assigned immediately.

• (U) Telework will be handled under the terms of the contract and coordinated with the organization you are assigned.

• (U) When the contract is terminated or the contractor-provided device (laptop) is permanently reclaimed, the drive shall be completely wiped/sanitized, and fully removed in IAW MCENMSG-UNIFICATION001-14: INTERIM MCEN HARD DRIVE REFORMATTING GUIDANCE (AMHS DTG 102042Z Jan 14);

• (U) Introducing any device into a secure facility shall be subject to local physical security policies. I am responsible for awareness and compliance with local facility security policy and procedures;

• (U) Connecting any device to additional classified or unclassified USG Info System is strictly prohibited.

(U//FOUO) The USG has the right to restrict or rescind computing privileges, or take other administrative or legal action due to failure to comply with the above referenced Terms & Conditions. Violation of these conditions may be grounds for disciplinary action up to and including removal from billet, among more severe legal consequences.

(U/FOUO) The USMC is not responsible for damaged, lost, or stolen equipment.

(U//FOUO) I acknowledge having completed all of the required user training, which includes instruction on the proper use and protection of the contractor-provided device and the applicable security features. I acknowledge that I have had the opportunity to clarify any aspect of operating or protecting the device and have no additional questions regarding use or protection of the device.
