About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for the U.S. Coast Guard's procurement of engine parts. The document seeks to justify a sole-source acquisition from YANMAR AMERICA CORPORATION or its authorized distributors for engine parts supporting 27' SPC-SW vessels. The key justification centers on the technical unavailability of manufacturing drawings and specifications from other vendors, which could potentially compromise vessel safety and mission capabilities if alternative parts were used.

The solicitation cites 10 U.S.C. § 3204(a)(1) as the authority, indicating "only one responsible source and no other supplies or services will satisfy agency requirements." The Coast Guard argues that YANMAR is the sole possessor of critical technical information required to properly manufacture the engine parts, and that using parts from other vendors could necessitate fabrication and potentially create hazardous operational conditions. The Contracting Officer's Representative (COR) will continue to conduct market research to potentially identify alternative vendors for future acquisitions.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT

WILL MEET THE GOVERNMENT’S REQUIREMENT.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. The purchase of ENGINE PARTS. The parts are in support of the 27’ SPC-SW. Vessel: Multi. (See Enclosure 1). The ENGINE PARTS are provided by YANMAR AMERICA CORPORATION the Original Equipment Manufacturer (OEM) or any of their authorized distributors.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. The technical data for the ENGINE PARTS required to make an accurate assessment of equal or alternate equipment meeting the Coast Guard’s performance, fit, form and function requirements for this procurement is unavailable.

The proper operation of the above parts is critical for the safety of both crew and vessel alike, especially during underway operations, where engine operability is of the utmost importance. Failure of the ENGINE PARTS would place a unit in a hazardous situation with the loss of engine use, possibly placing the vessel in a flooding situation. Any attempt to manufacture this item without the proper (OEM) parts and access to OEM reproduction manufacturing drawings, spec, tolerances/parameters, test procedures and other relevant information, could lead to major mission degradation. Therefore, all replacement parts offered shall be only “official brand” (OEM) parts.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). Researched the Internet for vendors available to provide the ENGINE PARTS, YANMAR AMERICA CORPORATION or any of their authorized distributors, are the suggested source that can provide the ENGINE PARTS installed. Searched for other vendors capable of supplying the ENGINE PARTS. While other vendors produce the ENGINE PARTS, to deviate from the installed brand may require fabrication upon installation.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

YANMAR AMERICA CORPORATION or any of their authorized distributors, are the suggested source that can provide the ENGINE PARTS to support the installed equipment. YANMAR AMERICA CORPORATION is the sole possessor of the drawings and other technical information required to properly manufacture the ENGINE PARTS. Another vendor’s parts may not contain the same fit, form and function. The installation of YANMAR AMERICA CORPORATION parts will ensure the continuity and configuration of the ENGINE PARTS installed at Coast Guard units. The Coast Guard does not have any technical information to deviate from the parts installed;

another vendor’s offer may lead to fabrication being necessary for installation.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. This is a proprietary commercial item of the proposed contractor. The reproduction of manufacturing drawings, specifications and other technical data related to this item were never purchased by the U.S. Coast Guard and therefore are controlled by and remain the sole property of the OEM.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. COR will continue to conduct market research in the attempt to locate vendors that can satisfy the needs of the Coast Guard including a requirement for manufacturer’s engineering drawings, detailed parts lists, design or testing procedures, and other relevant information concerning this item.
