I. AGENCY/CONTRACTING ACTIVITY:
This limited source justification is executed by the Department of Commerce (DOC), National Institute of Standards and Technology (NIST), Acquisition Management Division (AMD) on behalf of the Office of Facilities and Property Management (OFPM), Facilities Maintenance Division-Gaithersburg (FMD-G).
II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

IV. THE AUTHORITY AND SUPPORTING RATIONALE:
Authority:
FAR 8.405-6(a)(l)(i)(A) - an urgent and compelling need exists and following the procedure would result in unacceptable delays.
Rationale:
On March 13, 2020 the Director & Under Secretary of Commerce for Standards and Technology ordered the NIST Gaithersburg campus shutdown in response to the President of the United States issuance of Proclamation 9994 declaring a National Emergency Concerning the Novel Coronavirus Disease (COVID-19) Outbreak. On July 6, 2020 NIST Gaithersburg began Phase 1 of the reopening and reconditioning of the campus. The majority of the FMD-G workforce responsible for maintaining facility systems have been designated as “high-risk” per the Centers for Disease Control and Prevention (CDC) guidelines and are unable to work on-site due to COVID-19 health and safety restrictions. These restrictions are expected to remain in place until the reopening and reconditioning of campus is complete. Due to lack of proper maintenance during the 115-day shutdown, the facility systems responsible for maintaining strict environmental conditions that support mission critical scientific research have deteriorated. The Phase 1 reopening plan requires that maintenance and repairs be performed on these deteriorating systems in order to return the campus to a fully operational status. NIST requires a Contractor to provide emergency maintenance and repairs in support for the Phase 1 reopening of the Gaithersburg campus.
NIST has an immediate need as this requirement directly impacts the operational status of the campus. The Procurement Administrative Lead Time (PALT) established by the DOC for competing a requirement of this size and scope is 165 calendar days. OFPM has determined that following the established procedures would result in an unacceptable delay in the reconditioning of critical facility system of the Gaithersburg campus; therefore, NIST is authorized to restrict consideration in accordance with FAR 8.405-6(a)(l)(i)(A).
Through market research, NIST has determined that M.C. Dean has successfully performed facility maintenance and repairs in the past, are currently performing COVID-19 related facility maintenance for the White House Service Center, are able to provide the required qualified personnel at time of award, and are therefore uniquely qualified to provide the required services.
VIII. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE
RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE:
NIST has an urgent and immediate need for services. The need for these services is directly related to the current COVID-19 health and safety restrictions. If a need for additional services exists beyond the contract period of performance, future requirements shall be competed in accordance with the FAR.
IX. CONTRACTING OFFICER' S CERTIFICATION:
