About this file
This justification and approval document outlines a sole source procurement for an upgraded control system for a water boom located on a barge owned by the Louisville District of the U.S. Army Corps of Engineers. Schwing America, as the original equipment manufacturer, will design, build, and install a new control system to replace the failed remote portion of the existing system which is no longer supported. Competition was not feasible as Schwing is the only source that can provide the necessary retrofit and life cycle support for this specialized equipment. The anticipated cost to the government is determined to be fair and reasonable based on market research for replacement of the water boom control system.

4. Authority Cited: FAR 13.106-l(b) Only one source reasonably available.
5. Reason for Authority Cited: Schwing 32XL Water Boom was supplied on LD-781 Washdown barge when it was procured by Marine Design Center for the Louisville District in 2001. At the time the water boom was supplied with the remote and local control system. The control system is no longer supported and the remote portion is failed. Government requests the upgraded control system to be designed, built, and installed by Schwing who is the OEM for this water boom. This will help ensure this important piece of equipment is supported by the manufacturer well into the future. It is expected that the components will be of components common to other more modem equipment from Schwing thus ensuring an availability of spare component through this supplier.
6. Efforts to Obtain Competition: Based upon the information presented in Paragraph 5, competition for this action was not feasible. Schwing America is the only reasonably available vendor to retrofit the control system and provide life cycle support for the new system. There are numerous other control system vendors of non-OEM equipment. However, these companies did not offer retrofit of the controls, and have the potential to miss some safety features as outlined in section 2 above. These companies are not an OEM and would not stock the replacement components, or source equivalent replacement components when one becomes obsolete. This after-upgrade support is important to the government as end user of the wash boom. As noted previously, competition was achieved on the previous contract for the barge, with Schwing America selected as providing the best value to the barge builder.
7. Anticipated cost to the Government: I hereby determine that the anticipated cost or price to the Government for the procurement will be fair and reasonable based on market research for replacement of the water boom control system.
8. Market Research: Searched internet for controls retrofit systems specific to concrete and washdown booms. There were vendors of the remote control, that were from overseas, but did not mention retrofitting the controls to the boom. Putzmeister, who is Schwing's main competitor, offerer service for their equipment, but not retrofit of other equipment. This would leave only non-boom control companies to provide the retrofit.
