JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
RADIO FREQUENCY SENSORS
Upon the basis of the following justification, I, as the Contracting Officer hereby approve this sole source justification in accordance with 10 U.S.C. 2304(c)(l).
1. Requiring Agency and Contracting Office:
Requiring Agency:
Pentagon Force Protection Agency (PFPA) Counterintelligence Directorate (CI) 9000 Defense Pentagon Washington, DC 20301
Contracting Activity:
Washington Headquarters Services/Acquisition Directorate (WHS/AD) 1225 South Clark Street Arlington, Virginia 22202
2. Nature/Description of Action(s) being approved:
The purpose of this acquisition is award a Firm-Fixed Priced (FFP) contract to Transformational Security, LLC., for the production of radio frequency (RF) sensor packages and power supplies.
3. Description of Supplies/Services required to meet the agency’s needs (including estimated value):
The Pentagon Force Protection Agency (PFPA), Counterintelligence Directorate (CI).
Technical Security Division (TSD) is required to conduct CI missions using techniques and measures to detect and neutralize a variety of hostile and foreign penetration technologies that are used to obtain unauthorized access to classified and/or sensitive information.
The RF Sensor packages and power supplies requested are integral in supporting Special CI programs within the Counterintelligence Directorate. The RF sensor packages are considered non-commercial as these supplies must be specifically designed to meet the needs of PFPA CI and must be designed to fit the architecture of the Pentagon. Only a few sensors of this type are being used throughout the country and all within the Department of Defense.

The requested RF Sensor packages and power supplies shall consist of the following:
CLIN Product Quantity Estimated Unit Price
Total
0001 Wall Mounted Container and Components:
- Wall Mounted Container
- Fiber Optic Transmitter
- In-line Direct Current Radio
Frequency Interference Filter
- In-line Radio Frequency Amplifiers
127 each $9,955.48 $1,264,345.96
0002 Antenna with Ceiling Mounted Housing 110 each $1,375.00 $151,250.00 0003 50 Ohm Coaxial Cable (the connector must fit the wall mounted container and Ceiling mounted housing)
127 each $175.57 $22,297.39
0004 TS-HPS-24V Hallway Power Supplies 28 each $213.91 $5,989.48 Total $1,443,882.83
The estimated price of this acquisition is $1,443,882.83.
The supplies are expected to be delivered within one year after the date of contract award.
Historical information and correspondence with Transformational Security confirms that a one year lead time is necessary as these items are not commercial. Furthermore, Transformational Security does not have facilities dedicated to producing these items, and the need to acquire special tooling and materials contributes to the one year lead time.
4. Identification of Statutory Authority permitting other than full and open competition:
Pursuant to FAR 6.302-1, only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
5. Demonstration of Contractor’s Unique Qualifications or the nature of the acquisition requires use of an authority cited:
Transformational Security is the only known vendor that can provide the specific radio frequency sensors that meet the minimum requirements of the Government. Although there is nothing proprietary about these sensors, they do not have any current commercial application, and as such, all attempts to elicit interest from other vendors to produce a radio frequency sensor meeting the Government’s minimum requirements have failed.
In 2003 the PFPA/CI/TSD embarked on a threat-based model of electronic countermeasures to ensure sensitive or classified national defense information does not fall into the position of our adversaries to include data that may be used against the United States to bring harm, gain competitive advantage, or loss of life. Transformational Security designed the current threat reduction system being used in the Pentagon to monitor radio frequencies.

Transformational Security continued to expand the systems capabilities under IDIQ contract HQ0034-12-D-0005 which was awarded as a sole source due to the vendor’s unique knowledge of the program and superior designs.
Transformational Security’s radio frequency sensors have already been vetted through PFPA and the Pentagon Building Management Office (PBMO).
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies:
A Request for Information (RFI), along with descriptions and drawings of the components needed, was posted on the Federal Business Opportunities (FBO) on August 18, 2015 in hopes of finding other potential sources that were capable of producing the RF sensor supplies. This RFI was posted for 14 days and when it closed on September 1, 2015, but no responses were received thus supporting the conclusion that Transformational Security is the only vendor capable and willing to provide the necessary radio frequency sensor supplies.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: The contracting officer will ensure that the price is fair and proposal analysis is in accordance with FAR 15.404-1(b)(2)(v), comparison with the Independent Government Cost Estimate (IGCE). The IGCE was developed utilizing historical pricing under HQ0034-12-D-0005, Task Order 0004. Additionally, there is not a deviation in the item being procured. The contracting officer has concluded that a contract with Transformational Security represents the best value, as defined in FAR 2.101, and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. Procuring a new design for these sensors will drive up the cost due to research, development, testing and configuration as the current sensors fit the system already in place.
8. A description of the market research conducted and the results or a statement of the reason market research was not conducted:
Market Research, based on historical information and a Request for Information (RFI) posted on the Federal Business Opportunities website (FBO), verified that Transformational Security is the only Source capable of providing this requirement at present. A review of the mandatory sources concluded that these services could not be acquired through the mandatory Government Sources listed in FAR Part 8.002(a)(1). The use of mandatory sources under FAR Part 8.003 does not apply to this acquisition. The supplies cannot be acquired using the non-mandatory sources listed in FAR Part 8.004.
9. Any other facts supporting the use of other than full and open competition: N/A
10. A list of sources, if any, that expressed, in writing, an interest in the acquisition: No sources, other than Transformational Security, expressed interest in this acquisition.
11. A statement of the actions, if any, the agency intends to take to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services required: The Government intends to issue any subsequent requirement for these sensors on a brand name or equal basis for a minimum of 45 calendar days.
