4. Statutory Authority Permitting other than Full and Open competition.

The statutory authority permitting the use of other than Full and open Competition is 41 USC

1901(e)(2) - a sole source acquisition under the authority of the test program for certain commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority.

The proposed requirement is to acquire the items in paragraph 3 from Cross Match

Technologies- the NOMAD Jumpkits. Cross Match Technologies (CMT) is the only producer of these captioned items that are required for use with the other currently used CMT products such as the LiveScan and SEEK devices in NCIS inventory and the Mission Oriented Biometrics

Software (MOBS). The NOMAD Jumpkits are biometrics kits with the ability to capture fingerprints, iris, facial photos, and biographic information that is smaller and more compact than the current version. The Nomad USB scanner is a proprietary scanner developed by CMT and only operates with the CMT Mission Oriented Biometrics Software (MOBS).

NCIS Biometric Branches utilizes more than one hundred and sixty (160) devices deployed worldwide that currently use the Mission Oriented Biometrics Software (MOBS).This software was developed by Cross Match Technologies (CMT). The software is proprietary to CMT and therefore they are the only ones able to provide the required maintenance support. In order to have mission cohesiveness and optimal functionality, the new systems need to have the same familiar software to perform at their most efficient levels in security and be capable of compatibility between all biometric screening operations that NCIS manages worldwide. Cross

Match Technologies (CMT) is the sole party capable and authorized to perform any needed software changes, modifications and/or updates. If any unauthorized personnel, company, or business performs any changes to the CMT proprietary MOBS system and devices, the warranty will be voided and as a result, it can create major setbacks to any mission requirements that

NCIS is responsible for worldwide.

CMT Jumpkits are required for specific NCIS ops like vetting where a large number of people need to be processed in as little time as possible. The NOMAD jumpkits allow for a faster throughput compared to our mobile biometric capture devices. At a recent base event in 2017, the average enrollment for processing people coming through the gates for the mobile capture device was roughly 2 minutes and 30 seconds while using the NOMAD jumpkit was only 1 minute and 30 seconds. The system is a force multiplier that aides in force protection, counterterrorism, counter narcotics, counter transnational organized crime, and National Security by rapidly enrolling personnel into the authoritative U.S. Government databases and providing match/no match results in near real time. The addition of the NOMAD Jumpkits will allow for increased use at more DoN bases throughout the world, which will result in increased security.

The CMT NOMAD jumpkits are a compilation of hardware that is put together in a kit that can be deployed. There are pieces in the kit that are proprietary to CMT and some that are not. The proprietary equipment is 93% of the total cost for the kit. This would make it less cost effective to try and purchase all the pieces separate and build our own kit that we can get ready to go out of the box. Also, if we tried to build our own kit, CMT would not guarantee the setup and we would not be covered by CMT maintenance.

This equipment has been thoroughly researched for, functionality and mission cohesiveness.

Integrating the required items into the operational and investigative support provided is of a critical need to limit unacceptable delays in fulfilling the NCIS’s mission requirements. The enhanced capabilities provided by NCIS, through the use the required items, is a current and expanding requirement. The required items cannot be substituted for other systems in the marketplace because these systems must operate in accordance with operational requirements in support of NCIS’s worldwide investigative obligations. As a result, the proposed acquisition can only be fulfilled by items manufactured (and distributed) solely by Cross Match Technologies.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The requiring activity and contracting activity have conducted market research among schedule holders. NCIS Biometrics contacted members of the Federal Bureau of Investigation and the

Defense Forensics Biometrics Agencies and determined that the Nomad is FAP 60 compliant and that MOBS creates a DoD EBTS compliant output file. Biometrics also contacted the vendor, Cross Match, to determine if any other fingerprint scanners would work with their proprietary software. The vendor stated that only Cross Match scanners are compatible with the proprietary MOBS software. NCIS has stated and confirmed that they have also tried another manufacturer’s security scanner-the Cogent USB fingerprint scanner, developed by Gemalto, in

2013. The Gemalto Cogent Fingerprint scanner could not be recognized while using CMT software. The computer sees the scanner, but the CMT software would not recognize, function, or produce the necessary data to fulfill NCIS objectives. NCIS mission considers the additions of the NOMAD Jumpkits beneficial to the DoN. These jumpkits will increase security and produce efficient technological compatibility between devices and systems that will be used at DoN bases throughout the world.

The Cross Match Technologies (CMT) Nomad USB fingerprint scanner is proprietary to the

CMT software that we use throughout the agency. The specification sheets for the Nomad

Jumpkit were reviewed online and determined that it was the same form factor as the kits NCIS already uses. The requiring activity certifies that the requirement can be met by a commercial item and provides supporting documentation which is attached- Market Research Memo, IGE.

7. Determination of Fair and Reasonable Cost. The NAVSUP Fleet Logistics Center (FLC)

Norfolk Philadelphia Office Contracting Officer has determined the anticipated cost to the Government for the equipment listed in paragraph 3 and covered by this J&A will be both fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

All future requirements will be handled on a case by case basis.

9. CONTRACTING POINT OF CONTACT: The point of contact at NAVSUP FLC

Norfolk Contracting Department, Philadelphia Office is Mr. James McDevitt (Code 280.3J) who may be reached at 215-697-5025 or james.h.mcdevitt@navy.mil mailto:james.h.mcdevitt@navy.mil
