Justification for Other Than Full and Open Competition United States Department of Agriculture (USDA)/Farm Service Agency (FSA)
Kansas City Commodity Office (KCCO)/Procurement Division (PD)
AGAR No. 106 issued 11/2/2012 calls for the emergency acquisition flexibilities in FAR 18.201and 18.203 and FAR 26.2 to be applied to purchases associated with Hurricane Sandy Relief efforts.
Per FAR 18.110 offers were solicited from a single source and contracts awarded based on the quotes provided. The justification and approval below comply with requirements of FAR 6.303-2
Description of Action Being Approved
The United States Department of Agriculture (USDA) Food and Nutrition Service had a requirement to procure food assistance items as part of the relief efforts associated with Hurricane Sandy.

- I/T-001— Baby Food - Stage 2: 672 Jars
- I/T-002— Baby Cereal: 40 Boxes
Statutory Authority Permitting Other Than Full and Open Competition:
FAR 6.302-2 Unusual and compelling urgency
Demonstration of Proposed Contractor’s Unique Qualifications:
The contractor was able to deliver all the products identified above within 48 hours of receipt of the order. The contractor had inventory available to meet demand and was geographically advantageous to meet the needs of the agency during the declared disaster.

Prices were compared to online retail published prices for like products and all prices were determined to be fair and reasonable.
