Notice Type:

Special Notice

Synopsis:

Army Contracting Command APG, Tobyhanna Division intends to award a sole source service for power monitors. This is a

Notice of Intent to issue a negotiated sole source Proposed Contract Action under the FAR Part 12 Acquisition of

Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 334118 with a small business size standard of 1,000 employees.

The Government intends to negotiate a sole source contract with:

Eaton Corporation

8609 Six Forks Road

Raleigh, NC 27615

The Power Xpert Meters, 4000/6000/8000 series is proprietary and exclusive to Eaton. The Power Meter design and functionality meet specific electrical performance and physical size limitation requirements for the Power Distribution Unit

(PDU) assembly, TYAD drawings A337413 and A337414, and cannot be substituted. The performance requirements exceed customer needs and are controlled by the user/customer after installation. Market research was performed during the PDU's design, and it was determined this power meter was the best value to the Government. If the Government is unable to use this equipment, the government would have to incur a minimum of 240 hours of engineering time to redesign the PDUs and re-certify it for use. Currently, 15 configurations of the power distribution units (PDU) assembled incorporate

Eaton's Power Xpert Meter into their design. All previously fielded systems would need to be retro-fitted when the Power

Xpert Meter malfunctions/fails in the field incurring additional labor and travel costs to the Government.

Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 28 November 2022.
