Limited-Sources Justification
1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
2. The action submitted for approval is the sole source acquisition of technical support and maintenance services for the MiPACS Dental Enterprise Picture Archiving and Communication system (PACS) components of the Digital Dental Radiography Solutions (DDRS) for a one year running approximately from September 13, 2021 through September 12, 2022. This acquisition is conducted under the authority of the Medical Directorate Electronic Catalog (ECAT) Multiple-Award Schedule Program.
The annual support and technical maintenance to be acquired is available under Medicor Imaging’s Equipment ECAT contract, SPE2D1-18-D-0012.
3. This requirement is for Medicor Imaging annual expert technical support and technical maintenance services required by the customer; this includes, but is not limited to, call desk support, access to new version and patches of software that include bug fixes and workflow improvements, and centralized system back-ups for the MiPACS Dental Enterprise PACS components of the Digital Dental Radiography Solutions (DDRS) located throughout the U.S. Air Force, U.S. Air Force Reserves Command and Air National Guard. The estimated dollar value of this acquisition is $320,000.
4. The authority waiving the competition requirements is FAR 8.405-6(a)(1)(i)(B), only one source is capable of providing the services required at the level of quality required because the services are unique or highly specialized. Medicor Imaging’s technical support and technical maintenance services are the only ones that meet the U.S. Air Force, U.S. Air Reserves Command and Air National Guard’s requirements and Medicor Imaging is the only source that can provide the support and maintenance.
Due to the proprietary nature of the manufacturer’s hardware and software, Medicor Imaging is also the only source that can provide updates to the hardware and software. If another manufacturer were to attempt to change the proprietary software, it could prevent the Air Force and Air National Guard from utilizing the hardware systems as they are not privy to the source code.
5. The required technical support and technical maintenance services are available under the Medicor Imaging Equipment ECAT contract and the Contracting Officer have determined the price methodology for the annual technical support and maintenance services to be fair and reasonable based on a comparison to their commercial sales practices when technical support and maintenance services were added to the contract.
In accordance with FAR 8.405-4, since the estimated pricing exceeds the Simplified Acquisition Threshold (SAT), an additional price reduction will be sought. Medicor Imaging will be issued a Request for Quotation (RFQ) prior to the placement of the delivery order in an effort to obtain better pricing. It is anticipated that the pricing of the delivery order to be issued under this contract represents the best value to the
Government consistent with FAR 8.404(d) and will result in the lowest overall cost alternative to best meet the Government’s needs.
6. Market research, including but not limited to internet research, ECAT catalog searches, and RFIs to the vendor seeing if they have licensed these services to other vendors, which was conducted by DLA has confirmed that no other vendors under offer MiPACS technical support and technical maintenance services.
7. There are no other facts supporting the justification.
8. ECAT vendors have the opportunity to add products that fall within the scope of the
ECAT contract at any time, the addition of products by vendors may remove barriers that have restricted consideration when future acquisitions are made. However, currently there are no other known ECAT vendors that would be able to offer a similar or equivalent product.
9. As the Contracting Officer, I hereby certify that the information contained in this
Justification is accurate and complete to the best of my knowledge and belief.
