Video Editing Software Service Contract

I. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION”

NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

The National Archives and Records Administration (NARA) intends to restrict consideration to Chesapeake Systems for their brand name (CHESA) video editing software maintenance and services support.

A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

Chesapeake Systems is the sole provider for the video editing services level agreement (SLA) with integrated design specifically made to work with NARA’s media clip databases, IT security protocols, and servers. The National Archives and Records Administration desires the ability to include, as a solicitation requirement with Chesapeake Systems’ designed professional software maintenance and support services to provide NARA with the security of knowing that any and all services will be supported under the SLA. The software ensures media is maintained for future public use with a backup system that is failsafe to the main server.

The service contract must be awarded to Chesapeake Systems because they are the sole designer and understand how NARA’s systems can work together, communicate and backup data. The service contract will ensure the system will work optimally for as long as the system is in place and extend the life of the system while maintaining and preserving media assets.

II. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

The statutory authority permitting other than full and open competition is the Federal Acquisition Streamlining Act, Public Law 103-355 in conjunction with the Competition in Contracting Act, 41 U.S.C § 3304(a)(1) as implemented by FAR 13.106-1(b)(1)(i), “ …the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).”

III. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED

This acquisition meets the authority of FAR 6.302-1© which states that this authority may be used when “the use of such descriptions in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.”

IV. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES.

This justification will be posted along with a Notice of Intent to Award to Other than Full and Open Competition on SAM.gov Interested parties may identify their interest and capability to respond to the requirement. Respondents must provide to the Contracting Officer, their technical capability, pricing data and other information which shows a bona fide ability to meet this requirement.

V. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

Determination will be based on historical cost data and level of effort under previous contracts for SLA’s supporting the A1 Editing Suites.

VI. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED.

Market research indicated that this proprietary maintenance and support is commercially available through an authorized reseller.

VII ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

IX. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.

Once the equipment reaches the end of their life cycle, NARA will compete among other vendors, the procurement of the equipment and software maintenance and support.

X. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S KNOWLEDGE AND BELIEF.
