3.0 METHOD OF AWARD AND PROPOSAL EVALUATION PROCESS
3.1 METHOD OF AWARD
Proposals submitted by responsible Offerors and determined to be responsive to the requirements of this RFP will be evaluated in accordance with the evaluation criteria set forth herein.
North Carolina G.S. 143-52 provides a general list of criteria the State shall use to award contracts, as supplemented by the additional criteria herein. The Goods or Services being procured shall dictate the application and order of criteria; however, all award decisions shall be in the State’s best interest. All qualified proposals will be evaluated, and awards will be made to the Vendor(s) meeting the specific RFP Specifications and achieving the highest and best final evaluation, based on the criteria described below.
While the intent of this RFP is to award a Contract(s) to Single Vendor, the State reserves the right to make separate awards to different Vendors for one or more line items, to not award one or more line items or to cancel this RFP in its entirety without awarding a Contract, if it is considered to be most advantageous to the State to do so.
The College reserves the right to waive minor informalities, irregularities, or technicalities in proposals received when doing so does not prejudice other Offerors or compromise the fairness of the procurement process.
3.2 CONFIDENTIALITY AND PROHIBITED COMMUNICATIONS DURING EVALUATION
From the date of issuance of this RFP through the date of contract award or cancellation (the “Restricted Period”), Vendors shall not engage in any communication intended to influence the evaluation or award of this procurement.
Each Vendor, including its employees, agents, subcontractors, suppliers, subsidiaries, and affiliates, shall not communicate with any State employee, official, or representative involved in this procurement, including but not limited to personnel of the using agency, issuing agency, evaluation team members, or any other individual involved in the decision-making process, regarding:
• The content of the Vendor’s proposal
• The content of another Vendor’s proposal
• The qualifications or capabilities of any Vendor
• Any matter that could reasonably be considered to influence the evaluation process or award decision
All communications regarding this RFP shall be directed exclusively through the methods identified in this RFP, and only as permitted by the terms of this RFP.
The following communications are permitted:
• Submission of written questions in accordance with Section 2.6 (prior to the question deadline)
• Communications initiated by the State for purposes of clarification, verification, or evaluation
• Inquiries to the designated procurement contact regarding administrative matters or the status of the procurement (after bid submission), provided such inquiries do not attempt to influence the evaluation or award
Any attempt by a Vendor to influence the evaluation or award through prohibited communications may result in disqualification of the Vendor’s proposal. A Vendor may also be disqualified for the actions of its employees, agents, subcontractors, or suppliers.
3.3 PROPOSAL EVALUATION PROCESS
Only responsive submissions will be evaluated.
The State will conduct a One-Step evaluation of Proposals:
Ver: 11/2025 10
Proposals will be received according to the method stated in the Proposal Submittal Section above.
All proposals must be received by the issuing agency not later than the date and time specified in the RFP SCHEDULE Section above, unless modified by Addendum. Late proposals will not be opened or considered.
At the date and time provided in the RFP SCHEDULE Section above, unless modified by Addendum, the proposal from each responding Vendor will be opened publicly and all offers (except those that have been previously withdrawn, or voided bids) will be tabulated. The tabulation shall be made available for public inspection as required by law.
When negotiations after receipt of proposals are authorized pursuant to G.S. 143-49 and 01 NCAC 05B.0503, only the names of offerors and the Goods and Services offered shall be tabulated at the time of opening, cost and price shall become available for public inspection at the time of the award.
The State may request clarification of a proposal for the sole purpose of understanding the Vendor’s submission or resolving minor informalities or technicalities. Clarifications shall not result in modification of pricing or material terms.
Upon completion of the evaluation process, the State will make award(s) based on the evaluation and post the award(s) to the State’s eVP website under the RFP number for this solicitation.
The State reserves the right to negotiate with one or more vendors, or to reject all original offers and negotiate with one or more sources of supply that may be capable of satisfying the requirement, and in either case to require Vendor to submit a Best and Final Offer (BAFO) based on discussions and negotiations with the State.
3.4 EVALUATION CRITERIA
In addition to the general criteria in G.S. 143-52 which may or may not be relevant to this RFP, all qualified proposals will be evaluated, and award made based on considering the following criteria, to result in an award most advantageous to the State:
Technical: (800 Maximum Points)- Attachment I: Technical Approach Questions
As specified in the Technical Approach Questions Worksheet, the Vendor shall indicate whether it will comply with each individual requirement and shall provide a detailed supporting narrative in the space provided. The supporting narrative shall clearly describe the Vendor’s approach, qualifications, methodologies, and any other information necessary to demonstrate compliance with the applicable requirement. To be deemed responsive, responsible, and eligible for award, the Vendor must satisfy all requirements identified in the Technical Approach Questions Worksheet. Failure to meet any mandatory scored requirement may result in the disqualification of the Vendor’s proposal from further consideration. The Vendor’s narrative responses, together with any required supporting documentation or materials, shall be reviewed and evaluated by the evaluation team for compliance with the requirements of this Request for Proposals (RFP).
After review, the evaluation team will award points in accordance with this RFP.
Price (200 Maximum Points)- Attachment A: Pricing Form

The proposal with the lowest cost will receive a score of 200. All other competing proposals will be assigned a portion of the maximum score using the formula:
EVALUTION METHOD:
200 x the cost of the lowest cost proposal the cost of the cost proposal being evaluated
Ver: 11/2025 11
All qualified proposals will be evaluated, and award made based on considering the following criteria listed in descending order of importance, to result in an award most advantageous to the State:

2. Vendor’s Pricing for non-supplemental items.
3.5 PERFORMANCE OUTSIDE THE UNITED STATES
Vendor shall complete ATTACHMENT F: LOCATION OF WORKERS UTILIZED BY VENDOR. In addition to any other evaluation criteria identified in this RFP, the State may also consider, for purposes of evaluating proposed or actual contract performance outside of the United States, how that performance may affect the following factors to ensure that any award will be in the best interest of the State:
a) Total cost to the State
b) Level of quality provided by the Vendor
c) Process and performance capability across multiple jurisdictions
d) Protection of the State’s information and intellectual property
e) Availability of pertinent skills
f) Ability to understand the State’s business requirements and internal operational culture

h) Relations with citizens and employees
i) Contract enforcement jurisdictional issues
3.6 INTERPRETATION OF TERMS AND PHRASES
This RFP serves two primary purposes: (1) to inform prospective Vendors of the scope, parameters, and functional requirements of the solution sought by the State; and (2) to establish, together with all documents incorporated by reference, the terms and conditions of the Contract that may result from this procurement.
The use of terms such as “shall,” “must,” “required,” and “requirements” is intended to denote mandatory and enforceable contractual obligations. In evaluating proposals and determining whether a proposals should be considered or rejected, the State will assess the extent to which a Vendor has proposed, or failed to propose, a solution that satisfies the State’s stated needs and mandatory requirements.
Except where expressly stated otherwise in this RFP, no single requirement shall be deemed an automatic basis for disqualification. However, the State retains the sole and exclusive discretion to determine whether a Vendor’s failure to comply with any requirement—whether individually or in combination with other deficiencies—warrants rejection of the proposal in its entirety.
4.0 REQUIREMENTS
This Section lists the requirements related to this RFP. By submitting a proposal, the Vendor agrees to meet all stated requirements in this Section as well as any other specifications, requirements, and terms and conditions stated in this RFP. If a Vendor is unclear about a requirement or specification, or believes a change to a requirement would allow for the State to receive a better proposal, the Vendor is urged to submit these items in the form of a question during the question-and-answer period in accordance with the Proposal Questions Section above.
Failure to request clarification during the designated period shall not relieve the Vendor of its obligation to comply with all requirements as written, nor shall it serve as a basis for protest or for claiming ambiguity after proposal submission.
4.1 PRICING
Proposal price shall constitute the total cost to the State for complete performance in accordance with the requirements and specifications herein, including all applicable charges for handling, transportation, administrative and other similar fees. Complete ATTACHMENT A: PRICING FORM and include in Vendor’s proposal. The pricing
Ver: 11/2025 12 provided in ATTACHMENT A, or resulting from any negotiations, is incorporated herein and shall become part of any resulting Contract.

From the date of certification through the term of the Contract, the Vendor shall notify the State in writing within thirty (30) days of any event or condition that materially alters the accuracy of the certification.
The State reserves the right to require additional financial information or periodic recertification of financial stability during the term of the Contract.
4.3 HUB PARTICIPATION
Pursuant to North Carolina General Statute G.S. 143-48, it is State policy to encourage and promote the use of small, minority, physically handicapped, and women contractors in purchasing Goods and Services. As such, this RFP will serve to identify those Vendors that are minority owned or have a strategic plan to support the State’s Historically Underutilized Business program by meeting or exceeding the goal of 10% utilization of diverse firms as 1st or 2nd tier subcontractors. Vendor shall complete ATTACHMENT D: HUB SUPPLEMENTAL VENDOR

The State shall contact these users to determine whether the Services provided are substantially similar in scope to those proposed herein and whether the Vendor’s performance has been satisfactory. The information obtained shall be considered in the evaluation of the Proposal.
4.5 BACKGROUND CHECKS
