LIMITED SOURCE JUSTIFICATION

ORDERS OVER THE MICRO-PURCHASE THRESHOLD AND

UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

AUTHORITY: FAR 8.405-6 and 40 U.S.C 501

Purchase Request

This acquisition is conducted under the authority of the Multiple Award Schedule Program.

1. Contracting activity/agency. Department of the Interior, Interior Business Center, Acquisition Services Directorate, Division V, Branch I in support of the Office of Facilities and Administrative Services.

2. Description of supplies or services required to meet agency needs. On July 2nd, 2015, a sole source award was made to Midpoint International Inc. in the amount of $3,917.27 for recycling bins as a recycling pilot program at the Main Interior Building.

This award included specialized design work, two (2) TMF35-1 (one for paper and one for compost) and two (2) TMF35-2 (one with paper and landfill streams, and one with paper towels only and landfill streams). The results of this pilot were very successful with positive feedback on the bins and the resultant graphics making it easy for individuals to select the appropriate bins. Based on the pilot, the Department of Interior requires the procurement of additional single and multi-stream recycling bins to expand their recycling program. Due to accessibility constraints in various rooms, some of the bins are restricted in depth. In order to have a cohesive recycling program, it is DOI’s intent to have standardized recycling bins in all areas of the Main Interior Building for ease of use for the occupants. These bins are available under GSA Schedule 73, Special Identification Number 384 2 Office Recycling Containers and Waste Receptacles. The delivery date is estimated to be mid to late April of 2018 and the estimated price is . The following recycling bins are required:

Kitchenette/Conference/Copy Room Recycling Bins:

205 single stream (Transition TMF 35-1-BB) Size: 26.5” w x 12” d x 38” h Capacity: 36 gallons Top plates/backboards 50 forest green - compost 50 marine blue – recycle 105 warm cedar – mixed paper

106 dual stream (Transition TMF 35-2-BB) Size: 26.5” w x 12” d x 38” h Capacity: 35 gallons

Top plates/backboards 88 Bins Stream with 2/3 forest green – paper towels Stream with 1/3 landfill image 17 Bins Stream with 2/3 marine blue – recycle Stream with 1/3 landfill image 1 Bin Stream with 1/2 marine blue- recycle Stream with 1/2 forest green - compost Color of bin: dove gray

These bins have a slanted top and can be wall-mounted or free standing. The opening are stream-specific and interchangeable. The internal dividers can be adapted to support up to three separate types of waste and recyclables in a single unit.

Handicapped Restroom Recycling Bins:

10 dual stream bins (Slimline IRCT 26-2) Size: 21.75” w x 11” d x 36.50” h Capacity: 26 gallons Stream with 2/3 forest green – paper towels Stream with 1/3 landfill visual Color of bin: dove gray

These bins provide a narrow recycling center that is specifically design for areas that require maximum clearance due to accessibility reasons. They include magnets on the lids and bag clips that allow for easy servicing in a confined space. The back boards allow for high-impact graphics that are easy to read and can be standardized with all other bins.

Deskside Collection Bins:

2400 bins (Desksider DS-14Q) Size: .15.15” w x 11.00” d x 20.00” h Capacity 3.5 gallons Color: warm cedar (matches mixed paper color stream)

The deskside collection bin comes in a multitude of colors with custom imprints available. It can be paired with the side saddle bin to get rid of the garbage can and is designed to fit under desks in small interior spaces.

Side Saddle Bin: 2300 bins (SSSM) Size: 7.5” w x 5” d x 6.5” h Capacity: .75 gallons Color: black

This hanging waste basket is designed to hook onto the existing recycling bin and encourages the users to empty this frequently. It includes enhanced standard imprinting and graphics.

3. Identification of the limited source(s) to be solicited.

Midpoint International Inc.

189 Earl Stewart Drive Unit 1 Aurora, 08, L4G 6-V5 Canada Mr. Tom Lembo 888-646-4246 GSA Contract Number: GS-07F-0093N

4. Reason for authority cited. The contracting officer has determined the circumstances of the contract action deem only one source reasonably available.

FAR 8.405-6(a) (1) (i)B - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

5. Rationale.

Wings one (1) and six (6) have various kitchenettes, restrooms, handicapped restrooms and offices with a reduced footprint that require a compact depth of 12” or less with the ability to have multiple streams included for the various recycling needs.

Only Midpoint International has the ability to supply the CleanRiver Recycling products that will accommodate the needs of the Office of Facilities and Administrative Services for the recycling effort at the Main Interior Building.

CleanRiver was the only product found that allowed multiple streams and has the restricted depth of 12”, standardization of colors, and customization of graphics.

Although larger bins will be bought for other areas of the Main Interior Building, the ability to convert or change the streams of all bins provides flexibility to have the appropriate recycle bin where required when conditions change. The use of standardized colors and graphics has been found to encourage recycling during the pilot phase of this effort. The graphics were designed and completed during the pilot, and award through another product would cause duplicative costs.

6. Market Research.

Market research was performed through GSA Advantage! and the following products (available through multiple contract holders) were found:

Rubbermaid: The tallest recycle bin that has an 11” depth is 30 inches with a capacity of 23 gallons while CleanRiver provides 36.5” height with a 26 gallon capacity. The Rubbermaid product is available with paper and bottle & cans separate streams but does not allow the number of streams to be changed once purchased without purchasing another lid or bin. These bins only come in one color (blue) and no option for customized graphics was found. No type of side saddle bin was found available from Rubbermaid during the market research that met the size requirement.

Recyclingbin.com: A slimline option (30.5” H x 10.5” W x 19.6” D) was found but the depth did not meet DOI’s requirements. There were no options found for multiple streams, rather it appears that a new bin is required for each type of recycling which adds to the footprint of the recycling center. The Wedgecycle option was reviewed for the kitchenettes; however, the depth is 13” (32”H x 39”L x 13”D) and only holds 32 gallons vice 35 gallons. A separate bin for each type of recyclable is also required.

The Deskmate was reviewed for the Deskside bin (7.75” x 11.75” x 15”) and holds

3.4 gallons. Different standard colors are available based on the type of recycling that is needed. Multiple bins can be purchased for separate types of recyclables and the base (station) appears to come in a 2 or 3 bin size and is not interchangeable.

No type of side saddle bin was found available from Recyclingbin.com during market research.

Tough Guy products are available through multiple contract holders under GSA Advantage. Their slim container has a 9.5” depth and is 18.5” in width and 35.5” high. It comes in royal blue and does not allow for more than one stream per container. Other options were found but only provided one stream with no interchangeability. The deskside size found only comes in the color of blue.

Based on the market research performed and depicted above, no other bin manufacturer was found that can meet the needs of the Department of the Interior insofar as the depth restrictions, color standardization and multiple stream options.
