JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the issuance of a five-year Fixed- Price Indefinite Delivery Indefinite Quantity (IDIQ) contract for the procurement of the CMC Electronique, Inc. (CMC) TacView Portable Mission Displays (PMDs) and associated equipment. The associated equipment includes a solid state drive, cable assembly right hand, cable assembly left hand, and PMD dust cover. This equipment will be procured sole source from the Canadian Commercial Corporation (CCC). As CMC is a Canadian company, United States Government contracts are to be awarded directly to the CCC. The CCC, a Canadian Government Agency, will subcontract 100% to CMC. Delivery Orders (DOs) will be issued on a Firm Fixed-Price basis. The delivery schedule is anticipated to be 90 days after each DO award. It is anticipated that the Government will be procuring a minimum quantity of 10 CMC TacView PMDs, 10 solid state drives, and 10 PMD dust covers. It is anticipated that the Government will be procuring a maximum quantity of 105 CMC TacView PMDs, 104 solid state drives, 53 cable assemblies right hand, 53 cable assemblies left hand, and 88 PMD dust covers throughout the ordering periods of the IDIQ.

3. Description of Supplies/Services.

The NAWCAD Webster Outlying Field Special Communications Mission Solutions Division has been tasked by the Program Office for the V-22 (Osprey) Program (PMA-275) to provide material and components in support of the communications upgrades to the CMV-22B aircraft.

The CMV-22B communications upgrades are intended to improve situational awareness and secure voice channels and beyond line of sight systems. PMA-275 requires a PMD with an approved flight clearance that meets cybersecurity approvals, specified military standards, and size requirements. The CMV-22B aircraft is replacing the C-2A Greyhound and fulfills the Joint Maritime Component Commander time-critical logistics air connector requirements for transporting personnel, mail, and priority cargo from land bases to the seabase.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Only CMC manufactures a PMD and associated equipment that meets the unique combination of requirements for flight clearance, military standards, cybersecurity approvals, compatibility with existing components, interoperability, integrated QWERTY keyboard, and size needed by PMA-

275. Flight clearance for the CMC TacView PMD was obtained with the previously-procured CMC TacView PMD on contract N0042118P0845, which was awarded on 30 August 2018 and included the procurement of the cable assemblies left hand. Additionally, the CMC TacView PMD and solid state drive were previously procured under contract N6833522C0389 in support of the communications upgrade to the CMV-22B aircraft.

The CMC TacView PMD is the only mission display that meets the standards listed in Radio Technical Commission for Aeronautics DO-160, Environmental Conditions and Test Procedures for Airborne Equipment standards; Military Standards (MIL-STD) 810H, Department of Defense (DoD) Test Method Standard: Environmental Engineering Considerations and Laboratory Tests; MIL-STD-461G, DoD Interface Standard: Requirements for the Control of Electromagnetic Interference Characteristics of Subsystems and Equipment; and MIL-STD-3009, DoD Interface Standard: Lighting, Aircraft, Night Vision Imaging System. The CMC TacView PMDs are part of the CMV-22B aircraft baseline and are compatible with the existing mounting system on the aircraft. The CMV-22B baseline aircraft Authority to Operate was issued 12 October 2021 and the CMC TacView PMD was incorporated within.

Alternating vendor, technology, make, or model would result in duplication of cost to the Government that is not expected to be recovered through competition. Changing the PMD would require redesign and qualification, laboratory, and flight testing to ensure that the requirements set by PMA-275 are met. Additionally, changing the PMD would require new and updated cyber certification for the aircraft baseline. Current estimates to perform these additional duplicative efforts are approximately $3.05M required to perform qualification testing, cyber testing, and laboratory testing and to conduct flight tests, which is anticipated to result in a two-year delay.

The delay would include a redesign to the intercommunications package that supports the Multifunctional Information Distribution System Joint Tactical Radio System (MIDS-JTRS) since the CMC TacView PMD and associated equipment are used in conjunction with the MIDS-JTRS.

The PMA-275 is on a strict schedule to deploy at least four aircraft that are fully-integrated with the communications upgrade solution by February 2024 to support the sundown of the C-2A Greyhound. The CMV-22B will fill in as a Joint Maritime Component Commander time-critical logistics carrier-onboard-delivery requirement by transporting personnel, mail, and priority cargo from land bases to the seabase in place of the C-2A Greyhound as its primary mission. The CMV-22B has secondary-missions consisting of Vertical Onboard Delivery, Vertical Replenishment, Medical Evacuation, and Mission of State. Any delay would cause a gap in critical transportation of personnel, mail, and priority cargo to the seabase, gravely impacting critical response time for fleet needs.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted via General Services Administration (GSA) Advantage and the Defense Logistics Agency’s (DLA’s) Public Logistics (PUB LOG) Federal Logistics Information System (FLIS) for the requested PMD and associated equipment. Searches of DLA’s PUB LOG FLIS and GSA Advantage yielded no results. The Google search engine was searched and found results from Curtiss-Wright Corporation; Garmin International, Inc.;

L3Harris Technologies, Inc.; and CMC. However, only TacView PMDs and associated equipment from CMC meet requirements. The Dynamic Small Business Search was also searched, but there were no results. CCC is CMC’s prime contractor to the DoD for the CMC TacView PMDs and associated equipment.

Additional market research was conducted to identify commercially-available PMDs. Multiple solutions were identified and reviewed to determine each solution's ability to meet the requirements of PMA-275. A Request for Information (RFI) for a Tactical Aircraft Display was posted on 15 June 2022. Of the manufacturers identified in the market research, only the CMC TacView PMD and associated equipment meet the requirements. A pre-solicitation synopsis was posted on 14 February 2023.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons stated in Paragraph 5, only the CMC TacView PMDs and associated equipment can meet the requirements for light clearance, military standards, cybersecurity approvals, compatibility with existing components, interoperability, integrated QWERTY keyboard, and size, but are being procured through the CCC because they are the only distributor authorized to sell the CMC TacView PMDs and associated equipment to the Government. The Government will continue to evaluate other technologies that would allow for future competition by conducting market research to determine if there are any future vendors that have the capability to meet this requirement.
