VHAPM Part 808.405 6 Limiting Sources Page 2 of 3 Original Date: 08/30/2017 Revision 02 Eff Date: 02/21/2020 request includes stocked inventory of reagents, standards controls, supplies, disposables and any other materials required to properly perform tests on the equipment.
Delivery Period: Base Period 02/11/2021 08/10/2021; Option 1 08/11/2021 – 02/10/2022
(4) Identify the Authority and Supporting Rationale
FAR 8.405 6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; Siemens Healthcare Diagnostics, Inc. is already in place at VISN 6 medical facilities and Laboratory & Pathology cannot afford for Immunoassay & Reagent test to cease.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Informal pricing analysis shows market price to range between $ . The CO will obtain pricing from the schedule contractor and will seek additional discounts before placing order.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market Research was conducted and there are no other vendors that can provide the product. We are not conducting additional market research because the procurement is being resolicited as part of corrective action from a post award protest.
(7) Any Other Facts Supporting the Justification: A competitive solicitation was issued on June 22, 2020 and a resulting BPA awarded on November 17, 2020. The award was protested.
Corrective action is being pursued and this order will be executed to avoid a break in service.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
