JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
This justification is prepared consistent with FAR 16.505(b)(2)(B) and approved consistent with FAR 16.505(b)(2)(C).
1. Identification of the agency and the contracting activity and specific identification of the document as a “Justification for an Exception to Fair Opportunity.”
Federal Energy Regulatory Commission contracting for Esri Enterprise Advantage Program and Enterprise Consulting Support.
2. Nature and/or description of the action being approved.
Esri will provide the Esri Enterprise Advantage Program (EEAP) and ArcGIS Enterprise Consulting Support.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
Esri Enterprise Advantage Program (EEAP) – Annual subscription designed to provide enterprise-wide visioning and geospatial enablement through technical advisory, an annual planning meeting, a collaboratively developed technical work plan, and access to exclusive quarterly technology webcasts.
The program also provides access to a combination of consulting, premium support, and training services.
ArcGIS Enterprise Consulting Support - consulting services to assist FERC by augmenting the EAP to provide additional focused ArcGIS Enterprise support. Consulting services will include the following:
• Supporting FERC using ArcGIS GeoEvent server and services
• Supporting FERC establishing data control mechanisms according to Esri best practices
• Supporting FERC on production level Extract, Transform, and Load (ETL) mechanisms
• Supporting FERC establishing field and mobile GIS capabilities
• Supporting FERC using Web AppBuilder for ArcGIS
4. Identification of the exception to fair opportunity (see 16.505(b)(2)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).
Esri ArcGIS products are currently used by the Office of Energy Projects (OEP) for tracking dam safety inspections, among other uses. Esri has been involved with FERC with planning future cloud projects and mobile tracking. This is a logical follow-on for the government.
5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Based upon history and economic adjustment fair and reasonable will be determined.
6. Any other facts supporting the justification.
Esri products are the only available enterprise GIS products available on the market.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made. The agency will continue to monitor the market and search for vendors that can provide the services and products.
