JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
1. Agency/Contracting Activity: 103rd MSC
2. Description of Action: Building Management System Preventative Maintenance Agreement
Nature: New Requirement Follow-on Order Mod to Existing Order Number
Order against: Multiple Award ID/IQ Contract Number: GS-07F-135DA
Pricing: Firm-Fixed Price Time & Materials Cost Type
Funds: OMA Other Funds: LOCAL SRM
3. Description of Supplies or Services:
The 103rd Airlift Wing based at Bradley Air National Guard Base currently has a Building Management System(s) (BMS), providing energy and environmental control, installed in most of the buildings. As such, a preventative maintenance agreement is required in order to maintain the system(s) at the proper level.
Connecticut Air National Guard Bases require an annual preventative maintenance agreement to ensure that the BMS is operating correctly.
4. Authority:
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; [FAR 8.405- 6(a)(1)(B)];
5. Rationale/explanation to support cited authority: The main base DDC system is an Automated Logic System. This system was mandated by the NGB several years ago and we have attempted to use non Automated Logic Systems Controls but, have had no success with integrating them into the base wide system. If specific components are not installed and/or maintained in conjunction with the existing hardware, the system will suffer from performance degradation, warranty nullification, and/or inoperability.
In turn, this will result in increased project costs in terms of both time and money (system repair or replacement) to the Government.
6. Market Research: Automated Logic is the only local dealer for the company that manufactures the existing DDC system software and equipment. Only authorized dealers have access to the software and are allowed to work on the specific systems
7. Actions to Increase Competition: Automated Logic is the only authorized source for DDC system integration to the system that is presently in operation at 103 AW. At this time, the 103 AW can take no action to overcome competition barriers due to the nature of the system (software/equipment) to be maintained.
